HomeMy WebLinkAboutReso 1609-1950ORDERING ~{ESOLVED, by the City Council of the City of South San Francisco, California, that '~EREAS, said Board did an November 13, 1950, adopt its Resolution of Intention No. 159A to order certain ~.mprovements to be made in said City ~mder and pursuant to the Improvement Actor 1911, and to issue bonds pursuant to the Improvement Bond Act of 1915, which Resolution of Intention was modified by Resolution No. 1607 Ordering ChanEes and Modifications adopted on December 18, 1950, and is proposed to be modified by Resolution No. 1607 of Intention to Rake Changes and Modifications adopted on said dater reference to which Resolutions is hero,by made for a particular description of the improvements to be made, the boundaries of the assessment district, and the bonds to be issued; WHEREAS, said Resolution of Intention has been duly published twice in the South San Fran- cisco ~terorise~Journal, a newspaper of general circulation printed and published in said City, and notices of'the passage of said Resolution of Intention headed "Notice of Improvement" and of the time and place of the hearing as fixed b~ sa~d Resolution of Intention~ when and where all persons interested, having any objections to the oroposed improvements or 3gainst the district to be assessed for the costs and expenses thereof, or against the ~rades at which said work shall be done, may aopear before said Council and show cause why said improvements should not be carried out in a.'~cordance with said Resolution of Intention, were duly posted within the time and in the manner provided in said Act, and as directed by said Resolution of Intention, as appears from the affidavits of posting and publication on file in the office of the City Clerk; ~.~EREAS, at the time and place fixed for said hearing, protests or objections were made or presented to the proposed improvements, or to the district to be assessed, or to the grades at which said work was to be done, or to the bonds to be issued to pay the costs and expenses thereof, or to the engineer's estimate of the costs and expenses thereof, and all persons intersted desirin~ to be heard were given an o~portunity to be heard, and all matters and things pertai~ing to said proposed improvements were duly heard and considered by said Board; NOW, THEREFORE, said City Council does hereby FIND, DETER~INE and ORDER, ss follows: 1. That the plans and specifications for said improvemepts under said Resolution of Intention as modified and proposed to be modified be, and they are hereby, finally adopted and approved as the plans and specifications to which said work and improvement shall be done. 2. That the engineer's estimate of the itemized and total estimated cost and expenses for said improvements, under said ~esolution of Intention as modified and proposed to be modified be, and it is finally, adopted and approved as the engineer's total and detailed estimate of the costs and expenses of said improvements. 3. That the public interest and convenience require, and said City Council does hereby order the improvements to be done as described in and in accordsnce with said Resolution of Intention ~s modified and proposed to be modified, which resolutions are on file in the office of the City Clerk, reference to ?~nich is hereby made for a more particular description of the sa%d improvements and also for further particulars, m~rsuant to the provisions of the Improvement Act ofl911' such work to be done and improvements to be made under the direction and subject to the approval of the Works Engineer of said Gity. h. Said contemplated work and improvement, in the opinion of said Counc!l, are of more than local or ordinary public benefit, and said Council does make the expense of said work and improvement chargeable upon a district, which district said Council declares to be the district benefited by said work and improvements and to be assessed to pay the cost and expenses thereof, the exterior boundaries of which district are described as follows: Beginning at a point on the corporate limits line of the City of South San Francisco, said pbint being the point of intersection of the N~rtheasterly l~ne of the 80 foot right of way of the City and County of San Francisco with the Northwesterly line of Block 9, as said block is designated on the map entitled "RANCHO BURI BURI SO~H SAN FRANCISCO, CALIFORNIA", which map was filed in the office Of the Recorder of the County of San Mated State of California, on March 22, 19A6 in Book 25 of Maps at Pages 28, 29, and 30; thence from said point of beginning along said Northwesterly line of Rancho Buri Buri Subdivision No. l, and along the Southwesterly prolonFation of said line Southwest- erly to the Southwesterly line of Junipero Serfs Boulevard and the corporate limits line of the City of South San Francisco; thence along said corporate limits line the following courses: Northwesterly along the Southwesterly line of Junipero Serra Boulevard to the Southeasterly line of the 62.52 acre tract conveyed to Frank La~omarsino by deed recorded in Book 235 of Deeds at page A52, San Mated County Records; Southwesterly along said Southeasterly line to the most Southerly corner of said 62.52 acre tract; along the boundary of said 62.52 acre tract and the boundary of the 179.11 acre tract conveyed to Oliver D. Hamlin by Reed recorded in Book 259 of Deeds at page 366, San Mated County Records, Northwesterly and Northeasterly to the Southerly corner of the 53.95 acre tract conveyed to :~lliam E. Arata et al by deed recorded