RESOLVED b,y the City Council of the City of South San Francisco that public interest~ and convenience require the following improvement work to be done in said city; The construction of a sanitary sewer in Mission Road in said city, beginning at a manhole located 528 feet westerly from the manhole located at the intersection of Grand Avenue and said Mission Road and extendin~ westerly ~00 feet o~ said Mission Road, approximately to the corporate boundary of said city. Ail said work shall be done at the location shown upon the plans and specifications hereinafter mention~ and strictly in accordance with the plans and specifications heretofore submitted by ..the Works Engineer of said city and hereby adopted for said work. Ail said work and the materials used in connection therewith shall be furnished under the direction and to the satisfaction of said Works Engineer. Said City 'Council hereby ascertains that the general prevailing rates of hourly wages and the general prevailing rates for. legal holida~ and overtime work applicable to said work to be done are as follows: CLASSIFICATION HOURLY WAGE KATE Bricklayers (6 hour day) Hod Carriers (6 hour day~ Brick Pipe Eayers Trenching Machine Operators Tractors Oilers on Truck Cranes Laborers: Header Board, cribbers, laggers, blasters, powderman, drillers, high . scalers, (form raisers), sand blasters, wagon drill, combination jack hammer powderman, concrete mixer under ~ yd., asphalt ironers and rakers. $ 2.375 1.775 1.775 2.275 2.225 1.875 1.775 Concrete pan work, magesite and mastic workers, wet or dry, sloper, mucker underground, pavement breakers, Jackhammer, vibrators and all air gas and electric tools, loading and unloading, carrying and handling all rods and materials for use in reinforcing concrete construction. 1.65 Generat~ i labor, gardeners and landscape laborers, bridge laborers, construction laborers, trackmen (construction, maintenance and repair), all cleanup work of debris, grounds and buildings, watchmen, flagmen and guards, concrete laborers (wet or dry), and asphalt shovelers. 1.525 Truck drivers, 3 yds. or less ~ and 5 yds. 6 yards 1.5575 Pick up 1.525 Water and oil trucks, up to and including 1200 gals 1.6225 Overtim~ to be time and one-half for time over eight (8)~ hours, and on Saturdays, and double time on Sundays. Monthly rates are to be equal to the above, based on a 176-hour working month. The City Clerk is hereby directed to cause a notice inviting sealed proposals for doing said work and the furnishing of all materials necessary therefor to be published by two (2) insertions thereof, not less than 5 days apart, in "The Enterprise", .a newspaper of general circulation, published and printed in the City of Soutl San Francisco, which notice shall be substantially in the ~ollowing form: NOTICE INVITING SEALED PROPOSALS OR BIDS FOR THE CONSTRUCTION OF A SANITARY SEWER IN MISSION ROAD IN THE CITY OF SOUTH SAN FRANCISCO. Overtime to be time and one-half for time over eight (8) hours, and on Saturdays, and double time on Monthly rates a~e to be equal tothe above, based on a 176~hour working month. The following amc to be considered holidays: New Year's Day, Decoration Day, Independence Day, Labor Day, Admission Day, Thanksgiving Day, Christmas Day~ Saturdays and Sundays. It shall be mandatory upon the contractor, to whom the contract is awarded, and upon any sub-contractor under him, to pay not less than the specified rates to all laborers, workmen and mechanics employed by them in the execution of the contract. The contractor shall forfeit as a penalty to the City of South San Francisco Ten Dollars ($10.00) for each laborer, workman or mechanic employed foe each calendar day, or portion thereof, such laborer, workman or mechanic is paid less than said stipulated rates for any work done under said contract, by him, or by any sub-contract- or under him. Such contract shall contain a stipulation to this effect, in accordance with the provisions of Chapter 397 of the Statutes of California, 1931. No bid will be a~cepted from any contractor who has not been licensed in accordance with the provisions of an act of the legislature of the State of California entitled: "An act providing for the registration of contractors, and defining the term contractor, providing the method of obtaining licenses to engate in the business of contracting and fixing the fees for such licenses; providing the method of suspension and cancellation of such licenses; and prescribing the punishment for violation of the provisions of this act". Chapter 791 of the Statutes and Amendments of 1929, as amended. Notice is further hereby given that no contractor or sub-contractor or agent or representative thereof shall knowingly employ or cause or allow to be employed, on the work herein provided for, any alien, except in cases of extraordinary