HomeMy WebLinkAboutReso 1325-1948RESOLUTION NO. 1325 A RE~OLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DECLARING ITS INTENTION TO CONSTRUCT A SANITIRY S~ER IN SOUTH MAPLE AVENUE IN SAID CITY. WHEREAS public interest and convenience require that the work and improvement hereinafter described should be done; and ~F.~S, in the opinion of the City Council of the City of SoUth ~an Francisco, said comtemplated work and improvement is, and is hereby declared to be of more than local or or~iaary bemefit; and WHEREAS THE ownere~.~ of more than Eight-five (8~) percent of the area of the district of land proposed to be assessed to pay the costs and expenses of bhe work hereinafter mentioned did, by an instrument in writing, waive the. benfit of the certain act of the Legislature of the ~ate of California known and designat~ as "The Special Assessment Investigation, Limitation and Majority Protest Act of 1931", and have requested that the improvement work hereinafter mentioned should be performed, and that the cost of said improvement work be assessed upon the district hereinafter mentioned, which instrument is now on file in the office of said City Clel and WHEREAS an estimate on the cost and expense of said work has been filed with City Clerk; NOW, THEREFORE, RESOLVED BY the City Council of the City of South San Francisco that it is the intention of said City Council to order the following work and improvement to be done in said City; The constru, tion of a sanitary sewer in South Maple Avenue and ina right-of-way connected to said South Maple Avenue in said City, at the location shown ~pon the plans heretofore adopted for said work. ALL the work herein provided for shall be done in accordance with the special plans, profiles and specifications for said work, and at the location for said work and to the g~a~es shown upon the plans, whicl plans and a~e~-Afications were adopted by said City Council on the 15th day of March, 19~8, and are now on file in the office of the City Clerk. Reference is hereby made to said plans and specifications for the description of said work and fo~ the location and the extent of the work to be done thereunder and for the grades to which said work shall be don. and for a particular description.of the boundaries of the district herein mentioned. Said City Council does hereby determine and declare that said proposed work and improvement is of more than local or ordinary public benefit and will effect and benefit the land and district hereinafter descri~, which said district is hereby declared to be the district benefited by said work and improvement, and that, ther, fore, the entire cost and expense of said work of said improvement shall be and are hereby made chargeable and shall be assessed upon said land and said district, e:[cept as hereinafter expressly provided, which district is within the City of South.San Francisco, County of San Mateo, State of California and particularly described as follows, to-wit I COMMENCING at a point which bears south 15o33' west 60 feet and north 72027' west 2~3 feet from tl intersection of the westerly boundary of South Linden Avenue with the southerly boundary of Drainage Canal Right. of-way; thence from said point of commencement north 7~° 27' west 800 feet; thence south 15° 33' west 1157.62 feet; t~enceoaouth ?Ac 27' east 550 feet; thence north 15° 33' east 200 feet; thence south 72° 27' east 250 feet thence north 15° 33' east 957.62 feet to the point of commencement; excepting therefrom all streets, alleys, avenues, courts and places included and contained. Notice is .hereby given that serial bonds to represent unpaid assessments and to bear interest at' ra~.e of five (5%) percent per annum, will be issued hereunder in the manner provided by Division 10, of the S~re and Highways Code, The Improvement Bond Act of 1915, the last installment of which bonds shall mature fourteen (12) years from the 2nd day of July next succeeding ten (10) months from their date. "The ~nterprise#, a newspaper of general circulation, printed and published in said City of South San Francisco, is hereBy.designated as the newspaper ia which this resolution of intention shall be published, and the City Clerk is directed to cause this resolution of intention to be published by two (2) insertions in the manner and form required by law, 256 Said City Clerk is also directed to mail a natice of the adoption of this resolution of intention postage prepaid, to all persons owning real property which is proposed to be assessed to pay any part of the costs of said work, whose names and addresses appear on the last equali~med assessment roll of said City, or as know~ ~e said City Clerk. The Superintendent of Streets shall cause to be conspicuously posted along the line of said contem- plated work or ..improvement, and not more than three hundred (300) feet in distance apart, but not less than three (3) in all, and along all the open streets within s%id district at not more than three hundred (300) feet in dis- tance apart on each paid street., notices of the passage of this resolution of intention, in the manner and form required by the "Improvement Act of 1911#. Notice is hereby given that on Monday, the 5th day of April, 19~8, at the hour of 8 o' clock p.m. in the Council Chamber in the City Hall, in the City of South San Francisco, any and all persons having any objections to the proposed work and improvements may appear before said City Council and show cause why said proposed work and improvements should not be carried out in accordance with this resolution. Except as hereinbefore provided, all work hereinbefore mentioned shall~be done pursuant to an act of Legislature of the State of California, designated as "Improvement Act of 1911". I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco this 15th day of March, 19~8, by the following vote: Ayes, Councilmen G.
