HomeMy WebLinkAboutReso 1207-1947154 R2~OLUTION NO. 1207 RESOLUTION ORDERING THE CONSTRUCTION OF BASKETBALL COURTS IN THE OR~GE AVENUE PARK RESOLVED by the City Council of the City of South San Francisco that public interest and convenience require the followingttmp~o~msht?work to be done in said city: The construction of basketball courts in Orange Avenue Park in the City of South San Francisco. All said ~ork shall be done at the location shown upon the plans and specifications hereinafter mentioned and strictly in accordance with the plans and specifications heretofore submitted by the works engineer of said city and hereby sdopted for said work. All said work and the materials used in connection therewith shall be furmished under the direction and to satisfaction of the superintendent of streets of said city. The City Clerk is hereby directed to cause a notice inviting sealed proposals for doing said work and for the furnishing of all materials-necessary therefor to be published by two (2) insertions thereof, and not less than five (5) days apart, in "The Enterprise", a newspaper of general circulation published and ~rinted in the city of South San Francisco, which notice shall be substantially in the following form: NOTICE INVITING SEALED PROPOSALS OR BIDS FOR THE CONSTRUCTION OF BASKETBALL COURTS IN ORANGE AVENUE P~RK IN THE CITY OF SOUTH SAN FR;~CISCO Notice is hereby given that sealed proposals or bids will be received by the City Council of the City of South San Francisco on Nonday, the 5th day of N~y, 1947, until the hour of 8 o'clock p.m., for doing the following public improvement work in said city, to wit: The construction of basketball courts in Orange Avenue Park in the City of South San Francisco. All the work of constructing such basketball courts shall be done at the location shown upon the plans and specifications for said ~ork and strictly in accordance ~,lth the plans and specifications heretofore.adopted for said work. It shall be mandatory upon the contractor to whom the contract is awarded, and upon any subcontractor under him, to pay not less than the specified rates to all laborers, workmen and mechanics employed by them in the execution of thecontract. The contractor shall forfeit as a penalty to the City of South San Francisco Ten Dollars ($10.00) for each laborer, workman or mechanic employed, for each calendar day, or portion thereof, such laborer, worknmn or mechanic is paid less than the said stipulated r~tes for any work done under said contract, by him, or by any subcontractor under him. And such contract shall contain a stipulatien~ to this effect, in accordance with the provisions of Chapter 397 of'the Statutes of California, 1931. No bid will be accepted from any contractor who has not been licensed in accordance with the prqvisions of an act of the Legislature of the State of California entitled: "An Act Providing for th~ Registration of Contractors, and Defining the Te~m Contractor, Providing th~ Method of Obtaining Licenses to Engage in the Business of Contracting, and Fixing the Fees for ~$uch Licenses; Providing the Method ofSuspensmoa' ~nd Cancellation of Such Licenses; and Prescribing the Punishment for Violation of the Provisions of This Act." Chapter 791 of Statutes a~d Amendments of 1929, as Amended. Notice is further hereby given'that no contractor or subcontractor'or agent or representative thereof shall knowingly employ or cause or allow to be employed on the work herein provided for any alien, except in cases of extraordinary emergency c~used by fire, flood, or danger of life or property. The contractor of subcontractor to whom a con~rsct for said work may be awarded sh~ll forfeit as a penalty to the City of South S~n Frsmcisco Ten Dollars ($10.00) for each alien knowingly employed in the execution of s~ch contract, for each calendar day, or portion thereof, during which suc% alien is permiSted or required to labor in violation of the provisions of Article A of the Labor Code of the State of Gslifornia. A provision to this effect shall be inserted in such contract. The contract must be entered into in compliance with and subject to'the conditions imposed by Article 3 of the Labor Code of the State of California. Such contract shall contain a stipulation bo the effect that eight (8)~hours shall constitute a legal day's work in the performance of the ¥~rk herein provdded for, and that no contractor or subcontractor who employs, directs, or controls the work of any wor~aan employed on public work shall require or permit such workman to labor more than eight (8) hours during any one calendar day, except in cases of extraordinary emergency, caused.by fire, flood or dan~er to life or property and shall contain th~ further stipulation which shall provide that the contracto to whom the contract is awarded shall forfeit as a permlty to said City of South San Francisco Ten Dollars ($10.OO) for each wor~nan employed in the execution of such contract by the contractor or bM any subcontractor for each calendar day during which a~v workman is required or permitted to labor more than eight (8) hours in violation of the provisions of said Article 3. The contract to be awarded shall contain a further stipulation that the contractor, to whom such contract may be awarded, shall use or supply only such unmanufactured materials, produced in the United States, or substan- tially from materials produced in the United States, excepting only where such articles, materials or supplies from which they ~re manufactured, are not mined, produced or manufactured, as the case may be, in the United States, as required by Chapter ~, Article i of the Government Code of the State of California. Price, fitness and quality being equal said contr4ctor shall, in the performance of the contract, prefer supplies grown, manufactured, or produced in the State of California, and shall next prefer supplies partially manufactured, grown or produced in this state. The successful bidder shall, within ten (10) days ~fter the award, enter into a contract with the City of South San Francisco for the faithful performance of the work to be dome under said award. All sealed proposals or bids shall be adcompanied by a check payable to the City of South San Francisco, certified by a responsible bank for an amo~nt which shall not be less than ten (lO) per cent of the aggregate of the proposal, or by a bond for the said amount and so payable, signed by the bidder ~nd two (2) sureties who shall Justify before any officer competent to administer an oath in double said amount over and above all statutory exemptions. If the proposal be accepted and the contract awarded and if the bidder sha~l fail and neglect to execute a contr~,ct and ~.ive the bonds required, the sum mentioned in said check, or the principal sum of said bond, as the case may b~, shall be liquidated damages for such failure and neglect and shall be forfeited' to ~nd paid into the treasury of the City of South San Francisco. The bidder to whom the contrzct is awarded will be required to execute a bond for the faithful performance of hds work in an amount equal to fifty (50) per cent of the amo~mt of the undertaking with at least two (2) responsible sureties in the full amount of the bond each; and will also be required before enter, lng upo..n the work to furnish a good and sufficient bond, as required by ~n act of the Legislature of the State of California, approved May lO, 1919, entitled: "~m Act to Secure the Payment of the Claims of Persons Employed by Contrs.ctors Upon Public %~'orks and the Claims of Persons ~o Furnish Materials~ Supplies, Teams, Implements or Machinery Used or Consumed by Such Contractor in the Performance of Such ~7orks, and Prescribing the Duties of Certain Public Officers ~ith Respect Thereto", Chapter 303 of the Statutes of California, 1919. a~d Amendments of 1929, as amended. All sealed proposals will be opened by said City Council in public session on Monday, the 5th day of Nay, 19&7, at 8:00 o'clock p.m., at the Council Chamber of said City Council.
