HomeMy WebLinkAboutReso 1594-1950RESOLUTION OF INTENTION NO. 159d A RFSOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DECLARING ITS IYTF~TION TO CONSTRUCT A VITRIFIED CLAY PIPE SANITARY S~ER BEI~.~ ~tFSTNUT AVENUE AND EL CAMINO R~i~L. W~EREAS public interest and convenience require that the work and improvements here- inafter described should be done; and ~EREAS, in the oninion of the City Council of the City of South San Francisco, said contemplated work and improvement is, and is hereby declared to be of more than local or ordinary public benefit; and I~.~EREAS an estimate of the cost and exoense of said work has been filed ~th the city clerk of said city; NOW, THEREFORe, resolved by the City Council of the City of South San Francisco that it is the intention of said city council to order the folIowinz work and improvements to be done in said city: The construction of a vitrified clay pipe sanitary sewer between Chestnut Avenue and E1 Camino Real. All the work herein provided for shall be donein accordance with the special plans, profiles andspecifications for said work and at the location and to the grade shown upon said plans, which plans, profiles, andspecifications were heretofore adopted, by said city coundl on the 3Otb day of October, 1950, and are now on file in the office of said ci~%y clerk. Reference is hereby made to said plans, profiles, and specifications for s ?u!] des- cription of said work and for the location aris the extent of the work to be done hereunder and for the srades to which said work is to be done, and for a particular description of the boundaries of the ~istrict herein mentioned. Said city council does hereby determine and declare that said proposed work and im- provement is of more than local or ordinary oublic benefit and will affect and benefit the lands and district hereinafter described, which said district is hereby declared to be the district benefited by said work and ~mprovements and that, therefore, the entire cost and expense of said work and im- provements shall be and are hereby made chargeable against and shall be assessed upon said lands and district, except as hereinafter expressly provided, which district is within the City of South San Francisco, County ofSan Mateo, State of California, and particularly described as follows: BEGINNING at a point on the corporate limits line of the City of South San Francisco, said point bein~ the point of intersection of the Northeasterly line of the 80 foot right of way of the City and County of San Francisco with theNorthwesterly line of Block 9, as said block is designated on the map entitled "RANCHO BURI BURI SOUTH SAN FRANCISCO, CALIFORNIA", which map was filed in the office of the Record. er of the County of San Mateo, State of California, on March 22, 19A6 in Book 25 of Maps at Pages 28, 29 and 30; thence from said point of beginning along said Northwesterly line of Rancho Buri Buri Subdivision No. 1, and along the Southwesterly prolongation of said line Southwesterly to the Southwesterly line of Junipero Serra Boulevard and the corporate limits line of the City of South San Francisco; thence along said corporate limits line the following courses: Northwesterly along the Southwesterly line of Junipero Serra Bo~levard to the Southeasterly line of the 62.52 acre tract conveyed to Frank Lago- marsino by Deed recorded in Book 235 of Deeds at page 452, San Mateo County Records; Southwesterly alon~ s.~id Southeasterly line to the most Southerly corner of said 62.52 acre tract; alon~ the boundary of said 62.52 acre tract and the bo~ndary of the 179.11 acre tract conveyed to Oliver D. Hamlin by Deed recorded in Book 259 of Deeds, at page 366, San ~ateo County Records, Northwesterly and Northeasterly to the South- erly corner of the 53.95 acre tract conveyed to Vfil].iam E. Arata et al by Deed recorded in Book 210 of Deeds at page 79, S~mn Mateo County Records; along the boundary, of said 53.95 acre tract ~orthwesterly and Northeasterly to the Southerly corner of the Cypress Lawn Cemetery, said corner !~ein~ on the corporate limits line of the Town of Colma; Northeasterly along the So~theasterly line of Cypress Lawn Cemeteruf~ ~nd the corporate limits line of the Town of Colma to the Northeasterly line of E1 Cmmino Real; South- easterly alon.~ the Northeasterly line of E1 Cmmino Real to the Northwesterly line of the aforementioned Lagomarsino 62.52 acre tract; Northeasterly alonff the Northwesterly line of said 62.52 acre tract to the Southwesterly line of Market Street Railway and the corporate limits line of the Town of Colma; and Southeasterly alon~ said corporate limits line to a point 18.21 feet at right an~les Northwesterly from the Southeasterly line of said 62.52 acre tract; thence, leaving the corporate limits line of the City of South San Francisco, Northeasterly along a line parallel to, and 18.21 feet at right angles Northwesterly from the Southeasterly line of said 62.52 acre tract to the Northeasterly line of Mission Road; thence Southeasterly along said Northeasterly line of Mission Road to the corporate limits line of South San Francisco, said point being along the h~esterly corner of the 13.215 acre parcel of land conveyed to ~ntonio Scopesi and wife by Dee~ recorded January 9, 1936 in Book 673 of Official Records of San Mateo County at Page 61 (71767C); thence along said corporate limits line of the City of South San Francisco the foll~inK courses: Northeasterly along the North- westerly line of the said lands of Scopesi 3260 feet, more or less, to the most North- erly corner thereof, said point being in the Southeasterly corporate limits line of the City of Colma, which line is also the Southwesterly line of the subdivision desig- nated on the "Map of the