HomeMy WebLinkAboutReso 1761-1952RESOLUTION NO. 1761 DECLARING THAT INVESTIGATION PROCEEDINGS ARE NOT REQUIRED IN SHAW ROAD PROCEEDINGS. RESOLVED, by the City Council of the City of South San Francisco, California, that: WHEREAS, it is the intention of said City Council to make the following improvements in and for said city, to-wit: the improvement of Shaw Road for its entire length as shown ou that certain map entitled: "ASSESSMENT DIAGRAM, INDUSTRIAL ACRES IMPROVEMENTS, RESOLUTION OF INTENTION NO. 1762", by excavation and grading for its full length and the construction therein of aauitary sewer mains and laterals, storm sewers, pavement of crusher run base with asphaltic concrete surfaclug, Portland cement concrete curbs and gutters, together with backfilling necessary therefor, together with lamp holes, man holes, and catch basins necessary for the foregoing, together with construction of storm water drain from Shaw Road through easement in Lot No. 5 (assessment number), and the performing of all work auxiliary to the foregoing which may be necessary to carry out the same, and WHEREAS, the owners of more than 85~ of all the property within the proposed assessment district have signed and filed with this Council a written petition for the doing of said work and waiver of proceed- ings under the "Special Assessment, Investigation, Ltm~tatiou and MaJority protest Act of 19Bl", NOW, TMMREFORE, IT IS ORDERED, FOUND AND DETERMINED AS FOLLOWS: 1. That none of the property owners of property within the area of the proposed assessment dis- trict demanded the making of the investigation proceedings provided in the Special Assessment Investigation, Limitation and Majority Protest Act of 1931 for the work and improvement herein provided to be done. 2. That said Council proceed under the provisions of the Improvement Act of 1911 and the Improve- ment Bond Act of 1915 to carry through the contemplated proceedings without any further restrictions what- soever by reason of the terms and provisions of said "Special Assessment Investigation, Limitation and Majority Protest Act of 19B1. 3- The boundaries of the lands and of the districts of lands proposed to be specially assessed to pay the cost and expenses of such work and proposed improvement are generally described as follows, to-wit: Ali that certain real property situate in the City of South San Francisco, County of San Mateo, State of California, to-wit: BEGINNING at the southwesterly corner of Lot 4 as shown upon that certain map entitled "Industrial Acres", recorded iu Book 35 of Maps at Pages l0 and ll, Official Records of San Mateo County, California; thence along the southerly line of said Lot 4 South 89° 57' lB" East 405.63 feet; thence South 5° 53' 23" East 100.54 feet to the northerly line of Lot 6 of said Industrial Acres; thence along the bounAary line of Lots 6 and 7, Industrial Acres, North 89° 57' lB" West 359.69 feet; South along a curve to the right with a radius of 392.25 feet~ an arc distance of 190.39 feet; thence South 0° 59' East 454.42 feet, South lO° 29' lB" East 266.45 feet and South 89° 57' 13" East 355.11 feet; thence South 8° 35' 07" West 288.19 feet to the corporate limits line of the City of South San Francisco; thence along said corporate limits line South 89° 57' lB" East 160.32 feet to the southwesterly corner of Lot 8 of said Industrial Acres; thence along the southerly, easterly and northerly boundaries of said Industrial Acres South 89° 57' lB" East 13.86 feet; North 6~° 21' East 75.58 feet, South 30o BO' East 31.56 feet, North 6° 47' 43" West 9.31 feet, North 07°ll' 17" East 259.66 feet, North 15° 03' 20" West 169.32 feet; thence Northerly ou a curve to the right with a radius of 5115 feet, tangent to the preceding course, au arc distance of 987.96 feet, North 03° 59' 20" West 725.85 feet~ North 79° 29' 20" West 420.31 feet and North 65° 42' SO" West 125.02 feet to the northwesterly corner of Lot 5 of said Industrial Acres; thence North 51° 24' 06" West 502.35 feet; thence South 89° 54' West 65 feet, more or less to the easterly line of the Southern Pacific Company Railroad right-of-way; thence along said easterly railroad right-of-ray line South ll° 39~ West 135 feet and South along a curve to the left with a radius of 563.14 feet tangent to the preceding course, an arc distance of 245 feet more or less to a point 100 feet distant at right angles northerly from the northerly line of Shaw Road as shown on said map of Industrial Acres; thence South 87° 23' West 490 feet more or less to the center line of San Bruno Road; thence along the center line of San Bruno Road and San Mateo Avenue South OO 59' East 236.50 feet; thence North 87° 23' East 590 feet more or less to the southwesterly line of Lot i of said Industrial Acres; thence along the southwesterly line of Industrial Acres South 29° 21' 30" East 820 feet more or less to the point of beginning, as said boundaries and limits are shows and set forth in that certain map or plat now on file in the Office of the City Clerk of said City of South San Francisco entitled: "ASSESSMENT DIAGRAMINDUSTRIALACRES ]24- PROVEMENTS, RESOLUTION OF INTENTION NO. 1762". 4. That no portion of such proposed improvement is to be paid from any source other tb~n special assessments upon said benefitted property. 5. The statute under which it is proposed to conduct proceedings for the proposed improvement is the "Improvement Act of 1911" (Statute 1911, page 730, as amended) and it is proposed to pay for said im- provements by special assessment upon adjacent property upon au area basis with bonds to be issued as auth- orized under the Improvement Bond Act of 1915 (Statutes 1915, page 1441).
