HomeMy WebLinkAboutReso 1367-1948RESOLUTION NO. 1367 A RESOLUTION ORDERING THE CONSTRUCTION OF A SEWER AT BAYSHORE FREEWAY UNDER THE SOUTH SAN FRANCISCO OVERPASS AT GRAND A~ UE AND THE TRACKS OF THE SOUTHERN PACIFIC ~OMPANY. RESOLVED by the City. Council of the City of South San Francisco that public interest and convenience require the following improvement work to be done in said city: The construction of a sewer at the Bayshore Freeway under the South San Francisco overpass at Grand Avenue and the tracks of the Southern Pacific Company. Ail said work shall be done at the location shown upon the plans of specifications hereinafter mentioned and strictly in accordance with the plans of specifications heretofore submitted by the Works E~gineer of said city and hereby adopted for said work. Ail said work and the materials used in connection therewith shall .be furnished under the direction and to the satisfaction of said ,Works Engineer. Said city council hereby ascertains that the general prevailing rates of per d~em wages and the general prevailing rates for legal holiday and-overtime work applicable to said work to be done are as follows: CLASSIFICATION HOURLY WAGERATE Bricklayer (6 hour day) Carpenter Qement Finisher Concrete Mixer Operator (under 1 yd.) Overtime to be timemd one-half for time over eight (8) hours, and on Saturdays, and double time on Monthly rates are to be equal to the above, based on a 176-hour working month. The following are to be considered holidays: New Year's Day, Decoration Day, Independence Day., Labor Day, Admission Day, Thanksgiving Day, Christmas Day, Saturdays and Sundays. The City Clerk is hereby directed to cause a notice inviting sealed proposals for doing said work and for the furnishing of all materials necessary therefor to be published by two (2). insertions thereof, not less tha~ 5 days apart, in "The Enterprise", a newspaper of general circulation, published and .printed in the City of South San Francisco, which notice shall be substantially in the following form: NOTICE INVITING SEALED PBOPOSALS OR BIDS FOR THE CONSTRUCTION OF A SEWER AT BXYSHORE FREEWAY UNDER THE SOUTH SAN FRANCISCO OVERPASS OVER GRAND AVENUE AND THE SOUTHERN PACIFIC TRACKS. N~tice is hereby given thatsealed proposals or bids will be received by the City Council of the City of South San Francisco on Wednesday, the 18th day of August, 19~8, at the hour of 8:00 o'clock p.m., for doing..the following public improvement work in said city, to-wit: The construction of a sewer at the Bayshore Freeway under the South San Francisco Overpass over Grand .Avenue and the the Southern Pacific tracks in said City of South San Francisco. All the work of constructing such sewers shall be done. at the location showm upon the plans and specifications for said work and strictly in accordance with the plans of specifications heretofore adopted for said work. All such work and the materials 'Used in connection therewith shall be furnished under the direction and to the ~atisfaction of the Works Engineer of said city. Independence Day, It shall be mandatory upon the contractor, to whom the contract is awarded, and upon any sub- contractor under him, to pay not less than the specified rates to all laborers, workmen and mechanics employed by them in execution of the contract. The contractor shall forfeit as a penalty to the City of South San ~ Francisco Ten Dollars ($10.00) for each ~aborer, workman or mechanic employed for each calendar day, or portion thereof, such laborer, work,~_n or mechanic is paid less than said stiudlated rates for any work done under said contract, by him. or bv any sub-contractor under him. The contractor shall forfeit as a penalty to the City of South San Francisco Ten Dollars ($10.00) for each ~aborer, work,~_n or mechanic employed for each calendar day, or portion thereof, such laborer, workman or mechanic is paid less than said stipulated rates for any work done under maid contract, by him, or by any sub-contractor under him. Such contract shall contain a stipulation to this effect, in accordance with the provisions of Chapter 397 of the Statutes of California, 1931. No bid will be accepted from any contractor who has not been licensed in accordance with the provisions of an act of legislature of the State of California entitled: "An Act providing for the registratio~ of contractors, and defining the term contractor, providing the method of obtaining licenses to engage in the business of contracting, and fixing the fees for such licenses; providing the method of suspension and cancella- tion of such licenses; and prescribing the punishment for violation of the provisions of this act." Chapter 791 of the Statutes and Amendments of 1929, as amended. Notice is further hereby given that no contractor or sub-contractor or agent or representative thereof shall knowingly employ or cause or allow to be employed, on the