HomeMy WebLinkAboutReso 1255-1947RESOLUTION 0E INTENTION NO. %255 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DECLARING ITS INTENTION TO DO CERTAIN PUBLIC .IMPROYEEENT~iWORK IN THE CITY OF SOUTH SAN FRANCISCO IN THE SUBDIVISION KNOV~N AS BREN~OOD S~DIVISION NO. 3. ;'~IEREAS public interest and convenience require that the work and improvements hereinafter described should be done; and ~{EREAS, in the opinion of the City Council of the City of South San Francisco, said contemplated work and improvement is, and is hereby declared to be of more than local or ordinary public benefit; and ~EREAS Jesse Horn and Myrtle Horn, his w~f~, Lenry orn and Lmllian Horn, his wife, Perry Liebman and Ysabel Liebman, his wife, Ira S. Hohn and Ruth N. Kohn, his wife, and Lloyd J. Cosgrove and Anne V.Cosgrove, his wife, as owners of all that certain tract of land delineated upon that certain map entitled: "Brent~.~ood Sub- division No. ~, South San Francisco, San Mateo County., California", which map ~s filed in the office of the County Recorder of the Councty of San Mateo, State of California, August 15, 19&7, and recorded in Book 27 of ~aps at pa~es Al, A2, d3, and AA, have filed with~he City Clerk of said city an instm~men~ in writing reading as follows: "WAIVER OF P~O%ISIONS OF SPECIAL ASSESSKENT AND INVESTIGATION, LI~[ITATION AND ¥~AJORITY PROTEST ACT. Jesse Horn and~yrtle Horn, his wife, Henry Horn and Lillian Horn, his'~ife, Perry Liebman and Ysabel Liebman, his wife, Ira S. Kohn and Ruth N. Kohn, his wzfe, and Lloyd C. Cosgrove and Anne . ~osgrove, hms wife, as owners of all that certain tract of land delineated upon that certain map entitled: "Brentwood Subdivision No. 3, South San Francisco, San Mateo County, California", which map was filed in the office of the County Recorder of the County of San Mateo, State of California, August 15, 19~7, and recorded in Book 27 of Maps at pa~es ~1, ~2, A3 and ~, hereby waive the benefit of that certain act of the Legislature of the State of California known and designated as "Special Assessment Investigation, Li~mitation and Eajority Protest Act of 1931", v~th respect to all the improve- ments hereinafter mentioned. Said improvements are designated as follows: The construction.of vitrified clay pipe sanitary sewers, ~th manholes: concrete pipe storm sewers, with manholes, catch basins, and appurtenances; the installation of fire alarm boxes, the installation of_ fire hydrants at the locations sho~n on the plans hereinafter mentioned, the construction of cement concrete curbs, ~tters and sidewalks and the construction of a 5-inch waterbound macadam base psvement with 2~ inch asphaltic concrete ~ear~ng surface in Northwood Drive, Greenwood Drive, Ravenwood .Vay, Sherwood ~;~ay, Rosewood Way, Rriarwood Drive, Conmur St. Hazslwood Drive, Wildwood Drive, and ~ockwood Drive, the construction of a con=rete storm se~er with concrete head- wall in the parcel of land designated "playground" on the plans for all s~id work now on file in th~ office of the City Clerk of the City of South San Francisco, in the County of San 5fateo, State of California, the construction of concrete pipe storm water sewer, with catch basins and appurtenances, in those certain strips of land described as follows: The oublic utility easements ~esignated P. U. E. between lots numbered seventeen (17) and eighteen (18) in block numbered thirty-seven (37), between lots numbered twenty-eight (2~) and twenty-nine (29) in blo~ck thirty-seven (37), and between lots n,3mbered eighteen (1~) and nfneteen (19) in block n~nnbered twenty-t~o (22) and the cosstruction of a cement concrete lined drainage ditch in the ten-fSot (~O) public utility easement designated P. U~ E. along the southwesterly line of lots numbered sixteen (16), seventeen l~), and emghteen (1R) in block thirty- seven (37); and the construction of a cement concrete lined ditch in the ten- (lC-) foot public utility easement designated P. U. E. along the southeasterly line of lot n~unbered n~.neteen (19), in block twenty-t~o (22); all as shown upon said map of Brentwood Subdivision No. ~. The plans and specifications for all said work are now on file in the 6ffice of the City ~lerk of the City of South San Francisco. ~¥e hereby consent that the u~ty ounc~l of the City of South San Francisco may proceed with said improvements work and to the designation of the land described on the above-mentioned map as the district to be benefited