HomeMy WebLinkAboutReso 1622-1951RESOLUTION NO. 1622 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO PROVIDING FOR THE EXTENSION OF SPRUCE AVINUE FROM RAILROAD AVENUE TO EL CAMINO REAL AT THE INTERSECTION THEREOF %~XTH HAZELWOOD DRIVE. RESOLVED by the City Council of the City of South San Francisco, th~tpublic interest and convenience require the following improvement work to be done in said city: Construct storm drains and fill for Spruce Avenue Extension between the Southern Pacific Co., V~lencia Branch, and E1 C~mino Real. All said work shall be'done at the location shown upon the plans and specifications submitted this day by the Works Engineer of the City of South San Francisco for said work, which plans and specifications are hereby adopted for said work. All said work shall be done and the materials used in' connection therewith shall be furnished under the direction and td the satisfaction of the Works Engineer of said city. The following are to be considered holidays: New Year's Day, Decoration Day, Inde- pendence Day, Labor Day, Admission Day, Thanksgiving Day, Christmas Day and Sundays. The clerk is hereby directed to publish by two (2) insertions in the SOUTH SAN FRANCISCO ENTERPRISE-JOUrNAL, a newspaper of general circulation, published and circulated in the City of South San Francisco, a notice calling for sealed proposals or bids for doing said work, which notice shall be substantially in the following form: NOTICE INVITING S~%LED PROPOSALS FOR THE EXTENSION OF SPRUCE AVENUE FROM RAILROAD AVENUE TO EL CAMINO REAL AT THE INTERSECTION THEREOF ~4ITH HAZELWOOD DRIVE. Notice is hereby given that sealed proposals or bids will be received by the City Council of the City of South San Francisco on Monday, the 29th day of January, 1951, at the hour of 8 o'clock p. m., for doing the following improvement work in said city, to-wit: Construct storm drains ~nd fill for Spruce Avenue Extension between the Southern Pacific Co., V lencia Branch, and E1 Camino Real. All said work shallbe done at the location shown upon the plans and specifications for said work and strictly in accordance with said plans and specifications heretofore adopted for said work. The following are to be considered holidays: New Year's Day, Decoration Day, Independence Day, Labor Day, Admission Day, Thanksgiving Day, Christmas Day and Sundays. It shall be mandatory upon the contractor to whom the contract is awareded, and upon any subcontractor under him, to pay not less than the specified rates to all laborers, workmen and mechanics employed by them in the execution of the contract. The contractor shall forfeit as a penalty to the City of South San Francisco TEN DOLLARS ($10.00) for each laborer, workm~u or mechanic employed, for each calendar day, or portion thereof, such laborer, workman or mechanic is oaid less than the said stipulated rates for any work done under said contract, by him, or by any subcontractor under him. And such contract shall contain a stipulation to this effect, in accordance with the provisions of Chapter 397 of the Statutes of California, 1931. No bid will be accepted from any contractor who has not been licensed in accordance with the provisions of an act of the Legislature of the State of California entitled: "An act p~o- viding for the registration of contractors, and defining the term contractor, providing the method of obtaining, licenses to engaEe in the business of contracting, and fixing the fees for such licenses; providing the method of suspension and cancellation of such licenses; and prescribing the punishment for violation of the provisions of this act." Chapter 791 of the Statutes and Amendments of 1929, as amended. Notice is further hereby given that no contractor or subcontractor or agent or representative thereof shall knowingly employ or cause or allow tobe employed on the work herein provided for any alien, except in cases of extraordinary emergency caused by fire, flood or danger to li~e or property. The contractor or subcontractor to whom the contract for said work may be awarded shall forefeit as a penalty to the City of South San Francisco T~N DOLLARS ($10.00) for each alien knowingly employed in the executionof such contract, for each calendar day, or portion thereof, during which such alien is permitted or required to labor in violation of the provisions of Division II, Part I, Chapter I, Article A of the Labor Code of the State of California. A provision to this effect shall be inserted in such contract. The contract must be entered into in compliance with and subject to the conditions imposed by Divison II, Part 7, Chapter I, Article 3 of the Labor Code of the State of California. Such contract shall contain a stipulation to the effect that eight (8) hours shall constitute a legal day's work in the performance of the work herein provided for, and that no con- tractor or subcontractor who employs, directs or controls thework of any workman employed on public work shall require or permit such workman to l~bor more than eight (8) hours during any one calendar day, except in cases of extraordinary emergency caused by fire, flood or danger to life or property a~d shall contain the further stipulation which shall provide that the contractor to whom the contract is awarded shall foreFeit as a penalty to the City of South San Francisco T~N DOLL~ARS ($10.00) for each workman employed in the execution of such contract by the contractor or by any subcontractor for each calendar day during which any workman is required or permitted to labor more than eight (8) hours in violation of the provisions ofsaid Article 3. The contract to be awarded shall contain a further stipulation that the contractor, to whom such contract may be awarded, shall use or supply only such unmanufactured materials, pro- duced in the United States, or substantially from materials produced in the United States, excepting only where such articles, materials or supplies from which they are manufactured are not mined, pro- duced or manufactured, as the case may be , in the United States, in accordance with the provisions of Title l, Division 5, Chapter 4, Article I of the Government Code of the State of Ealifornia. Price, fitness and quality being equal, the successful bidder shall, in the performance of his contract, prefer supplies ~rown, manufactured or produced in the ~hate of California, and shall next prefer supplies partially manufactured, Erown or produced in this state, as required by Title I, Division 5, Article 2 of the Government Code of the State of California. The successful bidder shall, within ten (10) days after the award, enter into a con- tract with the City of South San Francisco for the faithful performance of the work to be done under said award. All sealed proposals or bids shall be accompanied by a check payable to the City of South San Francisco, certified by a responsible bank for an amount which shall not be less than ten (10) percent of the Aggregate of the proposal, or by a bond for the said amount and so payable, signed by the bidder and two (2) sureties who shall justify before any officer competent to a&minister an oath in double said amount over and above all statutory exemptions. If the proposal be accepted and the contract awarded, and if the bidder shall fail and neglect to execute a contract and give the bonds required, the sum mentioned in said check, or the principal sum of said bond, as the case may be, shall be liquidated damages for such failure and neElect and shall be forfeited to and paid into the treasury of the City of South San Francisco. The bidder to whom the contract is awarded will be required to execute a bond for the faithful performance of his work in an amount equal to fifty (50) percent of the amount of the undertaking with at least two (2) responsible sureties in the full amount of the bond each; and will also be re~ired before entering upon the work to furnish a good and sufficient bond, as required by Title l, Division 5, Chapter 3 of the Government Code of the State of California. Plans, specifications~and proposal sheets may be obtained at t~e office of Charles E. Randlett, said works engineer, City Hall, South San Francisco, California. Sealed proposals or bids will be delivered to the City Clerk of the City of SouthSan Francisco, in the City Hall, South San Francisco, California, on or before 8 o'clock p. m., on Monday the 29th day of January, 1951. All sealed proposals or bids will be opened by said city council on Monday, the 29th day of January, 1951, at 8 o'clock p. m. Said city council hereby reserves the right, in its discretion, to reject any and all bids and to award the contract for all said work, or for any portion or portions thereof.
