HomeMy WebLinkAboutReso 1377-1948310 RESOLUTION NO. 1377 WHEREAS the City of South San Francisco and John E. Estes, now deceased, entered into an agreement, dated May 8, 19&7, wherein said city employed said John E. Estes as engineer to make all preliminary investigations, surveys and estimates, and to prepare all plans for and superyise the construction of the work for which such plans and specifications were to be prepared, and to do all other things mentioned in said agreement, reference to which agreement is'hereby made for further particulars; and !~H~LEAS said John E. Estes had died, and Jessie B. Estes has been appointed executrix of the last will and testament of said deceased; and WHEREAS, as a part of the work provided for in said agreement, a chemical survey with respect to industrial waste has been made in said city and the report of said survey has been compiled; and ~REAS, after said chemical survey had been made, it was discovered that it will benecessary to provide a pre-treatment plant of much greater capacity than the pre-treatment plant contemplated at the time of the execution of the abovementioned agreement; and ~REAS a portion of the work incident tO the preparation of such plus and specifications was performed in the office of said John E. Estes prior to his death~- and all such work will be used in the preparation of the plans and specifications, which are to be completed for said work; RESOLVED by the City Council of the City of South San Francisco that sAid!city pay to said executrix the reasoomble value of the work perfzrmed in the office of said John E. Estes in connection with the projedt contemplated in said agreement, out of money to be loaned by the United States of America to the Said City of South San Francisco. It is a condition of the action of said city council, as expressed in this resolution, that said executrix shall irmmediately deliSer to the works engineer of said city all field notes, tracings, computations, work sheets and all other documents pertaining to said project and in the custody of said executrix. I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco this 7th day of Deptember, 19&8, by the following vote.