by such improvement. All the work herein provided for shall be ~one in accordance with the special plans, profiles and specifications for said work, apd at the location and to the grades shown upon said plans, which plans, ~rofi and specifications are entitled: "Plan§'and:~specifications for the construdtion of improvements in the tract of land known as Brentwood Subdivision No. 3", which plans, profiles and specifications were heretofore adopted by said City Council on the 25th day of August, 19&7, and are now on file in the office of th~ city clerk. Reference is hereby made to said plans, profiles and specifications for a full description of said work and for 'the location and the extent of the work to be done hereunder and for the grades to which said work is to be done, and for a particular description of the boundaries of the district herein mentioned. Said City Council does hereby determine and declare that said proposed work and improvement is of more than local or ordinary public benefit and will affect and benefit the lands and district hereinafter describ which said district is hereby declared to be the district benefited bY said work and imorovements and that, there fore, the entire cost and expense o6 said work and improvement shall be and hereby are made charageable against and shall be assessed upon said lands and district, except as hereinafter expressly provided, which district is within ~he City of South San ~rancisco, County of San Mateo, State of California, and particularly described as follows~ to wit: The exterior boundary of all that certain tract of land delineated upon that certain map enfitled: "Prentw~od Subdivision No. 3 South San Francisco, San ~ateo CountY, California~,:which map was filed in th~ offic of the County Recorder of the County of San Mateo, State of California, on August 15, 1947, and recorded id Book 27 of Maps at pages Al, A2, &3, and d~, saving, excepting and excluding from said district all public streets avenues and alleys, lanes, courts and places included and contained. Notice is hereby given that serial bon~s to represent unpaid assessments, and to bear interest at the rate of five (5) percent per annum, ~dll be issued hereunder the manner provided by Division I0 of~the ~treets.and Highways Code, in the Improvement Bond Act of 1915, and the last instalDaent of such bonds sh~ll mature fourteen (lA) years from the second day of July, next succeeding ten (lC) months from their date. The "South Sa~ Francisco Journal", a newspaper of general circulation, printed and p~bl~sh~d in said City of South San Francisco, is hereby designated ~s the newpaper in which this resolution of intention shall be published, and the City Clerk. is hereby directed to cause this resolution to be published by two-(2) insertlens in the manner and form required by law. Said City Clerk is also directed to mail a notice of the adoption of said resolution of intention of posta{e prepaid, to all persons own]ng real property which is proposed to te ~ssessed to pay any part df the cost of .said work, whose names and addresses api.~ar on the last equalized assessment roil, or as known to sa]d City Clerk. The Superintendent of Streets shall cause to be conspicuously posted along the line of said contemplated Work or improvements, and not more than three hundred (300) feet i~ distance apart, but oct less than three (3) in all, and along the open streets within said district as not more than three hundred (300) feet in distance apart on each said street, notices of the passage o~ this resolution of intention, the manner and form respired by the "Improvement Act of 1911". Notice ~s hereby given that, on 5ronday, the 15th day of September, 19~7, at the hour of 8 o'clock p.m., ~n the Council Chamber of said City Council of the City of South San Francisco, any and all persons having any objections to the proposed work and improvements may ~ppear before said City Council and show .cause why said proposed work and improvements should not be carried out in accordance w~th this resolution. Except as hereinbefore provided, all of the herein proposed work shall be done pursuant to an act of the Legislature of the State of California designated as "Improvement Act of 1911". I hereby cert~(y that the foregoing resoluti, on was reFularly introduced and adopted by the City Council of the City of South San Francisco, this 25th day of August, 19A7, by the following vote: Ayes, Noes, ABsent?
