HomeMy WebLinkAboutReso 1510-1950432 RESOLUTION NO. 1510 A RESOLUTION oRDERING THE CONSTRIETION AND INSTALLATION OF A TRAFFIC SIGNAL S'~STD~ AT THE INTERSECTION OF ~L CAMINO REAL AND ARROYO DRIVE IN THE CITY OF SOUTH SAN FRANCISCO. RF~OLVED by the City Council of the City of South San Francisco that public interest and convenience require the following improvement work to be done in said city:1 The construction and installation of a full, traffic actuated, two-phase signal system and the construction of concrete curbs at the intersection of E1 Camino seal and Arroyo Drive in the City of South San Francisco. All said work shall be done at the location shown upon the plans hereinafter mentioned and strictly in accordance with the plans and specifications submitted for said work by the works engineer of said city, and hereby adopted for said work. All said work and all the materials used in connection therewith shall be furnished under the direction and to the satisfaction of said works engineer. The following are to be considered as holidays: New Year's Day, Decoration Day, Independence Day, Labor Day~ Admission Day, Thanksgiving Day, §hristmas Day, Saturdays and Sundays. The city clerk is hereby directed to cause a notice inviting sealed proposals for doing said work and for the furnishing of all materials necessary therefor to be published by two (2) insertions thereof, not less than five (5) days apart, in "The Enterprise", a newspaper of general circulation, ~lished and ciruclated in the City of South San Francisco, which notice shall be substantially in the following form: NOTICE INVITING SEALED PP~OPOSALS OR BIDS FOR THE CONSTRUCTION AND IN~ STALLATION OF A TRAFFIC ACTUATED, T~O-PHASE SIGNAL SYSTEM AT THE EL CAMINO REAL AND ARROYO DRIVE IN THE CITY OF SOUTH SAN FRANCISCO. The following are to be considere~ as holidays: New Year's Day, Decoration Day, Independence Day, Labor Day, Admission Day, Thanksgiving Day, Christmas Day, Saturdays and Sundays. It shall be mendatory upon the contractor, to whom the contract is awarded, and upon any sub-contract~ under him, to pay not less than the specified rates to all laborers, workmen and mechanics employed by them in the execution of the contract. The contractor shall forfeit as a penalty to the City of South San Francisco Te: Dollars ($10.OO) for each laborer, workman or mechanic employed for each calendar day, or portion thereof, such laborer, workman or mechanic is paid less than said stipulated rates for any work done under said contract by h! or by any s~-contractor under him. Such contract shall contain a stipualtion to this effect, in accordance ~th the provisions of Chapter 397 of the Statutes of California, 1931. No bid will be accepted from any contractor ~no has not been licensed in accordance with the provisio~ of an act of the legislature of the State of California entitled: "An act providing for the registration of contractors, and defining the term contractor, providing the method of obtaining licenses to engage in the busil of contracting and fixing the fees for such licenses; providing the method of suspension and cancellatien of su licenses; and prescribing the punis~aent for violation of the provisions of this act". Chapter 791 of the Statutes and Amendments of 1929, as amended. Notice is further hereby given that no contractor or subcontractor' or agent or representative thereof shall knowlingly employ or cause or allow to be employed, on the work herein provided, for any alien, except in cases of extraordinary emergency caused by fire, flood, or danger to life or property. The contractor of sub-contractor to whom the contract for said work may be awarded shall forfeit as penalty to the City of South San Francisco, Ten Dollars ($10.OO) for each alien knowingly employed in the execution of such contract, for each calendar day, o= portion thereof, during which such alien is permitted or required to labor in violation of the provisions of Article d of the Labor Code of the ~tate of California. A provision to this effect shall be inserted in such contract. The contract must be entere~ into in compliance with and s~bject to the conditions ~posed by Article ~ of the Labor Code of the State of California. Such contract shall contain a sti~altion to the effect that eight (~) hours shall constitute a legal days work in the performance of the work herein provided for, and that no contractor or subcontractor who empl~ directs or controls the work of any wor~an emoloyed on public work, shall require or permit such workman to labor more than eight (8) hours during any one calendar day, except in cases of extraordinary emergency, cause¢ fire, flood or danger to life or property and shall contain tDe further stipulation, which shall provide tnat! contractor, to whom the contract is awarded, shall forfeit as a penalty to said City of South San Francisco Ie~ Dollars ($10.OO) for each workman employed in the execution of such contract by the contractor, or by any subcontractor, for each calendar day during which any ~or~aan is required or permitted to labor more than eighl hours in violation of the provisions of said Article 3. The contract to be awarded shall contain a further stipulation t~at the contractor, to whom such con~ may be awarded, shall use or supply only such unmanufactured materials, produced in the United States, or substantially from materials produced in the United States, excepting only where such articles, materials or supplies from which they are manufactured, are not mined, produced or manufactured, as the case may be, in the United States, as re~ired by Chapter d, Article i of the Government Code of the State of California. Price, fitness and quality being equal, said contractor shall, in the 9erformance of the contract, p sUpplies grown, manufactured, or produced in the State of California, and shall next prefer supolies partially manufactured, grown or produced in this state. Th& successful bidder shall, within ten (10) days after the award, enter into a contract with the Ci of South San Francisco for the faithful performance of the ~ork to be done under said award. All sealed propc or bids shall be accompanied by a check payable to the City of South San Francisco, certified by a responsible bank, for an amount which shall not be less than ten (10) percent of the aggregate of the proposal, or by abc for the said amount and so payable, signed by the bidder and two (2) sureties, who shall justdfy, before any officer competent to administer an oath, in double said amount, over and above all statutary exemptions. If ~ proposal be acvepted and the contract awarded an~ if th~ bidder shall fail and neglect to execute a contract and give the bonds required, the sum mentioned in s~id check, or the principal sum of said bond, ~.s the case ~ be, shall be liquidated damages for such failure and neglect and shall ~e forfeited to and paid into the tre~ of the City of South San Francisco. The bidder, to whom the contract is awarded, will be required to execute bond for the faithful performance of his work in an amount equal to fifty percent (50%) of the amount of the undertaking with at least two (2) responsible sureties in the full amount of the bond each; and will also be ~ before entering upon the work to furnish a good and sufficient bond, as required by an act of the legislature the State of California, approved ~ay 10, 1919, entitled: "An acto to secure the payment of the claims of pe~ employed by contractors upon public works and the claims of persons who furnish materials~ supplies, became, implements or machinery used or consumed by such contractor in the performance of such works, and prescribing ......... Sealed proposals or bids may be delivered to the city clerk on or before 8 o'clock p.m., on ~onday, t ~th ~ay of February, 1950. All sealed proposals will be opened by said city council in p~lic session, on Monday, the 6th day o~ February, 1950, at S o'clock p.m., at the council chamber of said city council.
