HomeMy WebLinkAboutReso 1762-1952NO. 1762 RESOLUTION OF iNTMr~I'£ON RESOLVED, by the City Council of the City of South San Francisco, California, that in its opinion the public interest and convenience require, and that it is the intention of said Council to order, the following improvements to be made in and for said City, to-wit: Section 1. The improvement of Shaw Road designated as follows: The construction of sanitary sewer mains and laterals, storm sewers, pavement of crusher run base with as- phaltic concrete surfacing, Portland cement concrete curbs and gutters, together with all excavation, grading and backfilling necessary therefor, together with lamp holes, man holes and catch basins necessary for the foregoing, together with construction of storm water drain from Shaw Road through easement in Lot No. 5 (assessment number), and all incidental work in, through and upon said Shaw Road in the City of South San Francisco, for the entire length thereof and including all street intersections, terminations and opposite terminations as and to the extent that said streets and avenues appear upon that certain map entitled "INDUSTRIAL ACRES, SOUT~ SAN FRANCISCO, SAN MATE0 COUNTY, CALIFORNIA", which map was filed for record in the office of the County Recorder of San Mateo County on May 23, 1952, in Volume 35 of Official Maps at pages 10 and 11. Section 2. Whenever any public way is herein referred to as running between two public ways, or from or to any public way, the intersections of the public ways referred to are included to the extent that work shall be shown on the plans to be done therein. All of the hereinbefore proposed work or improvement shall include any and all street intersections, terminations and opposite terminations occurring within the limits of the work hereinbefore mentioned, except as otherwise herein noted, and shall be of the forms, sizes, dimensions, depth, in the locations and to the gra~es, as more particularly shown on the plans, profiles, cross-sections and specifications therefor heretofore adopted by the City Council of the City of South San Francisco on the Zad day of June, 1952, and now on file in the office of the City Clerk of said City, and which plans, profiles, cross-sections and specifications are hereby expressly made a part of this Resolution; there is excepted, however, from the abovementioned work any and all thereof which has already been done or laid to official lines and grades as heretofore adopted and established in said plans, profiles, cross-sections and specifications; Section 3. Reference is hereby made to the plans and specifications on file in the office of the City Clerk of the City of South San Francisco and entitled, "STREET IMPRO~, INDUSTRIAL ACRES, APRIL, 1952"- and the same are incorporated herein as if fully set forth herein. Said reference shall be for all purposes of this Resolution of Intention and more particularly for the purpose of describing the area and areas to be improved, the nature and extent and location of such improvements, the extent, boundaries and delineations of the assessment dis- trict to be hereafter formed for the purpose of assessing the same for the cost of the work and improvement herein everywhere referred to. Section 4. Reference is hereby made to the written petition of SOUTH SAN FRANCISCO IAND AND IMPROVEMENT CO., a corporation, AND E. P. KAUFFMANN, for said work and waiver of proceedings under the "Special Assessment In- vestigation, Limitation and Majority Protest Act of 1913, and Resolution of said Council declaring that said Act shall not apply to this proceeding, all on file in the office of the City Clerk of said City. Section 5. Said City Council does hereby determine and declare that said proposed work or improvement is of more than local or ordinary public benefit and will affect and benefit the lauds and district hereinafter re- ferred to which said district is hereby declared to be the district benefitted by said work and improvement and that, therefore, the entire costs and expenses of said work and improvement shall be and are hereby made chargeable against and shall be assessed upon said lauds and district, except as hereinafter expressly provided. Reference is hereby made to the plat or map on file iu the office of the City Clerk of the City of South San Francisco for a complete description of said district, said map or plat being and constituting a portion of the plans and specifications hereinbefore referred to. Said district shall be constituted as aforesaid, saving, excepting and excluding therefrom also, all areas thereon shown to be "excepted and excluded". Said City Council further declares that the total estimated cost of said work and improvement is the sum of $77,110.00 which is the estimated cost of said work and improvement to be assessed against the real property and assessment district proposed to be hereinafter created, as hereinafter mentioned and set forth. Section 6. Reference is hereby made to all resolutions, records and reports on file in the office of the City Clerk of said City, relative to said proposed improvement, all of which may at any t~me be examined at the office of the City Clerk of said City. Ail of the foregoing are hereby incorporated herein, as are also each, all and every the maps, plats, plans, cross-sections and specifications herein everywhere referred to and reference is hereby made to each and all thereof for all purposes connected with this Resolution of Intention, including a description of the work to be done, the streets, places and public ways wherein said work and impr~ovement is to be done and made and for a complete description of the assessment district proposed to be created hereunder and by the terms hereof. Section 7. Notice is hereby given that serial bonds to represent unpaid assessments and to bear interest at the rate of Five per cent (5~) per annum will be issued hereunder in the manner provided by the "Improvement Bond Act of 1915", and the amendments thereto, the last installment of which bonds shall mature fourteen (14) years from the 2nd day of July next succeeding ten (10) months from their date. The South San Francisco Enterprise-Journal, a weekly newspaper printed and circulated in the City of South San Francisco is hereby designated as the newspaper in which this Resolution of Intention shall be published, and the City Clerk is hereby directed to cause this Resolution of Intention to be published by two (2) insertions in the manner and form required by law. The Superintendent of Streets shall cause to be conspicuously posted along the line of said contemplat, ed work or improvement at not more than three hundred (300) feet in distance apart, and along all the open streets and avenues within said district and in front of all property liable to be assessed at not less than three hundred (300) feet in distance apart, but not less than three (3) in all in ~each street in said district, notices of the passage of this Resolution of Intention, in the manner and form required by the "Improvement Act of 1911", and the amendments thereto. Notice is hereby given that on Monday, the 23rd day of June, 1952, at the hour of eight o'clock p. m. in the chamber room of said City Council of the City of South San Francisco at the City Hall on Grand Avenue in said City of South San Francisco, any and all persons having any objections to the proposed work and improvement herein des- cribed, or chaD~e and modification of existing established grades, or having any objections to the proposed grades at which said work and improvement are to be done and made or having any objections to the. proposed district to be assess- ed therefor or the boundaries or extent thereof, may appear before said City Council and show cause why said proposed work or improvement or change and modification of existing grades should not be carried out, in accordance with this Resolution of Intention. Except as hereinbefore provided, all of the herein proposed work and improvement shall be done in pursuance of au Act of the Legislature of the State of California, designated as the "Improvement Act of 1911", approved April 7, 1911, and the amendment thereto. The City Clerk is hereby directed to mail notices of the adoption of the within Resolution of Intention, postage prepaid, to all persons specified and in the time, form and manner provided for, in the "IMPROVEMENT ACT OF 1911", herein everywhere referred to.