in Book 210 of Deeds at p~ge 79, San MateD County Eecords; slong the boundary of said 53.95 acre tract Northwesterly and Northeasterly to the Southerly corner of the Cypress Lawn Cemetery, said corner being on the corporate limits line of the Town of Colma; Northeasterly along the Southeasterly line of Cypress Lswn Cemetery and the corporate limits ldne of the Town of Colma to the Northeasterly line of E1 Camino Real; Southeasterly along the Northeasterly l~ne of E1 Camino Real to the ~Iorthwesterly line of the aforementioned Lagomarsino 62.52 acre tract; Northeasterly along the Northwesterly line of said 62.52 acre tract to t he South- westerly line of Market Street ~ailway and the corporate limits line of the Town of Colma; and Southeasterly along said corporate limits line to a point 18.21 feet at right angles Northwesterly from the Southeasterly line of said 62.52 acre tract; thence, leaving the corporate limits line of the City of South San Francisco, Northeasterly along a line parallel to, and 18.21 feet at right angles Northwesterly from the So,]theasterly line of said 62.52 acre tract to the Northeasterly line of Mission Eoad: thence South- easterly along said Northeasterly line of Mission Road to the corporate l~mits line of South San Francisco, said point being along the ~sterly corner of the 13.215 acre par- cel of land conveyed to Antonio Scopesi ~nd wife by deed recorded January 9, 1936 in Book 073 of Official ~ecords of San MateD County at page 61 (71767C); thence along said cor- porate limits line of the City of South San Francisco the following courses:' North- easterly along the Northwesterly line of the said lands of Scopesi 3260 feet, more or less, to the most Northerly corner thereof, said point being in the Southeasterly coroorate l~mits line of the City of Colma, which line is also the Southwesterly line of the sub- division designated on the "Map of the Lands of the Abbey Homestead Associates", which ~ap was filed in the Office of the ~ecorder of the County of San ~ateo, State of California on January 2, 1872 in Book 15 of Deeds st pages 2 and 3 and cody entered in Book B of Maps atpage A3 and Book 1 of Maps at page lA; along said corporate limits line of the City of Colma, southeasterly 950 feet, more or less, and Northeasterly 100 feet more ~ less, to the intersection of said corporate limits line with t he Southwesterly l~ne of Hillside Boulevard; and leaving the corporate limits line of the City of Colma and following said Southwesterly line of Hillside Boulevard Southeasterly 1510 feet, more or less, to the Easterly corner of the parcel of land described in Parcel A of the deed from California Pacific Title Insurance Company to Pacific Coast Construction Company and recorded in Book 1797 of Official Records of San MateD Co~mty at page 576 (37965 I): thence, leaving said cornorate limits line of the City of South San Francisco, and running ~lon~ the , ,, q boundary of said Parcel & South 37© 3E &O ~est 561.~5 feet, South 55© 37' 50" East 105.29 feet, South 35° DA' 30" West 5~1.7& feet and North A9© h3' 5~" Wost 50.21 feet to the Easterly corner of Parcel 10 described in said deed from t~e California Pacific Title Insurance Company to Pacific Coast Construction Company, thenc~e South 35© DA' 30" ~st along the Southeasterly line of Parcels 10, 9 and 3 described in said deed to Pacific Coast Construction Company ~nd the orolongation of said line, to the Northeasterly line of Lot 10 in Block 1 as shown on the Nap entitled "Regli Tract, South San Francisco, California", which map was filed in the Office of the Recorder of the County of San MateD, State of California on M~y 8, 192~ in Book Il of Maps, oage 63; thence Northwesterly along said Northeasterly line of Lot 10 to the Northerly corner of Lot 10; thence Southwesterly along the Northwesterly boundary of said Regli Tract to the Northeasterly line of Missio~ '~oad; thence ~outheasterly along the Northeasterly line of Mission ~oad to the Southeasterly line of ~illow Avenue: thence Northeasterly along said South- easterly line of Willow Avenue 300 feet; thence Southeasterly to a point in the South- easterly line of Oak Avenue, which point is 300 feet at right angles Northeasterly from the City of South San Francisco drainage canal right of way described in the instm~ment recorded in Book 680 of Official Records of San mateo County at page232 (7507A C); thence Southeasterly along a line 300 feet at right ankles Northeasterly~rom said drainage right of way to the Southeasterly line of Chestnut Avenue; thence Southwesterly along said Southeasterly line of Chestnut Avenue to a point 300 feet at right angles Southwesterly from said drainage right of way; thence Northwesterly along a line 300 feet at right ankles Soithwesterly from sai~ drainage canal to the Southwesterly line of Mission Road~ thence Northwesterly along said Southwesterly line of Mission Read to the Southeasterly line of the aforesaid 62.52 ~cre tract conveyed to Frank Lagomarsino; thence Southwesterly along the Southeasterly line of said 62.52 acre tract to the Northeasterly line of the 80 foot right of way of the City and County of San Francisco; thence Southeasterly along the Northeasterly line of said 80 foot right of way to,he point of beginning. Said Council further declares that all public streets and highways and other oublic property within said assessment district, in use in the performance of a public function as such, shall be omitted from the assessmmnh hereafter to be made to cover the costs and expenses of said improvement.
