HomeMy WebLinkAboutReso 1821-1952 RESOLUTION NO. 1821 DECLARING THAT INVESTIGATION PROCEEDINGS ARE NOT XEQUIRED IN NORTHWEST DRAINAGE DISTRICT PROCEEDINGS. 17 RESOLVED, by the City Council of the City of South San Francisco, California, that: THEREAS, it is the intention of said City Co~mcil to make the following improvements in and for said city, to-wit: the improvement of the Northwest Drairage District by the fur- nishing of all material, l~bor, equipment, and supplies, and the doinf e~ all' work necessary for the construction and installation of a storm drainage system, including the laying and installing of concrete pipe, corrugated arch storm drains, catch basins, inlet and outlet structures, ~11 excavation and backfill work and the repaying of streets, and the irstalling of any and all necessary a ~purtena~ces, and the performance of al]. incidental work necessary for such storm drainage system, which is to be located along Gran~ Avenue, Oak Avenue, along an easement between Oak Avenue and Chestnut Avenue, along Old Mission Road, Ever~.reen Drive and Crestwood Drive, and along an easement northerly from Crestwood Drive~, t.o,'!a location near its northwesterly terminus, all of which streetS'and easements are situate within the confines of the City of South San Francisco, and the performing of all work auxiliary to the foregoing v~ich may be necessary to carry out the ~'~EREAS, the o~ners of more than 60% of all the property within the proposed assessment district have signed and filed with this Council a written petition for the doing of said work and waiv, er of proceedings under the "Special Assessment, Investigation, Limitation and Majority Protest Ave of 1931", NO'~f, THEREFORE, IT !e~ ORDERED, FOUND AND DP. mE,~%~T~n~.,:.~,,~.~.~, AS FOLLOJS'. i. That none of the property owners of pr.oDerty within the area of the proposed assessment district demanded the m~king of the investigation proceedings provided in the "Special Assess- ment Investigation, Limitation and Majority Protest Act of-1931" for the work and improvement herein provided to be done. 2. That said Ucuncil proceed under the provisions of the Improvement Act of 1911 and the Improvement Bond Act of !915!~to carry through the contemplated proceedings without any further restrictions whatsoever by reason of the terms and provisions of said "Special Assessment In- vestigation, Limitation and Majority Protest Act of 1931". 3. The boundaries of the lands and of the districts of lands proposed to be specially assessed to pay the cost and expenses of such work and proposed ~m%provement are generally described as follows, to-wit: All that certain real property situate in the City of South San Francisco, County of San Mateo, State of California, to-wit: BEGINNING at an ang~ point in the corporate limits boundary of the City of South San Francisco, said point lying also on the corporate limits boundary for ~he Town oi' Colma, and also being the northerly corner of the 13,215 acre parcel of land conveyed to Antonio Scopesi and ~gife by deed recorded January 9, 1936 in Book 673 of Official Records of San Mateo County at Page (71767C); thence along said corporate limits boundary of the City of South San Francisco south- easterly 950 feet, more or less, and northeasterly 100 feet, more or less, to the southwesterly Line of'.~Hilt~ide B~levard; thence continuing along said corporate limits line of the City of South San Francisco southeasterly 1800 feet, more or less, to the granite monument L-5 of the Ilar Survey; thence continuing along said corporate limits line South 8~° 28' dO" East 758.11 feet, more or less, to a granite monument and northeasterly 600 feet, more or less, to the north-westerly corner of Sterling Terrace No. 5 as shown upon that certain map recorded in Book 31 of Maps at Page 2A, San Mateo County Eecords; thence along the westerly boundary of said Sterling Terrace No. 5 South 30020' 20" East 708.01 I'eet to the southwesterly corner of said Sterling Terrace No. 5; thence southwesterly 670I'eet, more or less, to the easterly corner to that certain 2.006 acre parcel of land belonging to the California Water Service Company; thence along the south- easterly line of said 2.006 acre parcel of lana South Al° 3d' 2A" West 300 feet; thence south- westerly A70 feet, more or less, to the northwesterly corner of that certain3.225 acre parcel of land now, or formerly, owned by A. M. Gui~O? thence South 15° 33' 'Nest 1037.71 feet, more or less, to the southerly li~e of Tamarack Lane as shown upon that certain map entitled "South San Francisco Plat No. l", recorded in Book 2 of Maps at PaKe 52, San Mateo County Records; thence along said southerly ldr~e of Tamarack Lane North 7A°27, West 100 feet, more or less, to the westerly line of LaurelAvenue; thence alongsaid westerly line of Laurel Avenue South 15°33' West 500, more or less, to the northerly lineof Grand Avenue; thence along said northerly lmne of Grand Avenue North 7~° 27' West ~00 feet to the easterly line of Chestnut Avenue; thence southerly and southwesterly along said easterly line of Chestnut Avenue 1050 I'eet, more or less, to a point lying 3.50 feet northeasterly at right angles fromthe northeastsrly line of the Colma Creek Drainage C~nal Eight-of Way; thence northwesterly along a line lying parallel to and 350 feet at right angles northeasterly fona said Right-of-Way line 670 feet, more or less, to the southeasterly ldne oi' Oak Avenue; thence southwesterly, along said southeasterly line of Oak Avenue and its prolongation southwesterly, ~60 feet, more or less, to the southwesterly line of Mission Road and the corporate limits line of the City of South San Francisco; thence northwesterly, along said southwesterly line of Mission goad and corporate limitsline, &,OAO feet, more or less; thence continuing along said corporate limits line but leaving the south- westerly line of Mission ~oad, morthwesterly 3270 I'eet, more or less, to the point of beginning, as said boundaries and limits are shown ~nd set forth in that certain map or plat now on file in the Office of the City Clerk of said City of South San Francisco entitled:" ~. The statute under which it is proposed to conduct proceedings for the proposed improve- ment is the "Improvement Act of 1911" (Statute 1911, page 730 , as ~mended ) and it is proposed to Day for said improvements by special ~ssessment upon adjacent property upon an area basis with bonds to be issued as authorized under the ImproVement Bond Act of 1915 (Statutes 1915, p~ge l~A1).
