RESOLUTION NO. 1223
RESOLUTION ORDERING THE CONSTRUCTION OF A CONVENEINCE
STATION IN THE ORANGE AVENUE PARK.
RESOLVED by the City Council of the City of South San Francisco that public interest and convenience
require the following improvement work to be done in said city:
The construction of a convenience station in the Orange Avenue Park in the City of South San Francisco.
All said work shall be done at the location shown upon the plans and specifications hereinafter mentioned
and strictly in accordance withtthe p~an~ and specifications heretofore submitted by the works engineer of said
city and hereby adopted for said work. Ail said work and the materials used in connection therewith shall be furn-
ished ,mder the direction and to the satisfaction of said works engineer.
Said City Council hereby ascertains that the general prevailing rates o~ per diem wages and the general
prevailing rates for legal holiday and overtime work applicable to said work to be d~e are as follows:

The following are to be consid-
ered holidays: New Year's Day,

Labor Day, Admission Day, Thanks-
giving Day, Christmas Day, Satur-
day and Sundays.
It shall be mandatory upon the
contractor to whom the contract is
awarded, and upon any subcontrac-
tor under him, to pay not less than
the specified rates to aH laborers,
workmen and mechanics employed
by them in the execution of the con-
tract. The contractor shall forfeit as
a penalty to the City of South San
Francisco Ten Dollars ($10.00) for
each laborer, workman or mechanic
employed, for each calendar day. or
portion thereof, such laborer, work-
man or mechanic is paid less than
the said stipulated rates for any
work done under said contract by
him, or by any subcontractor under
him. And such contract shall con-
tain a stipulation to this effect, in
accordance with the provisions oI
Chapter 397 of the Statutes of Cali-
fornia. 1931.
No bid will be accepted from any
contractor who has not been li-
censed in accordance with the pro-
visions of an act of the Legislature

hour of 8 o'clock p. m., for doing
the following public improvement

such convenience station shall be

Licenses; and FrescriMn~ the Pun-

as amended.
Notice is further hereby given
that no contractor or subc~tractor
or agent or representative thereof
shall knowingly employ or cause or
allow to be employed on the work
herein provided for any alien, except
in cases of extraordinary emergency
caused by fire, flood, or danger to
life or property.
The contractor or subcontractor
to whom a contract for said work
may be awarded shall forfeit as ·
penalty to the City of South
Francisco ?e~ Dollars ($10.00)

The contract must be entered into
in compliance with and subject to
the conditions imposed by Article 3
of the Labor Code of the State of
California.
Such contract shall contain a sti-
pulation to the effect that eight (8)
hours shall constitute a legal day's
work in the performance of the
work herein provided for. and that
no contractor or subcontractor who
employs, directs or controls the
work of any workman employed on
public work shall require or permit
such workman to labor more than
eight (8) hours during any one cal-
endar day, except in cases of extra-
ordinary emergency, caused by fire,
flood or danger to life or property
and shall contain the further stipu-
lation which shall provide that the

Price, fitness and quality being
equal said contractor shall, in the
performance of this contract, prefer
supplies grown, manufactured, or

duced in this state.
The successful bidder shall, with-
in ten (10) days after the award,
enter into a contract with the City
of South San Francisco for the faith-
ful performance of the work to be

tioned in said check, or the principal
sum of said bond, as the case may

Francisco. The bidder to whom the
contract is awarded will be required
to execute a bond for the faithful
performance of his work in an
amount equal to fifty (50) per cent
of the amount of the undertaking
with at least two (2) responsible
sureties in the full amount of the
bond each; and will also be required
before entering upon the work to
furnish a good and sufficient bond,
as required by an act of the Legis-
lature of the State of California. ap-
proved May 10, 1919, entitled "An
act to secure the payment of the
claims of persons employed by con-
tractors upon public works and the
claims of persons who furnish ma-
terials, supplies, teams, implements
or machinery used or consumed by
such contractor in the performance
of such works, and prescribing the
duties of certain public officers with
respect thereto," Chapter 303 of the
Statutes of California, 1919.
Plans, specifications and proposal
sheets may be obtained at the office
of the works engineer of the City
of South San Francisco, in the City
Hall of said city, in South San Fran-
cisco, California.
Sealed proposals or bids will be
delivered to the city clerk on or be-
fore 8:00 o'clock p. m., on Monday
the 7th day of July, 1947.
All sealed proposals will be op-
ened by said City Council in public
session on Monday, the 7th day of
July, 1947, at 8:00 o'clock p. m., at
the Council Chamber of said City
Council.
Said City Council reserves the
:ight to reject any and all bids.
