RE~OLVED by the City Council of the City of South San Francisco that piblic intere,t and cenvenier require the following work to be done in said city: The construction of a storm drain in Oak Avenue between Grand Avenue and C~mmercial Avenue, Ail said work shall be done at the'location shown on the plans and specifications hereinafter ~entioned andstrictly in accordance with the plans and specifications submitted by the works engineer of said city for said work, and hereby adopted for said work. Ail said work and all the materials used in connection therewith shall be furnished under the direction and to the satisfaction of said works engineer. It shall be ma_~datory upon the contractor, to w~om the contract is awarded, and upon any subcontractor under him, to pay not less than the specified rates to all laborers, workmen and mechanics employed by them in ~the ex- ecution of the contract. The contractor shall forfeit as a penalty to the 6ity of South San Francisco Ten Dollars ($10.OO) for each laborer, workman or mechanic employed for each calendar day, or portion thereof, such laborer, work- man or mechanic is paid less than said stipulated rates for any work done under said contract, by him, or by any subcontractor under him. Such contract shall contain a stipulation to this effect, in accordance with the provisions of Chapter 397 of the Statutes of California, 1931. No bid will be accepted from any contractor who has not been licensed in accordance with the provisions of an act of[ the legislature of the State of California entitled: "An act providing for the registration of contractors and defining the term contractor, providing the method of obtaining licenses to engage in the business of contracting and fixing the fees for such licenses; providing the method of suspension and cancellation of such licenses; and prescribing .the punishment for violation of the provisions of this act." Chapter 791 of the Statutes and Amendments of 1929, as amended. No~ice is further hereby given that no contractor or subcontractor or agent or representative thereof shall knowi~y employ or cause or allow to be employed, on the work herein provided for, any alien, except in cases of extraordinary emergency caused by fire, flood, or danger to life or property. The contractor or subcontractor to whom the contract for ~aid work may be awarded shall forfeit to the 6ity of .South San Francisco, Ten Dollars ($10.00) for each alien knowingly employed in the execution of such contract, for each calendar day, or portion thereof, during which such alien is permitted or required t~ labor in violation of the provisions of Article ~ of the Labor Code of the State of California. A provision to this effect shall be inserted in such contract. The contract must be entered into in compliance with the subject to the conditions imposed by Article 3 of the Labor Code of the State of California. Such contract shall contain a stipulation to the effect that eight (8) hours shall constitute a legal day's work iD the performance of the work hereih provided for, and tha~ no contractor or subcontractor who employs, directs or c.ontrols the work of any workman employed on public work, shall require or permit such workman to labor more than eight (8) hours during any one calendar day, except in cases of extraordinary emergency, caused by fire, flood or danger to life or property and shall contain the further stipulation, which shall provide that the subcontractor to whom the contract is awarded, shall forfeit as a penalty to said City of South San Francisco Ten Dollars ($10.00) for each workman employed in the execution of such contract by the contractor, or by any subcoatractor, for each calendar day during which any workman is required or permitted to labor more than eight (8) hours in violation Of the provisions of said Article 3. The contract to be awarded shall contain a further stipulation that the contractor, to whom such contract may be awarded, shall use or supply only such unmanufactured materials, produced in the United States, or substantially from materials produced in the United States, excepting anly where such articles, materials or sapplies from ~hich they are manufactured, are not mi~ed, produced ar manufactured, as the case may be, in the United States, as required by Chapter 2, Article 1 of the Government Code of the State of California. Price fitness and quality being equal, said contractor shall, in the performance of the contract, prefer supplies grown, manufactured~ or produced in the. State of California, and shall next prefer supplies partially manufactured grown or produced in this state. The successful bidder shall, within ten (10) days after the award, enter into a contract with the City of South San Francisco for the faithful performance of the work to be done under said award. All sealed proposals or bids shall be accompanied by a check payabl~ to the City of South San Francisco, certified by a responsible bank, for an amount which shall not be less than ten ~10) percent of the aggregate of the proposal, or by a bond for the said amount and so payable, signed by the bidder~and two (2) sureties, who shall Justify, before any officer competent to administer an. o~th, in doublesaidamount, over and. above all statutory exemptions. If the proposal be accepted and the contract awarded and if the bidder shall fail and neglect to execute a contract and give the bonds required, the sum mentioned in said check, or the principal sum of said bond, as the case may be, shall beiliquidated damages for such failure and neglect and shall be forfeited to and paid into the treasury of the City of South San Francisco. The bidder to whom the contract is awarded, will be required to execute a bond for the faithful performance of his work in an amount equal to fifty percent (50%) of the amount of the undertaking with at least two (2) responsible sureties in the fu~l amount of the bond each; and will also be required before entering upon the work to furnish a good and sufficient bond as required by an act of. the legislature of the State of California, approved May 10, 1919, entitled; "An act to secure the payment of the claims of persons employed by contractors upon public works and the claims of nersons who furnish ($10.OO) for each laborer, workn~_a or mechanic employed for each calendar day, or portion thereof, such laborer, work- man or mechanic is paid less than said stipulated rates for any work done under said contract, by him, or by any subcontractor under him. Such contract shall contain a stipulation to this effect, in accordance with the provisions of Chapter 397 of the Statutes of California, 1931.
