HomeMy WebLinkAboutReso 1420-1949RESOLUTION NO. lA20 A RESOLUTION ORDERING THE CONST~CTION OF STREET IMPROVEMENTS ON CHESTk~;T AVENUE BETWEEN COM)~CIAL AVENUE AND EL CAMINO REAL. RESOLVED by the City Council of the City of. South San Francisco that public interest and convenience reqdire the followihg improvement work to be done in said city: The construction of the following improvements on Chestnut Avenue between Commercial Avenue and E1 Camino Real. Grading and the construction of ~avement havdng a six (6) inch crusher run base and a two and one-half (2½) inch asphaltic concrete wearing surface; the construction of an asphaltic con- crete sidewalk on tbs one side of said Chesnut Avenue; widening the bridge over Colma Creek; the construction of drainage facilities and the performance of appurtenant work. All said work shall be dose at the location shown upon the plans and specifications hereinafter mentioned and strictl~ in accordance with the plans and specifications heretofore submitted by the works engineer of said city, and hereby adopted for said work. Ail said work and all the materials used in connection therewith shall be furnished under the direction snd to the satisfaction of said works engineer. Said city council hereby ascertains that the general prevailing rates for legal holiday and overtime work applicable to said work to be done are as foI~ws: CLASSIFICATION Carpenter ~. Notice is hereby given that.sealed proposals or bids will be received by the city council of the city of South San Francisco on Monday, the 21st day of March, 19h9, at the hour of 8 o'clock p.m., for doing the following public improvement work in said city, to-wit: Grading and the construction of pavement having a six (6) inch crusher run base and a two and one-half (2½) inch asphaltic concrete wearing surface; the construction of an asphaltic concrete sidewalk on the one side of said Chestnut Avenue; widening the bridge over Colma Creek; the construction .of drainage facilities and the performance of appurtenant work. All said work shall be done at the location shown upon the plans and specifications for said work and strictly in accordance with plans and specifications heretofore adopted for said work. All said work a~d the materials used in connection therewith shall be furnished under the direction and to the satisfaction of the Works Engineer of said city. It shall be mandatory upon the contractor, to whom the contract is awarded, and upon any sub-contract¢ under him, to pay not less than the specified rates to all laborers, workmen and mechanics employed by them in the execution of the contract. The contractor shall forfeit as a penalty to the City of South San Francisco Ten Dollars ($10.00) for each'laborer, workman or mechanic employed for each c~lendar day, or portion thereof, ~ch laborer, workman or mechanic is paid less than said stipulated rates, for any work done under said contract, bF him, or by any sub-contractor under him. Such contract shall contain a stipulation to this effect, in accord with the provisions of Chapter 397 of the Statutes of California, 1931. No bid will be accepted from any contractor who has not been licensed in accordance with the provistoz of an act of the legislature of the State of California entitled: "An act providing for the registration of contractors, and defining the term contractor, providing the method of obtaining licenses to engage in the busi~ of contracting, and fixing the fses for such licenses; providing the method of suspension and cancellation of.s~ licenses; and prescribing the punishment for violation of the provisions of this act." Notice is further hereby given that no contracbor or sub-contractor or agent or renresentative there¢ shall knowlingly employ or cause to allow to be employed, on the workherein provided for, any alien, except ir cames of extraordinary emergency caused by fire, flood, or danger to life or property. The contractor or sub-contracotr to whom the contract for said work may be awarded shall forfeit as ~ penalty to the City of South San Francisco, Ten Dollars ($10.~0) for each alien knowingly employed in the exec~ of ~uch contract, for each calendar day, or portion thereof, during which such alien is permitted or required ~ labor in violatioh of the provisions of Article & of the Labor Code of the State of California. A provision t. this effect shall be inserted in such contract. The contract must be entered into in compliance with and subj. to the conditions imposed by Article 3 of the Labor Code of the State of California. Such contract shall con%sin a stipulation to the effect that eight (8) hours shall constitute a lega day's work in the performance of the work herein provided for, and that no contractor or'subcontractor ~ho employs, directs or controls the work of any workman employed on public work, shall require or permit such wor to labor more than eight (8) hours during any one calendar day, except in cases of extraordinary emergency, cs by fire, flood or danger to life or property and shall contain the further stipulation, which shall provide th the contractor, to whom the contract is awarded, shall forfeit as a penalty to said City of South San Francis¢ Ten Dollars ($10.00) for each workman employed in the execution of such contract by the contractor, or by anys contractor, for each calendar day during which any workman is required or permitted to labor more than eight I hours in violation of the provisions of said Article 3. 350' The contract to be awarded shall contain a further stipulation that the contractor, to whom such contract maybe awarded, shall use o~ supply only such unmanufactured materials, produced in the United States, or substantially from materials produced in the United States, excepting only where such articles, materials or supplies from which they are manufactured, are not mined, produced or manufactured, as the case may be, in the United States, aS required by Chapter L, Article i of the Government Code of the State of California. Price, fitness and quality being equal, said Contractor shall, in the performance of the contract, prefer supplies grown, manufactured, or produced in the State of California, and shall next prefer supplies partially manufactured, grown or produced in this state. The successful bidder shall, within ten (10) days after the award, enter into a contract with the City of South San Francisco for the faithful performance of the work to be dune under said award. All sealed proposals or bids shall~be accompanied by a check payable to the City of South San Francisco, certified by a responsible bank for an amount which shall not be less than ten (lC) percent of the aggregate of the proposal, or by a bond for the said amount and so payable, signed by the bidder and two (2) sureties, ~ho shall justify, before any officer competent to administer an oath, in double said amount, oveP and above all statutory exemptions. If the proposal be accepted and the contract awarded and if the bidder shall fail and neglect to execute s contract and give the bonds required the sum mentioned in said check, or the principal sum of .said bond, as the case may be, shall be liquidated damages for such failure and neglect and shall be forfeited to and paid into the treasury of the City of South San Francisco. The bidder, to whom the contract is awarded, will be required to execute a bond for the faithful performance of his work in an amount equal to fifty percent (504) of the amount of the undertaking with at least two (2) responsible sureties in thefull amount of the bond each; and will also be required before entering upon the work to furnish a good and sufficient bond, as required by an act of the legislature of the State of California, approved May lC, 1919, entitled: "En act to secure the payment of the claims of persons employed by contractors upon public works and the claims of persons who furnish materials, supplies, teams, implements or machinery used or consumed by such contractor in the performance ~f such works, and prescribing the duties of certain public officers with respect thereto", Chapter 303, Statues. of California, 1919. Plans, specifications and proposal sheets may be obtained at the office of the Works ~ngineer of the City of South San Francisco, in the city hall of said city, in South San Francisco, California. Sealed proposals or bids may be delivered to the City Clerk on or before 8:00 o'clock p.m., on Monday, the 21st day of March, 1~9. Ail sealed, proposals will be opened by said city council, in public session, on Monda~r, the 21st day of March, 19L9, at 8:O0-o'clock p.m., at the council chamber of said city council.