Lands of the ~bbey Homestead Associates", which Map was filed in the Office of the Recorder of the County of San Mateo, State of California on January 2, 1872 in Book 15 of Deeds at pages 2 and 3 and copy entered in Book B of Maps at PaMe 43 and Book 1 of Maps at Page lA; along said corporate limits line of the lO City of Colma, $o~theasterly 950 feet, more orless, and Northeasterly 1OO feet more or less, and Northeasterly 100 feet more or ]ess, to the intersection of said corporate limits line with the So~thwesterly line of Hillside Boulevard; and leavin~ the cor- porate limits line of the City of Colma and following said Southwesterly line of ~!i]lside Bo~levard Southeasterly _1510 feet, more or less, to the Easterly corner of the parcel of land described in Parcel 4 of the Deed from C~lifornia Pacific Title Insurance Company to Pacific Coast Construction Company and recorded in Book 1797 of Of£icial Records of San Mate~ County at Pa~e 576 (37965 I); thence, leaving said corporate ~imits line of the City of South San Francisco, and runnin~ alon~ the boun- dary of said Parcel A So~th 37° 38, ~0" YJest 561.85 feet, North 55° 37, 50" East 105.29 feet, South 35° 0~' 30" ~est 581.7~ fe~t and North ~9° ~3' 5~" West 50.21 feet to the Easterly corner of Parcel 10 described in said Deed from the California Pacific Title Insurance Company to Pacific Coast Construction Company, thence South 35~ 0~' 30" ~?est, alon~ the Southeasterly line of Parcels 10, 9 and 3 described in said Deed to Pacific Coast Construction Company and the prolongation of said line, to the Northwesterly line of Lot 10 in Block 1 as shown on the map e~titled, "Regli Tract, So~th San Francisco, California", which ma~ was filed, in theOffice of the Re- corder of the Co~mty of San Mateo, State of California on May ~, 192~ in Book 11 of Maps Page 63; thence Northwesterly alon~ said Northeasterly line of Lot 10 to the Northerly corner of Lot 10; thence Southwesterly along the ~ortb~westerly boundary of said Regli Tract to the Northeasterly line of Wission Road; thence Southeasterly alon~ the Northeasterly line of Mission Road to the Southeasterly line of ~7illow Avenue; thence Northeasterly along said Southeasterly line of ?~illow Avenue 300 feet; thence Southeasterly to a point in the Southeasterly line of Oak Avenue, which point is 300 feet at right an~les Northeasterly from the City of South S~n Francisco ~rain- age canal right of way described in the instr~ment recorded in Book 6~0 of Official Records of San Mateo County at Page 232 (7507~ C); thence Southeasterly a]on~ a line 300 feet at right angles ~ortheasterly from said drainage right of ~ay to the South- easterly line of Chestnut Avenue; thence Southwesterly along said Southeasterly line of Chestnut Avenue to a point 300 feet at right angles Southwesterly from said drainage right of way; thence Northwesterly along a line 500 feet at right an~les Southwesterly from said drainage canal to the Southwesterly line of Mission Road; thence Northwesterly along said South~.zesterly line of Mission Road to the Southeast- erly line of the aforesaid 62.52 acre tract conveyed to Frank Lagomarsino; thence So~thwesterly alon~ the Southeasterly line of said 62.52 acre tract to the Northeast- erly line of the 80 foot right of way of the City and County of San Francisco; thence Southeasterly alon~ the Northeasterly line of said 80 foot right of way to the point of beginning. Notice is hereby ~iven that serial bonds to represent unpaid assessments, and to bear interest at the r~te of five percent (5~) per annum will be issued hereunder in the manner provided by Division 10 of Streets and I~ighways Code, in the Improvement Bond Act of 1915, and the last in- stallment of such bonds shall mature fo~rteen (lg) years from the 2nd day of July, next succeeding ten (10) months from their date. The SOUTH SAN FRANCISCO ~TERPRISE-JOURNAL, a newspaper of ~eneral circulation, printed and published in said City of South San Francisco, is hereby designated as the newspaper in which this resolution of intention shall be published, and the city clerk is hereby directed to cause this resolution to be published by two (2) insertions in the manner and form respired by law. Said city clerk is also directed to mail a notice of the adoption of this resolution of intention, postage prepaid, to all persons owning real property which is proposed to be assessed to pay any part of the cost of said work, whose names and addresses appear on the last e~alized assessment roll, or as known to said city clerk. The superintendent of streets shall cause to be conspicuously posted alon? the line of said contemplated work or improvement, and not more than three hundred (300) feet in distance apart, but not less than three (3)in all, and alon~ the open streets within said district at not more than three hundred (300) feet in distance apart on each said street, notices of the passage of this resolution of intention, in the manner and form requir~ by the "Improvement Act of 1911." Notice is hereby ~iven that Monday, the Ath day of December, 1950, at the hour of 8 o'clock p. m., in the council chamber of said City Council of the City of South San Francisco, any and all oersons having any objection to the pro?osed work and improvements may appear before said city council and show ca~se why said proposed work and improv~ents should not be carried out in accordance with this resolution. Except as hereinbefore provided,all of the herein-proposed work shall be done pur- suant to an act of the legislature of the State of California designated as "Improvement .~,ct of 1911". I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Franci~co this 13th day of November, 1950, by the follow- lng vote: Ayes, Councilmen.
