HomeMy WebLinkAboutReso 1364-1948 RESOLVED by the City Council of the City of South Sa~ Francisco that said city enter into a contract
with South San Francisco Scavenger Company, in which it shall be 'provided as follows'.
Said South San Francisco ~cavenger Company shall have the exclusive right to collect garbage in said
city and to deposit upon the garbage dump now under the control of said South San Francisco Scavenger Company
any garbage originating within said City of South San Francisco, or within Brisbane, Visitacion, Lomita Park and
Millbrae, County of San Mateo, State of California, .but not elsewhere;
Said South San Francisco Scavenger Company ~ay charge all persons, firms and corPOrations, who may
desire to deposit garbage upon said dump, except as hereinafter expressly provided, the following prices:
1. Ten (10) cents for a can of Twenty-five (25) gallons and fifty (50) cents per truck load,
irrespective of size, but not exceeding three (3) y~rds in:~content.
For garbage originating outside of the City of South San Francisco the above mentioned prices shall
not apply, but said South San Francisco Scavenger Company may fix its own prices for garbage referred to in this
paragraph.
2. It shall be the obligation of said South San Francisco Scavenger Company.
a. To keep some responsible person in charge of said garbage dump at all times when the enclosure,
in which said dump is located, is open;
b. To maintain 'said garbage dump in a good and work~a,l~ke manner and to cause all fires, irrespect~w
of the cause of the same, to be extinguished not later than the time of sunset;
c. To maintain a barbed wire gate, of substantial structure, across the road on which the entrance to
said garbage dump is located, and to keep such gate securely closed and locked at all times when said garbage dm
shall not be opened for use;
d. To keep said garbage dump open at all times'between the hour of 9 o'clock a.m. and the hour of
5 o' clock p.m. of each day, excepting Sunda~;
e. To keep and hold said City of South San Francisco free and harmless from every kind of liability
which may arise or occur in connection with the use of said garbage dump by any person, persons, firm or corpora
The agreement herein authorized shall extend over the period of ten (10) years from the 1st day of
August, 1928. Said South San Francisco Scavenger Company shall have the option and privilege of extending this
agreement for an additional term of five (5) years!~ to commence on the expiration of the agreement hereby autho3
provided that said South San Francisco Scavenger Company shall have given to said City of South San Francisco
written notice of its intention to exercise this option at least six (6) months prior to the expiration of the
term of the agreement hereby authorized.
The agreement to be executed by said City and said South San Francisco Scavenger Company, in the even'
of the election of said South San Francisco Scavenger Company to exercise this option, shall be substantially i
the form of the agreement hereby authorized, except that such additional agreement shall contain no option for
renewal or extension.
On each Saturday of the term hereby authorized and during the period of any extention of said term, a
person, firm or corporation located within said City of South San Francisco may deposit upon said dump lawn
trimmings, hedge trimmings and cuttings and flowers, free of charge, between the hours of 9 o'clock a.m. and
5 o'clock p.m., but at no other time.
Said South San Francisco Scavenger Company shall not permit any person, firm or corporation to depos~
on said dump garbage not originating within the City of South S~nFrancisco, or in said Brisbane, Visitacion,
Lomita Park or Millbrae.

City of South San Francisco shall cause a supply of water to be conducted to said garbage du~p,
having an internal diameter of not less than one and one-half inches nor greater than two inche,
for the purposes of extinguishing any fires which may occur in or upon said garbage dump.
Said South San Francisco Scavenger Company shall pay to said City of South San Francisco, annually i
advance, on the first day of August of each year of said term, the sum of One Thousand Dollars ($1,OOO.00). T
first payment of said annual amount shall be on the 5th day of August, 19~8.
The Mayor and City Clerk are hereby authv~ized and directed, in the name of said city and under its
seal, to execute the agreement herein authorized.