work herein provided for, any alien, except in cases of extraordinary emergency caused by fire, flood, or danger to life or property. The contractor or sub-contractor to whom the contract for said work may be awarded shall forfeit as a penalty to the City of South San Francisco, Ten Dollars ($10.00) for each alien knowingly employed in the execution of such contract, for each calendar day, or portion thereof, during which such alien is permitted or required to labor in violation of the provisions of Article ~ of the Labor Code of the S~ate of California. A provision to this effect shall be inserted in such contract. The contract must be entered into in compliance with and subject to the conditions impbmed by Article 3 of the Labor Code of the State of California. Such contract shall contain a stipulation to the effect that eight (8) hours shall constitute a legal day's work in the performance of the work herein provided for, and that no contractor or 'subcontractor employs, directs or controls the work of any workman employed on public work, shall require or permit such workman to labor more than eight (8) hours during any one calendar day, except in cases of extraordinary emerge caused by fire, flood or danger to life or property and shall contain the further stipulation, which shall pro~ that the contractor, to whom the contract is awarded, shall forfeit as a penalty to said City of South San Francisco Ten Dollars ($10.00) for each workman employed in the execution of such contract by the contractor, 3O2 or by any subcontractor, for each ealendar day during which any workman is required or permitted to labor more than eight (8) hours in violation of the provisions of said Article 3. The contract ko b~ awarded shall contain a further stipulation that the contractor, to whom such contract may be awarded, shall use or supply only such unmanufactured materials, produced in the United States, or substantially from materials produced in the United States, excepting only where such articles, materials or supplies from which they are manufactured, are not mined, produced or manufactured, as the case maybe, in the United States, as required by Chapter ~, Article 1 of the Government Code of the State of California. Price, fitness and quality being equal, said Contractor shall, in the performance of the contract, prefer supplies grown, manufactured, or produced in the Stats of California, and shall next prefer supplies partially m-eufactured, grown or produded in this State. The successful bidder shall, within ten (10) days after the award, enter into a contract with the City of South San Francisco for the faithful performance of the work to be done under said award. Ail sealed proposals or bids shall be accompanied by a check payable to the City of South San Francisco, certified by a responsible, bank, for an amount which shall not be less than ten (10) per cent of the aggregate of the proposal, or by a bond for the said amount and so payable, signed by the bidder and two (2) sureties, who shall Justify before any officer competent to administer an oath in double said amount, over and above all statutory exemptions. If the proposal be accepted and the contract awarded and if the bidder shall fail and neglect to execute a contract and give the bonds required, the sum mentioned in said check, or the principal sum of said bond, as the case may be, shall be liquidated damages for such failure and neglect and shall be forfeited to and paid into the treasury of the City of South San Francisco. The bidder, to whom the contract is awarded, will be required to execute a bond for the faithful performance of his work in an amount equal to fifty per cent (50%) of the amount of the undertaking with at least two (2) responsible sureties in the full amount of the bond each; and will also be re- quired before 'entering upon the work to furnish a good and sufficient bond, as required by an act of the legislature of the State of California, approved May 10, 1919, entitled: "An act to secure the payment, of the claims of persons employed by contractors upon public works and the claims of persons who furnish materials, supplies, teams, imple- ments or machinery used or consumed by such contractor in the performance of such works, and prescribing the. duties of certain public officers with respect thereto", Chapter 303, Statutes of California, 1919. Plans, specifications and proposal sheets may be obtained at the office of the Works Engineer of the City of South San Francisco, in the City H~ll of said City, in South San Francisco, California. Sealed proposals or bids will be delivered to the City Clerk on or before 7:30 o'clock p.m., on Wednesday, the 18th day of August, 19&8. Ail. sealed proposals will be opened by said City Council, in public session, on Wednesday, the day of August, 19&8, at 7:30 o'clock p.m., at the Council Chamber of said City Council.
