HomeMy WebLinkAboutReso 1784-1952RE$OL[rfION NO. 1784 A RESOLUTION OF THE CITY OF SOUTH SAN FRA~CISCO DFELARING THAT INVEST- IGATION PRO'SEEDINGS ARE NOT REQUIRED IN CONNECTION ~'fiTH THE IMPROVE- U2~T OF THIRD LA~E FRO~( EUC~LYPTUS AVEN~E TO A POINT %8 FEET WEST OF LAUREl, AVENUE. RESOLVED by the City Council of the City Of South San Francisco, California, that: ~HERE~S it is the intention of said City Council to make the following improvements in and for said city, to-wit: The improvement of Third Lane from Eucalyptus Avenueto a point 58 feet west of Laurel Avenue, as sho~n on that certain map entitled: "THIRD LANE INPROV-F~E~T · PLAN ~AR~ PROFILE", by excavating and grading and constructing strom drains, gutters, and pave- ment ~long Third Lane from said Eucalyptus Avenue t.o a point 58 Feet west of Laurel Avenue,~~ and a storm drain in Laurel Avenue, and the performing of all work auxiliary to the foregoing ~ich may be necessary to carry out the same, and ~'~qEREAS the owners of more than 85~ of all the property ~itnin the proposed assess- ment district have signed and filed with this City Council a written petition for the doing of said work and waiver of proceedings under the "Special Assessment, Investigation, Ldmita- tion and Majority Protest Act of 1931", NO~J, TH~EFORE, IT IS ORD~CD, FOIPJD, A~D DETE'~I~I~{ED AS FOLLO~/S: 1. That none of the owners of property within the area of the proposed assessment district demanded the making of the investigation proceedings provided in the Special Assess- mer. t Investigation, Limitation and ~ajority Protest Act of 1931 for the work and improvement herein provided to be don,~. 2. That said city council proceed ,mder the provisions of the Improvement Act of 1911 and the Improvement Bond Act of 1915 to carry through the contemplated proceedings without any further restrictions whatsoever by reason of the terms and provisions of said "Special Assessment Investigation, Limitation and Majority Protest Act of 1931. 3. The bounua~-Xe~ o~ zme lands and of the ~istricts of lands proposed to be specially assessed to pay the cost and expenses of such work and proposed improvement are generally de- scribed as follows, to-wit: All that certain real property situate in the City of South San Francisco, County of San Francisco, County of San Mateo, State of California, and more particularly described as follows: Beginning at the southeasterly corner of Block78, as shown upon t~at certain map entitled "South San Fran- cisco, San Mateo County, California, Plat No. l", which map was filed i~ bhe office of the Co, mty Recorder of the Couhty of San Mateo, California, on March l, 1892, and re- .?corded in Map Book No.2 at page 52; thence westerly along the southerly line of said Block 78 to the southwesterly corner of Lot 16;thence northerly along the westerly line of Lot 16 and its projection northerly to the northerly line of said block 78; thence easterly along said north- erly line to the northeasterly corner of block 78: theace southerly along the easterly line of said block78 to the point of beginning. Excepting all public streets, avenues, thoroughfares, courts, lanes and alleys included and contained in said district. All of said bo~mdaries and limits are shown and set forth in that certain ~map or plat now on file in the office of the city clerk of said City of South San Francisco en- titled: "THIRD LANE IMPROVEMENT AND PROFILE". &. That no protion of such proposed improvement is to be paid from any source other than special assessments upon said benefitted property. 5. The statute under which it is proposed to conduct proceedings for the pro- posed improvement is the "Improvement Act of 1911" ( Statute 1911, page 730, as amended) and it is proposed to pay for said improvements by special assessment upon adJacen~ pro- perty upon and area basis with bonds to be issued as authorized under the Improvement Bond Act of 1915 ( Statutes 1915, page lgA1). ***** ** *** ** . . *** I hereby certify that the foregoing resolution was duly end re$~larly adopted by the City Council of the City of South San Francis~,o at a regular meeting the~of held on the 10th day of July, 1952, by the following vote: Ayes, Councilmen John~'Noonan, Adolph Sani, Emilio Cortesi, Joseph Bracco, Telford Smith Noes, Councilmen None Absent, Councilmen None Attest: Arthur A.
