A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO
PROVIDING FOR ACQUIRING THE USE OF A SMALL BOAT PIER BY THE CITY OF
SOUTH SAN FRANCISCO
RESOLVED by the City Council of the City of South San Francisco that public interest and convenience
require that said city acquire the use of a ~all boat pier in said city upon the terms and conditions stated in the
notice hereinaffter provided.
· The work of constructing said small boat pier shall be done at the location and upon the land herein-
after mentioned and strictly in accordance with the plans and specifications heretofore submitted by the work engineer
of said city for said work and hereby adopted for said work and in accordance with the agreement provided for in the
notice required to be given under this resolutionl Ail of the said work and the materials used in connection herewith
shall be furnished under the direction and to the satisfaction of the work~ engineer of said city.
The City Council hereby ascertains that the general prevailing rates of per diem wages and the general
prevailing rabes of legal holiday and overtime work applicable to said work to be 'done are as follows:' ''

The'City Clerk is hereby directed to cause a notice inviting sealed proposals for doing said work and
for furnishing all the materials necessary therefor to be published by two (2) insertions thereof, and not less than
five (5) days apart in "The Enterprise", a newspaper of general circulation, published and printed in the City of South
San Francisco, which notice shall be substantially in the following form.
NOTICE INVITING SEALED PROPOSALS OR BIDS FOR THE C(NSTRUCTION OF
A SMALL BOAT PIER IN THE CITY OF SOUTH SAN FRANCISCO AND FOR
LEASING SUCH PIER TO SAID CITY.
"' Notice is hereby given tha~ sealed proposals or bids will be received by the City Council of the City of
South San Francisco on the 17th day of November, 19~7, at the hour of 8 o'clock p.m., for doing the following public
work in said city, to wit~
The construction of a small boat pier on the land situate in the City of South San Francisco, County of
San Mateo, State of California~ and hereinafter described.
The land hereinbefore referred to is all that certain tract or parcel of land situate .in the City of South
San Francisco, County of San Mateo, State of California, and described a~ follows:
BEGINNING at a point which bears North 508.85 feet, North 6~° ~5' East ~2.60 feet, North 33° ~5' East
167.89 feet, East 243.~7 feet and. South 190 feet more or less from the South easterly corner of that certain parcel
of land acquired by Wtldberg Brothers, a description of which was recorded March 9, 1923, in Volume 66 of Official
.Records at Page 381, San Mateo County Records; thence ~rom said point of beginning South l0 feet; thence East.260
feet; thence North 20 feet; thence West ~60 feet; .thence South 10.feet to the point of beginning.
All work of constructing such small boat pier shall be dofle~ the location shown upon the plans for
said work and strictly in accordance with the plans and specifications heret~go~adopted for said work. All such
work and the materi.als used in connection therewith shall be furnished under the direction and to the satisfaction
of the works engineer of said city. .
Said City Council has ascertained that the general prevailing rates of per diem wages and
the general, per diem rates for legal holidays and overtime work applicable for said work to be done are

appear in the special provisions, as interpreted in the light of this classification.

It shall be mandatory upon the contractor to whom the contract is awarded, and upon any
subcontractor under him, to pay not less than the specified rates to all laborers, workmen and mechanics
employed by them in the execution of the contract. The contractor shall forfeit as a penalty to the City
of South San Francisco Ten Dollars ($10.00) for each laborer, workman or mechanic employed, for each
caSendar day, or portion thereof, such laborer, workman or mechanic is paid less than the said stipulated
rates for any work done under said contract, by him, or by any subcontractor under him. And such contract
shall contain a sti~ulation to this 'effect, in accordance with the 'pro'visions of Cha~te~ 397 of the
Statutes of California, 1931.
No bid will be accepted from any contractor who has not been licensed in accordance with
the provisions of an act of the Legislature of the State of California entitled: "An act providing for the
registration of contractors, and defining the term contractor, providing the method of obtaining licenses
to engage in the business of contracting, and fixing the fees ~.r such licenses; providing the method of
suspension and cancellation of such licenses; and prescribing the punishment for violation of the provisions
of this act", Chapter 791 of Statutes and Amendments of 1929~ as amended.
Notice is further hereby giVen that no contractor or subcontractor or agent or representative
thereof shall knowlingly employ or cause or, allow to be employed on the work herein provided for any alien,
except in cases of extraordinary emergency caused by fire, flood, or danger to life or property,
The contractor or subcontractor, to whom a contract for said work may be awarded, shall for-
feit as a penalty to the §ity of South San Francisco Ten Dollars ($10.00) for each alien knowingly employed
in the execution of such contract, for each calendar day, or portion thereof, during which such alien is
permitted or required to labor in violation of the provision s of article ~ of the Labor Code of the State
of California. A provision to the effect shall be inserted in such contract.
Such contract shall contain a stipulation to the effect that eight (8) hours shall constitute
a legal day's w~rk in the performance of the work herein provided for, and that no contractor or subcontract~
who employs, directs, or controls the work of any wer~m_an employed on public work shall require or permit
such workman to labor more than eight (8) hours during any one calendar day, except in cases of extraordina~
emergency, 'caused by fire, flood or danger to life or property and shall contain the further stipulation
which shall provide that the which shall provide that the contractor, to whom the contract is awarded, shall
forfeit as a penalty ~o said City of South San Francisco Ten Dollars ($10.00) for each workman employed in
the execution of such contract by the contractor or by any subcontractor for each calendar day ~uring which
any workman is required or permitted to labor more than eight (8) hours in violation of the provisions of
said Article 3.
The contract to be awarded shall contain a further stipulation that the contractor, to whom
such contract maybe awarded, shall use or supply only such unmanufactured articles, materials, and supplies
as may have been mined or produced in the United Statee and only such manufactured articles, materials,
and ~upplies as have been manufactured in the United States, substantially from all articles, materials
or Supplies mined, produced, or so m~ufactured, as the case may be, in the United States, excepting only
where such articles, materials or supplies frem which they are manufactured are not mined, proabAced or
manufactured, as the case maybe, in the United States, as required by an act of the Legislature of the
State of California entitled: "An act to require the use of materials and supplies substantially produced
in the United States, in publia works and for public purposes"; Chapter 226 of the Statutes of California,