emergency caused, by fire, flood, or danger to life or property. The contractor ~r sub-contractor to whom the contract for said work may be awarded shall forfeit as a penalty tothe City of South San Francisco, Ten Dollars ($10.O0) for each alien knowingly employed in the execution of such contract, for each calendar day, or portion thereof, during which such alien is permitted or required to labor in violation of the provisions of ArtiCle ~ of the Labor Code of the State of California. A provision to this effect shall be inserted in such contract. The contract must be entered into in compliance with and sub,oct to the conditions imposed by Article 3 of the Labor Code of the State of California. Such contract shall contain a stipulation to the effect that eight (8) hours shall constitute a legal day's work in the performance of the work herein provided for, and that no contractor or subcontractor who employs, directs or controls the work of any workman employed on public work, shall require or permit such workman to labor more than eight (8) hours during any o~e calendar day, except in cases of extraordinary emergency, caused by Sire, flood or danger to life or property and shall contain the further stipulation, which shall provided that the contractor, to whom the contract is awarded, shall forfeit as a penalty to said City of South San Francisco Ten Dollars ($10.O0) for each workman employed in the execution of such contract by the contractor, or by any sub- contractor, for each calendar day during which any workman is required or permitted to labor more than eight (8) hours in violation of the provisions of said Article 3. The contraCt to be awarded shall contain a further stipulation that the contractor, to whom such contract may be awarded, shall use or supply only such unmanufactured materials, produced in the United States, or sub- stantially from materials produced in the United StateS, excepting only where such articles, materials or supplies from which they are ~anufactured, are not mined, produced or manufactured, as the case may be, in the United States, as required by Chapter A, Article I of the Government Code of the State of California. Price, fitness and ~uality being eqUal, said Contractor shall, in the performance of the contract, prefer supplies grown, manufactured, or produced in the State of California, and shall next prefer supplies partially manufactured, grown or produced in this state. The successful bidder shall, within ten (10) days after the award, enter into a contract with the City of South San Francisco for the faithful performance of the work to be done under said award. All sealed proposals or bids shall be accompanied by a check payable to the City of South San Francisco, certified by a responsible bank, for an amount which shall not be less than ten (10) per cent of the aggregate of the proposal, or by a bond for the said amount and so payable, signed by the bidder and two (2) sureties, who shall Justify, before the officer competent to administer an oath, in double said amount, over and above all statutory exemptions. It the proposal be accepted and the contract awarded and if the bidder shall fail,nd neglect to execute a contract and give the bonds required, the sum mentioned in said check, or the principal sum of said bond, as the case may be, shall, be liquidated damages for such failure and neglect and shall be forfeited to and paid into the treasury of the City of South San FrancisCo. The bidder, to whom the contract is awarded, will be required to execute a bond for the faithful performance of his work in an amount equal to fifty per cent (50%) of the amount of the undertaking with at least two (2) responsible sureties in the full amount of the bond each; and will also be required before entering upon the work to furnish a good and sufficient bond, as required by an act of the legislature of the State of California, approved May lO, 1919, entitled: "An act to secure the payment of the claims of persons employed by contractors upon public works and the claims of persons who furnish materials, supplies, teams, implements or machinery used or consumed by such contractor in the performance of such works, and prescribing the duties of certain public officers with respect thereto", Chapter 303, Statutes of California, 1919. Plans and specifications and proposal sheets may be obtained at the office of the Works Engineer of the City of South San Francisco, in the City Hall of said City, in South San Francisco, California. Sealed proposals, or bids may be delivered to the City Clerk on or before 8:00 o'clock p.m., on Tuesday, the 7th day of September, ~9~8. All sealed proposals will be opened by said City Council, in public session, on Tuesday, the 7th day of September, 19~8, at 8:00 o'clock p.m., at the Council Chamber of said City Council.
