City Clerk is hereby directed to publish a notice by two (2) insertions in "The Enterprise", a news- paper of general circulation printed and published in the City of South San Francisco, a notice inviting the sealed proPOsals for the construction of such recreation buildings, which notice shall be substantially be in the following form: NOTICE INVITING SEALED PROPOSALS FOR THE CONSTRUOTION OF THREE RECREATION BUILDI~C,S IN THE CITY OF SO~3TH SAN FRANCISCO Notice is hereby given, that sealed proposals or bids will be received by the City 8ouncil of the City of South San Francisco, on Monday, the 5th day of April, 19&8, until the hour of 8:00 p.m. for doing the following public work in said City, to-wit: The construction of three recreation buildings in said City of South San Francisco, at the places shown upon the plans hereinafter mentioned, for the construction of such buildings. Ail work shall be done in strict accordance with the plans and specifications submitted by ~illiam Henry Rowe, architect, which plans and specificatioasswere adopted by said City Council 'for said work on the 15th day of March, 19&8, ands:are now on file in the office of City Clerk of said City. Ail classifications to be paid time and one-half for time over eight (8) hours, Saturdays and holidays, and double time on Sundays. and on Monthly rates are to be equal to the above based on a l?6-hour working month. The following are to be considered holidays: New Year's Day, Decoration Day, Independence Day, Labor Day, Admfssion Day, Thanksgiving Day and Christmas Day. Price, fitness and quality being equal, the successful bidder shall, in the performance of his contract, prefer supplies grown, ,~nufactured or produced in the State of California, and shall next prefer supplies partially manufactured, grown or produced in this state, as required by Title 1, Division 5, Article of the government code of the State of California. The successful bidder shall, within ten (10) days after the award, enter into a contract with the City of South San Francisco for the faithful performance of the work to be done under said award. Ail sea] proposals or bids shall be accompa~ied by a check payable to the City of South San Francisco, certified by a responsible bank, in an amount which shall not be less than ten (10) per cent of the aggre~te of the proposal, or by a bond for the said amount and so payable, signed by the bidder and two (2) sureties who shall Justify, before any officer competent to administer an oath, in double that amount over and above all statutory exempti¢ if the proposal be accepted and the contract awarded and if the bidder shall fail and neglect to execute a contract and give the bonds required, the sum mentioned in said check, or the principal sum of said bond, as t? case maybe, shall be liquidated damages for such failure and neglect and shall be forfeited to and paid into the treasury of the City of South San Francisco. The bidder to whom the con%ract is awarded will be required t 2 cute a bond for the faithful performance of his work in an amount equal to fifty (50) per cent of the amount of the undertaking with at least two (2) responsible sureties in the full amount of the bond each; and will also be required before entering upon the ~rk to furnish a good and sufficient bond, as required by Title l, Division 5, Chapter 3~, of the Government Code Qf the State of California. It shall be mandatory upon the contractor to whom the contract is awarded, and upon any submontractor ~nder him, to ~pay not less than the sDecified rates to all laborers, workmen and mechanics employed by them in the execution of the contra~t. The contractor shall forfeit as a penalty to the City of South San Francisco Ten Dollars ($10.~O) for each laborer, workman, or mechanic employed, for each calendar day, or portion thereof, such laborer workman or mechanic is paid less than .the said stipulated rates for any work done under said contract, by him or by any submontractor under him. And such contract shall contain a stipulation to this effect, in accordance with the provisions of Chapter 397 of the Statutes of California, 1931. For the duration of the wars in which the United States of America is now engaged, payment for over- time work shall be made in accordance .with the executive order of the President of the United States, dated Septem- ber 10, 19&2, if such payment for over. time is legally subSect to and legally controlled by said order. Notice is further here~ given that no contractor or subcontractor or agent or representative thereof shall knowingly employ or cause or allow to be employed on the work herein provided for any alien except in cases of extraordinary emergency caused by fire, flood, or danger to life or property. The contractor or subcontractor, to whom a contract for said work. may be awarded, shall forfeit as a penalty to the City of South 8an Francisco Ten Dollars ($10.00) for each alien knowingly employed in the execution of such c_on. tract, or portion thereof, during which such alien is permitted or required to labor in violation of provisiohs of Division II, Part I, Chapter I, Article & of the Labor Code of the State of California. A provision to this effect shall be inserted in such contract. The contract must be entered into in compliance with and subject to the conditions imposed by' Division II, Part 7, Chapter 1, Article 3, of the Labor Code of the State of California. Such contract shall contain a stipulation to the effect that eight (8) hours shall constitute a legal day's work in the performance of the work' her.sin provided for, and that no contractor or .subcontractor who employs, directs or controls the work of amy workman employ, ed on public work shall require or permit such workman to labor more than eith (8) hours during any one calepMer day, except in cases of extraordinary emergency caused by fire, flood or .danger to life or property and shall contain the further stipulation which shall provide that the contractor to whom the contract is awarded shall forfeit as a penalty to the City of South San Francisco, Ten Dollars ($10.OO) for each workman employed in the execution of such Contract by the Contractor or by any subcontractor for each calendar ~ay during which any workman is required tr permitted to labor more than eight (8) hours in violation of the provisions of said Article 3. The 6ontract to be awarded shall contain a further stipulation that the c.~ntractor to whom such contract may be awarded, shall use or supply only such u ~f~,e~ufactured materials, produced in the ~nited States, or substantially from materials produced in the United States, excepting only where such articles, materials or alpplies for which they are manufactured are not mined, produced or manufactured, as the case may be, in the United States, in accordance with the provisions of Title 1, Division 5, Chapter ~, Article 1 of the Government Code of the State of California. ~aled proposals or bid~ will be delivered to the City Clerk on or before 8 o' clock p.m. on Monday, the fifth day of April, 19&8. All sealed proposals will be opened by said City Council, in public session, on Monday, the 5th day of April, 19~8, at $ 5' clock p.m., in the Council Chamber of said City Council. Said City Council hereby reserves the right, in its discretion, to reject any and all bids and to award a contract for all said work, or for any portion or portions ~hereof.