The successful bidder shall, within ten (10) days after the aWard, enter into a contract with the
City of South San Francisco for the faithful performance of the work to be done under said award. Ail sealed
proposals or bids shall be accompanied by a check payable to the City of South 5an Francisco, certified by a
responsible bank for an amount which shall not be less than ten (10) percent of the ~ggregate of the proposal,
or by a bond for the said amount and so. payable, signed by the bidder and two (2) sureties who shall Justify
before an~ officer competent to admisister an oath in double said amount over and above all statutory exemptions.
If the proposal be accepted, and the contract awarded and if the bidder shall fail and neglect to execute a contract
~sand give the bonds required, the sum mehtioned in said check, or the principal sum of said bond, as the case may
be, shall be liquidated d_-m~-ges for such failure and neglect and shall be forfeited to and paid into the treasury
of the City of South San Francisco. The bidder to whom the contract is Awarded' will be required to execute a
bond for the faithful performance of his Work in an amount equal to fift~ (50) percent of the amount of the under-
taking with at least two (2) repponsible Sureties in the full amount of the bond each; and will also be required
before entering ~pon the work to furnish & good and sufficient bond, as required under the provisions of Section
2,200 et seq. of the Government Code of the State of California.
The successful bidder will'be required to enter into an agr&ement with the City of South San Fran-
cisceffor the construction of such small boat pier and in which agreement such successful bidder shall agree to
lease from said city the land hereinbefore described for a period of four (2) years from the date of such agreement
at the monthly rental of One Dollar ($1.OO) per month, and under which agreement the successful will execute a least
of said land, with such small boat pier t~ said city for the period of three (3) years following the date of actual
hompletion of the c onstruetion of such pier. The annual rent under the lease to be eXecuted by such successful
bidder to said city shall be an amount of money which shall equal one-third (1/3) of the amount of the bid of such
Successful bidder and shall be payable annually in advance at the times following: One-Third (1/3) of the amount of
such bid shall become payable on the expiPation of thirty-five (35) days from the date of actual completion of con-
struction of such pier; one-third (1/3) of the amount of said bid shall become payable on the expiration of one
(1) year and thirty-five (35) days followin~.~ the date of such completion;a dn one-third (1/3) of the amountqof
such bid shall become due and payable on the expiration of two (2) years and thirty-five (35) days from the date of
such actual!completion. The lease to be executed by such successful bidder to said cit~, under the agreemtn of
above mentioned, 'shall provide that said City of South San Francisco 'shalI have th8 option and privilege of
purchasing such small boat pier for the s~m of One Hundred Dollars ($100.00), provided ~hat said city shall have
given such successful bidder notice of its election to exercise such option within the last month of the term of
the lease to be executed by such successful bidder to said City of .South San Francisco.
Plans, specifications and proposal sheets may be obtained at the office o~ the Works Engineer of
said City of South San Francisco, in the City Hall of said City, in South San Francisco, California.
Sealed proposals or bids will be delivered to the City Clerk on or before 8 o' clock p.m., on Monday
the 17th day of November, 19&7.
Ail sealed proposals will be opened by said City Council in public ~ession on Monday, the 17th day
of November, 19~7, at 8 o'clock p.m., in the Council Chamber of said City Codncil.
Said City Council reserves the right to reject any and all bids.
