A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH
SAN FRANCISCO PROVIDING FOR THE CONSTRUCTION OF A SAN-
ITARY SEWER IN MISSION ROAD.
RESOLVED by the City Council of the City of South San Francisco that public interest and convenien
require the following public improvement work to be done in said city:
Ail said work shall be dme in accordance with hhe plans and specifications submitted by the works
engineer of the City of South San Francisco for said work, which plans and specifications are hereby adopted
for said work.
All said work shall be done at the location shown upon said plans and all said work and the materi
used in connection therewith shall be furnished under the direction and to the satisfaction of said works
engineer of said city.
Said City Council of the City of South San Fran$isco hereby ascertains that the ~eneral prevailinf
rates for legal holiday and overtime work applicable to said work to be done are as follows:

Notice is hereby given tl~t sealed
proposals or bids will be receiv~l on
the 7th day of July, 1947, 'until the
hour of 8 o'clock p. m.. for doing
the following work for said City. of
South San Francisco:
The construction of an eight (8)
inch sanitary sewer from a man-
hole in the intersection of Grand
Avenue and Mission Road north-
westerly along said Mission Road for
a distance of five hundred and
twenty eight (528) feet.
All said work shall be done at the
location shown upon the plans here-
tofore adopted by the City Council
of the City of South San Francisco
for said work and strictly in ac-
cordance with the plans and speci-
fications heretofore adopted for said
work. All such work and the ma-
terials used in connection therewith
shall be furnished under the direc-
tion and to the satisfaction of John
E. Estes, works engineer of said city.

each laborer, workman or mechanic
employed, for each calendar day, or
portion thereof such laborer, work-
man or mechanic is paid less than
the said stipulated rates for any
work done under said contract, by
him, or by any subcontractor under
him. And such contract shall con-
tain a stipulqtion to this effect, in
accordance with the provisions of
Chapter 397 of the Statutes of Cali-
fornia, 1931.
For the duration of the wars in
which the United States of America
is now engaged, payment for over-
time work shall be made in accord-
ance with the executive order of the
President of the United States of
America, dated September 10, 1942,
if such payment for overtime work
is legally subject to and legally con-
trolled by said order.
No bid will be accepted from any
contractor who has not been li-
censed in accordance with the pro-
visions of Division III, Chapter 9 of
the Business and Professions Code
of the State of California.
Notice is further hereby given
Said City Council has ascertained that no contractor or subcontractor
that the general prevailing rates of or agent or representative thereof
per diem wages and the general pre- shall knowingly employ or cause or
vailing rates for legal holidays and allow to be employe~ on the work

of the Labor Code of the State of
California. A provision to this effect
shall be inserted in such contract.
The contract must be entered in-
to in compliance with and subject
to the conditions imposed by Divi-
sign II, Part 7, Chapter I, Article 3
of the Labor Code of the State of
California.
Such contract shall contain a sti-
pulation to the effect that eight (8)
hours shall constitute a legal day's
work in the performance of the
work herein provided for, and that
no contractor or subcontractor who
employs, directs or controls the
work of any workman employed on
public work shall require or permit
such workman to labor more than
eight (8) hours during any one cal-
endar day, except in cases of extra-
ordinary emergency caused by fire,
flood or danger to life or property
and shall contain the further stipu-
lation which shall provide that the
contractor to whom the contract is
awarded shall forfeit as a penalty to
the City of South San Francisco Ten
Dollars ($10,00) for each workman
employed in the execution of such
contract by the contractor or by
any subcontractor for each calendar
day during which any workman is
required or permitted to labor more
than eight (8) hours in violation
of the provisions of said Article 3.
The contract to be awarded shall
contain a further stipulation that
the contractor, to whom such con-
tract may be awarded, shah use or
supply only such unmanufactured
of ~outh San Francisco for the faith-
ful performance of the work to be
done under said award. All sealed
proposals or bids shall be accom-
pan~ed by a check payable to the
City of South San Francisco, certi-
fled by a responsible bank for an
amount which shall not be less than
ten (10) per cent of the aggregate
of the proposal, or by a bend for
the said amount and so payable,
signed by the bidder and two (2)
sureties who shall justify before any
officer competent to administer an
oath in double said amount over
and above all statutory exemptions.
If the proposal be accepted and the
contract awarded and if the bidder
shall fail and neglect to execute a
contract and give the bonds re-
quired* the sum mentioned in said
check, or the principal sum of said
bond, as the case may be, shall be
liquidated damages for such failure
and neglect and shall be forfeited
to and paid into the treasury of the
City of South San Francisco. The
bidder to whom the contract is a-
warded will be required to execute
a bond for the faithful performance
of his work in an amount equal to
fifty (50) per cent of the amount of
the undertaking with at least two
(2) responsible sureties in the full
amount of the bond each; and will
also be required before entering up-
on the work to furnish a good and
sufficient bond. as required by Title
1, Division 5, Chapter 3 of the Gov-
ernment Code of the State of Cali-
fornia.

It shall be mandatory upon the
contractor to whom the contract is
awarded, and upon any subcontract-
or under him, to pay not less than
the s~rates to all laborers,
workmen. ~ mechanics employed

The contractor or subcontractor
to whom a contract for said work
may be awarded shall forfeit as a

thereof, during which such alien is
permitted or required to labor in
violation of the provisions of Divi-
sion II, Part I, Chapter I, Article 4
of the Labor Code of the State of

Price, fitness and quality being
equal, the successful bidder shall,
in the performance of his contract,
prefer supplies grown manufactured
or produced in the State of Califor-
nia, and'shall next prefer supplies
partially manufactured, grown or
produced in this state, as required
by Title 1, Division 5, Article 2 of
the Government Code of the State

The successful bidder shall, with-
in ten (10) days after the award,
enter into a contract with the City
of South San Francisco for the faith-
ful performance of the work to be
done under said award. All sealed
proposals or bids shall be accom-

gineer, City Hall, South San Fran-
cisco, California.
Sealed proposals or bids will be
delivered to the City Clerk of the
City of South San Francisco, in tho
City Hall, South San Francisco. Cali-
fornia, on or before 8:00 o'clock
p. m. on Monday, the 7th day of
July, 1947.
All sealed proposals or bids will
be opened by said City Council on
Monday, the 7th day of July, 1947,
at 8:00 o'clock p. m.
Said City Council hereby reserves
the right, in its discretion, to re-
ject any and all bids and to award
the contract for all said work, or
for any portion or portions thereof.
