A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISUO DECLARING ITS INTENTION TO IMPROVE LINDEN AVENUE BET~,~_J~N THE SOUTH- EP~Y BOUNDARY LINE OF RAILROAD AVENUE AND THE SOUTHERLY TERMINATION OF LINDEN AVENUE, .~ND SAN MATEO AVEA~JE, FROM THE SOUTHERLY TERJ4INATION OF LINDEN AVENUE TO THE SOUTHERLY BOUNDARY LINE OF THE CITY OF SOUTH SAN FRANCISCO. ~HEREAS public interest and convenience require that the work and improvements hereinafter described should be done; and, ~,~EREAS,. in the opinion of the City Council of the City of South San Francisco, said contemplated work and improvements are, and are hereby declared to be of more than local or ordinary public benefit; and, ~EREAS, on the 5th day of July, 19&9, said city council adopted a resolution, in which the city clerk was directed to mail prepaid postcards giving notice of the proposal of said city council to do said work, in which resolution said city council defined the district of land hereinafter described as the land to be specially assessed to pay the cost of said improvements and determdned that said improvement be constructed under the proceedings taken pursuant to the provisions of the Improvement Act of 1911, and that serial bonds bo represent unpaid assessments and to bear interest at the rate of five percent (5%)per annum, be issued in'the manner provided by Division l0 of the Streets and Highways Code, in the ImM~.emma~Bond Act of 1915, the last installment of which bonds will mature fourteen (14) years from the 2nd day of July next succeeding ten (10) months from their date; and ~EREAS such cards were mailed to each person and corporation to whom and to which land in the proposed assessment district, which is the district of land hereinafter described, is assessed on the last equal- ized county assessment roll, as his and its residence as shown upon said roll, and to any person, whether owning in fee or having a lien or legal, or equitable interest in said land, within said proposed district, who has filed with the city clerk his name and address, and the designation of the land in which he is interested, as appears by the affidavit of Daniel J. Hyland, said city clerk; and, I~EREAS owners of less than fifteen percent (15%) of the area of the district in said resolution described, and hereinafter described, have not demanded proceedings under the ,"Special Assessment Investigation, Limitation and .Majority Protest Act of 1931"; AND, ~EREAS, an estimate of the cost and expense of said work has been filed with the city clerk of said city; MG¥, THEREOFRE, Resolved by the City Council of the City of South San Francisco that is the intention of said city council to order the following work and improvements to be done in said city, to-wit: The improvement of Linden Avenue between the southerly boundary line of Railroad Avenue and the southerly termination of Linden Avenue, ~d San Mateo Avenue from the southerly termina- tion of Linden Avenue to the southerly boundary ldne of the City of South San Francisco by the construction of sanitary sewers, drainage facilities, curbs and gutters, sidewalks and resurfacing and widening the existing pavement with plant-mixed surfacing on a crusher run base. All the work herein provided for shall be done in accordance with the special plans, ~rofiles and specifications for said work, and at the locations and to the grades shown upon said plans, which plans, pro- files and specifications were heretofore adopted by said city council on the 23rd day of June, 19~9, and are now on file in the office of the city clerk. Reference is hereby made to said plans, profiles and specifications for a full description of said work and for the location and the extent of the work to be done hereunder and for the grades to which said work is to be done, and for a particular description of the boundaries of the district herein mentioned. Said city council does hereby determine and declare that said proposed work and improvements are of more than local or ordinary public benefit and will affect and benefit the land and district herein- after described, which said district is hereby declared to be the district benefited by said work and improvements and that, therefore, the entire cost and expense of said work and improvements shall be and hereby are made chargeable against and shall be assessed upon said land and district, except as hereinafter expressly provided, which district is within the 6ity of South San Francisco, County of San Mateo, State of California, and particularly described as follows, to-wit: Beginning at a point on the westerly line of Linden Avenue where said line is inter- sected by the southern line of the.Southern Pacific Railroad (Baden Branch) right of way; thence North 7~° 27' West 396.0& feet; thence around a curve to the right having a radius of 272.95 feet a distance of 2~3.176 feet; thence continuing on a curve to the right having a radius of 583.14 feet a distance of 131.59 feet; thence South 15° 33' West along a line 225 feet westerly and parallel with the westerly line o~~ Linaen Avenue