HomeMy WebLinkAboutReso 1458-1949 RESOLUTION NO. 1%58 A RESOLUTION INVITING SEALED PROPOSALS FOR SURFACING PORTIONS OF GRAND AVENUE BE~.~EN BAYSHORE HIGHWAY AND MISSION ROAD IN THE CITY OF SOUTH SAN FRANCISCO. RESOLVED by the City Council of the CitY of South San Francisco that public interest and conven- ience require the surfacing of the portions.of Grand Avenue, between Mission Road and Bayshore Highway, shown upon the maps forming a part of the plans and specifications, submitted by the works engineer of said city for said work, which plans and specifications are hereby adopted. The City Clerk is hereby directed to publish, by two insertions in The Enterprise, a weekly newspaper, published and circulated ih said city, a notice inviting sealed proposals for said work, which notice shall be in substantially ~he following form: NOTICE INVITING SEAI.~.O PROPOSALS FOR SURFACING PORTIONS OF GRAND AVENUEEBET~EEN BAYSHORE HIGH!fAY AND MISSION ROAD IN THE CITY OF SOUTH SAN FRANCISCO. Notice is hereby given that sealed proposals or bids will be received by the city council of the City of South S~n Francisco on the 23rd day of June, 19A9, at the hour of 5 o'clock p.m. for doing the following maintenance work in said city, to-wit~ Furnishing materials and labor for Street Maintenance Surfacing of portion of Grand Avenue betwee~ Bayshore and Mission Road as shown onmaps and specifications on file at the '~orks Engineer's office at the City Hall, with asphaltic concrete known as Virginia Mix including tack coat, seal coat and sand. Ail said work shall be done at the locations shown upon the plans and sp~ecifications for said worl and strictly in accordance with the plans and specifications heretofore adopted for.said work. All said work and the materials used in connection therewith shall be furnished ander the directi, ~and to the satisfaction of the Works Engineer of said city. ~' .~ Said city council has ascertained that the general prevailing rates for hourly wages, and the general prevailing rates for legal holidays and overtime work applicable to said work to be done are as follows: CLASSIFICATION Carpenter. It shall be mandatory upon the contractor to whom the contract is awarded and Spon any sub-contra¢ under him, to pay not less than the specified rates to all laborers, workmen and mechanics employed by them in t! execution of the contract. The contractor shall forfeit as a penalty to the City of South San Francisco Ten Dollars ($10.00) for each laborer, workman or mechanic employed for each calendar day, or portion thereof~ such laborer, workman or mechanic is paid less than said stipulated rates for any work done under said contract, by h~ or by any sub-contractorunder him. Such contract shall contain a stipulation to the effect, Sn accordance with the provisions of Chapter 397 of The Statutes of California, 1931. No bid shall be accepted from a~y contractor who has not been licensed in accordance with the pro- visions of an act of the legislature of the State of California entitled: "An act providin~ for the registratio~ of contractor, providing the method of obtaining licenses to engage in the business of contracting, and fixing ~ fees for such licenses; providing the method of suspension and cancellation of such licenses; and prescribing th~ punishment for violation of the provisions of this act" Chapter 791 of the Stat~s of Amendments of 1929, as amended~ Notice is Eurther hereby given that no contractor or sub-contractor or agent or representative thereof shall knowingly employ or cause or allow to be employed, on the work herein provided for, any alien, except in cases of extraordinary emergency caused by fire, flood, or danger to life or property. The contractor or subcontractor to whom the contract for said work may be awarded shall forfiet as penalty to the City of South San Francisco, Ten Dollars ($10.00) for each alien ~nowingly employed in the execut~ of such contract for each calendar day, or portion thereof, during which such alien is permitted or required to labor in violation of the provisions of Article A e~ the Labor Code of the State of California. The contract must be entered into in compliance with and subject the conditions imposed by Article ] of the Labor Code of the State of California. 880 Such contract shall contain a stipulation to the effect that eight (8) hours shall constitute a legal day's t~ork in the performance of the work herein provided for, and that no contractor or sub-contractor who employs, directs or controls the work of any workman employed on public work, shall require or permit such workman to labor more than eight (8) hours during any one "calendar day, except in cases of extraordinary emergency, caused by fire, flood or danger to life or property and shall contain the further stipulation~ which shall provide that the contracotr, to whom the contract is awarded', shall forfeit as a penalty to said City of South San Francisco Ten Dollars ($10.00) for each workman employed in the execution of such contract by the contractor or by any sub-contractor, for each calendar day during which any workman is required or permitted to labor<, more than eight (8) hours in violation of the provisiSn of said Article 3. The contract to be awarded shall Contain a further stipulation that the contractor, to whom such contract may be awarded, shall use or supply only such unmanufactured materials, produced in the United States, or s~stantially from materials produced in the United States, excepting only where such Articles, materials or supplies from which they are manufactured, are not mined, produced or manufactured, as the case may be, in the United States, as required by Chapter d, Article 1 of the Government Code of the State of California. Price, fitness and quality being equal, said Contractor shall, in the performance of the contract, pre- fer supplies grown, manufactured, or produced in the State of California and shall next prefer supplies partially manufactured, gro~e~ or produced in this state. The successful bidder shall,~within ten (10) days after the award, enter into a contract with the City of South San Francisco for the faithful performance of the work to be done under said award. Ail sealed prop- osals or bids shall be accompanied by a check payable to the City of South 'San Francisco certified by a responsible bank, for an amount which shall not be less than ten (10) per cent of the aggregate of the proposal, or by a bond for the said amount and so payable, signed by the bidder and two (2)~sureties, who mhall Justify, before any officer competent to administer an oath, in double said amount, over and above all statutory exemptions. If the proposal be accepted and the contract awarded and if the bidder shall fail and neglect to execute a contract and give 'the bonds required, the sum mentioned in said check, or the principal sum of said bond, as the case may be, shall be liquidated ~am~ges for such failure and neglect and shall be forfeited to and paid into the treasury of the City of South San Francisco. The bidder, to whom the contract is awarded, will be required to execute a bond for the faith- ful performance of his work ~n an amount equal to fifty per cent (50%) of the amount of theundertaking with at least two (2) responsible sureties in the full amount of the bond each; and will also be required before entering upon the work to furnish a good and sufficient bond, as required by an act of the legislature of the State of California, approved May !0, 1919, entitled: "An act to secure the payment of the clai~of persons emplsyed by contractors upon public works and the claims of persons who furnish materials, supplies, teams, implements or machinery used or cons,~ed by such contractor in the performance of such works and.prescribing the duties of certain public officers with respect thereto," Chapter 303, Stat~s of California, 1919. Sealed proposals or bids may be delivered to the city clerk on or before five o'clock p.m., on Thursday, the 23rd day of June, 19~9. All sealed proposals will be opened by said city council in public session, on ThurSday, the 23rd day of June, 19~9, at five o~clock p.m., in the council chamber of said city council, Said city council reserves the right to reject any and all bi~s.
