HomeMy WebLinkAboutReso 1573-1950RESOLUTION OF INTENTION NO. 1573 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DE~LARING ITS INTFENTION TO DO CERTAIN PUBLIC I~iPROVEME~ WORK IN THE CITY OF SOUTH SAN FRANCISCO ON SOUTH ¥~PLE AVENUE B~fff~'~EN SOUTH CANAL STREET AND VICTORY AVENUE. WHEREAS public interest and convenience require that the work and improvements hereinafter described should be done; and ~EREAS, in the opinion of the City Council of the City of South San Francisco, said contemplated work and improvement is, and is hereby declared to be of more than local or ordinary public benefit; and ~EREAS Peter Saracco, S. Grassi, A. W. Sorich, Harold S. Firstenberg, Ray Hawley, F. F. Ott, E. L. Bonalanza for E. Mongoia, and Jack A. Cooper, as owners of all that certain tract of land situate in the City of South San Francisco, County of San Mateo, State of Califor- nia, described as follows: COMMENCING at a point which bears south 15 degrees 33 minutes west 60 feet and north 7A degrees 27 m&nutes west 2d3 feet from the in- tersection of the ~esterly boundary of South Linden Avenue with the southerly boundary of Drainage Canal Right-of-way; thence from said point of commencement north 7A degrees 27 minutes west 800 feet; thenc~ south 15 degrees 33 minutes west 1157.62 feet; thence south 7d degrees 27 minutes east 550 feet; thence north 15 degrees 33 minutes east 200 feet; thence south 7d degrees 27 minutes east 250 feet; thence north 15 degrees 33 minutes east 957.62 feet to the point of commencement; have filed with the city clerk of said city an instrument in writing reading as follows: "We, the undersigned, as owners of all that certain tract or parcel of land hereinafter described,, do hereby waive the benefit of that certain act of the Legislature of the State of California known and designated as the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931", with respect to all the imorovements hereinafter mentioned. "The construction of pavement, sidewalk, curbs and gutters in the portion of South Maple Avenue between South Canal Street and Victory Avenue, in the City of South San Francisco in ac- cordance with the plans and specifications adopted for said work by the City Council of the City of South San Francisco on the 17th day of July, 1950. 494 "The land hereinbefore referred to is all that certain land situate in the City of South San Francisco, County of 3an Mateo, State of California, and described as follows: "COMMENCING at a point which bears south 15 degrees 33 minutes west 60 feet and north 7& degrees 27 minutes west 2~3 fec~,t from the intersection of the westerly boundary of south Linden Avenue with the southerly boundary of Drainage Canal Right-of-way; thence from said point of commencement north 7& degrees 27 minutes west 800 feet; thence south 15 degrees 33 minutes west 1157.62 feet; thence south 7~ degrees 27 minutes east 550 feet; thence north 15 degrees 33 minutes~east 200 feet; thence south 7A degrees 27 minutes east 250 feet; thence north 15 degrees 33 minutes east 957.62 feet to the point of Commencement. "We hereby consent to the Construction of all said improvements under the provisions of that certain act of the Legislature of the State of California known and designated as the "Improvement Act of 1911", and likewise consent to the assessment of all said land for the cost of said improvements, and to the issuance of bonds to represent unpaid assessments under the provisions of that certain act of the Legis- lature of the State of California known as the "Improvement Bond Act of 1915", which bonds shall bear in- terest at the rate of five percent (5%) per annum, the last installment of which bonds will mature fourteen (l&) years from the second day of July, ne~t succeeding ten (10) months from their date, without compliance with the procedure set forth in said Special Assessment Investigation, Limitation and Majority Protest Act. AND I~MEREAS an estimate of the cost and expense of said work has been filed with the city clerk of said city; NOW, THEREFORE, RESOLVED by the City Council of the City of South San Francisco that it is the intention of said city council to order the following work and improvements to be done in said city, t o-wit: The construction of pavement, sidewalk, curbs and ~tters in the portion of South ~ple Avenue between South Canal Street and Victory Avenue, in the City of South San Francisco. All the work herein provided for shall be done in accordance with the special plans, pro- files and specifications for said work, and at the location and to the grades shown upon said plans, which plans, profiles and specifications are entitled: "Plans and specifications for the construction of pave- ment, sidewalk, curbs and gutters on South Maple Avenue between South Canal Street and Victory Avenue," which plans, profiles and s~ecifications were heretofore adopted by said city council on the 17th day of July, 1950, and are now on file in the office of the city clerk. Reference is hereby made to said plans, profiles and specifications for a f~ll description of said work and for the location and the extent of the work to be done hereunder and for the grades to which s~id work is to be done, and for a particular description of the boundaries of the district herein mentioned. Said city council does hereby determine and declare that said proposed work and improvement is of more than local or ordinary public benefit and will affect and benefit the lands and district here- inafter described, which said district is hereby declared to be the district benefited by said work and improvements and that, therefore, the entire cost and expense of said work and improvement shall be and hereby are made chargeable a~minst and shall be assessed upon said lands and district, except as herein- after expressly provided, which district is within the City of South San Francisco, County of Jan Mateo, State of California, and particularly described as follows, to-wit: COMMENCING at a point which bears south 15 degrees 33 minutes west 60 feet and north 74 degrees 27 minutes west 243 feet from the intersection of the westerly boundary of South Linden Avenue with the southerly boundary of the Drainage Canal Right-of-way; thence from said point of commencement north 7A degrees 27 minutes west 800 feet; thence south 15 degrees 33 minutes west 1157.62 feet; thence south 7A degrees 27 minutes east 550 feet; thence north 15 degrees 33 minutes east 200 feet; thence south 7~ degrees 27 minutes east 250 feet; thence north 15 degrees 33 minutes east 957.62 feet to the point of commencement. Notice is hereby given that serial bonds to represent unpaid assessments, and to bear in- terest at the rate of five (5) percent per annum, will be issued hereunder in the manner provided by Division l0 of the Streets and Highways Code, inthe Improvement Bond Act of 1915, and the last instaLLment of such bonds shall mature fourteen (lA) years from the second day of July, next succeeding ten (10) months from their date. The South San Francisco Enterprise-Journal, a newspaper of general circulation, printed and published in said City of South San Francisco, is hereby designated as the newspaper in which this resolu- tion of intention shall be published, and the city clerk is hereby directed to cause this resolution to be published by two (2) insertions in the manner and form required by law. Said city clerk is also directed to mail a notice of the adoption of said resolution of in- tention, postage prepaid, to all persons owning real property which is proposed to be assessed to nay any part of the cost of said work, whose names and addresses appear on the last equalize4 assessment roll, or as known to said city clerk. The superintendent of streets shall cause to be conspicuously posted along the line of said contemplated work or improvements, and not more than three hundred (300) feet in distance apart, but not less than three (3) in all, and along the open streets within said district at not more than three hundred (300~ feet in distance apart on each said street, notices of the passage of this resolu- tion of intention, in themanner and form required by the "Improvement Act of 1911". Notice is hereby given that on Monday, the 18th day of September, 1950, at the hour of 8 o'clock p. m., in the Council Chamber of said City Council of the City of So~th San Francisco, any and all persons having any objections to the proposed work and improvements may appear before said city council and show cause why said proposed work and improvements should not be carried out in accordance with this resolution. Except as hereinbefore provided, all of the herein proposed work shall be done pursuant to an act of the Legislature of the State of California designated as "Improvement Act of 1911". I hereby certify that the foregoing resolution was regularly introduced and adopbed by the City Council of the City of South San Francisco, this 28th day of August, 1950, by the following vote: Ayes, Councilmen Victor Boido, Charles K.