a distance of 268~.2d feet more'or less to the Southwesterly corner of the Reichold Chemical Company's 3.00 acre tract, said corner also being the Northwesterly corner of the E, I. Dupont De Nemours 7.AO Acre tract; thence continuing South 15o 33' West 2d8.20 feet; thence South 7~° 27' East i foot; thence around a curve to the right having a radius of 583.1~ feet a distance 218.31 feet; thence North 53° 00' West i foot; thence South 37° 00' West 55~.71 feet more ~or less to the Northwesterly corner of that certain Parcel of land containing 3.00 Acres and belonging to the Standard Wire Corporation and designated on the Official Map of South San Francisco as ~arcel 28, Zone "E"; thence South 2~° 39' 18" East 858.10 feet; themce ~orth 65° 20' &2" East 1090 feet more or less to an intersection with the westerly line of San Mateo Avenue; thence around a curve to the right having a radius of 370 feet a distance of 60 feet more or less to the Northeasterly corner of Block 3, San Bruno Park 5th Addition; thence in a southerly direction along the westerly line of San Mateo Avenue to an intersection with the line marking the South Boundary Line of the City of South San Francisco; thence South 89° 57' 13" East 70 feet; thence North O0° 58' 30" West 35 feeb; thence South 89° 57' 13" East 200 feet; thence North O0° 58' 30" west 310.57 feet; thence North 89° 57' 13" West 200 feet to the easterly line of San Mateo Avenue; thence in a Northerly direction along the easterly line of San Marco Avenue a distance of 1360 feet more or less to the Northwesterly corner of that certain 13.77~ Acre Tract known as "Cape Esperance" a War Housing Project; thence South 89° 57' 13" East 200 feet; thence Northerly and Northwesterly on a line parallel with and at a distance of 200 feet therefrom measured at right angles frem the Easterly line of San Mateo Avenue and the Northerly line of Linden Avenue to an intersection with the Westerly Right of ~ay line of the Southern Pacific Railroad Company which intersection is located on the Easterly property line of that .939 Acre trac$ of land owned by the Union Oil Company and designated on the Official Map of South San.Francisco as Parcel 27 Zone "J"; thence northerly along the westerly boundary line of the Southern Pacific Railroad right of way line around a curve to the right having ~ radius of 5779.65 feet a distance of 7~0 feet; thence North 11° 28' 38" East 950 feet; thence comtinuing along the westerly line of the Southern Pacific~ Railroad right of way line around a curve to the right having a radius of 23~1.88 feet a distance of 13dO feet; thence continuing along said line around a curve to the left a distance of 700 feet more or less to the point of beginning. Notice is hereby given that serial bonds to represent unpaid assessments, and to bear interest- at the rate of five percent (5%) per annum, will be issued hereUnder in the manner provided by Division l0 of the Streets and Highways Code, in the Improvement Bond Act of 1915, and the last installment of which bonds shall mature fourteen (14) years from the 2nd day of July, next succeeding ten (10) months from their date. The South San Francisco ~ournal, a newspaper of general circulation, printed and published in said City of. South San Francisco, is hereby designated as the newspaper in which this resolution of intention shall be published, and the city clerk is hereby directed to cause this resolution to be published by two (2) insertions in the manner and form required by law. Said City Clerk is also directed to mail a notice of the adoption of said resolution of intention postage prepaid, to all persons onwimg real property which is proposed to be assessed to pay any part of the cost of said work, whose names and addresses appear on the last equalized assessment roll, or as known to said city c~erk. The superintendent of streets shall cause to be conspicuously posted along the line of said contemplated work and improvements, and not more than three hundred (300) feet ~n distance apart, but not less than three (3) feet in all, and Aong the open streets withing said district at not more than three hundred (~00) feet in distance apart on each said street, notices of the passage of this resolution of intention, in the hammer and form required by the "Improvement Act of 1911". Notice is hereby given that, on Tuesday, the 6th day of September, 19&9, at the hour of 8:00 p.m., in the Council Chamber of said City Council of the City of South San Francisco, and and all persons having any objection to the proposed work and improvements may appear before sai~ city council and show cause ~hy said proposed work and improvement s mhould not be carried out in accordance with this resolution. Except as hereinbefore provided, all the herein proposed work shall be done pursuant to an act of the Legislature of the State of California designated as "Improvement Act of 1911". I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco, this 16th day of August, 19d9, by the following vote: ~yes, Noes, Councilmen Victor Boido, Leo Ferko, Adolph Sani.
