HomeMy WebLinkAboutReso 1824-1952RESOLUTION NO. 182& RESOLUTION OF INTENTION RESOLVED, by the City Council of the City of South San Francisco, California, and said City Council doe. s hereby find that, in its opinion the public interest andconvenience will not be served by allowing the property owners to take the contract for the hereinafter described improvements to be made in and for said City, and it is furthor RESOLVED, by the City Council of the City of South San Francisco, California, that in its opinion the public interest and convenience required, and that it is the intention o£ said Council to order, the follow- ing improvements to be made in and f~r said City, t~-wit: Section 1. The improvement of the Northwest Drainage District designated as follows: The constructio.n, and installation of a storm drainage system, including the laying and installing of concrete pipe, corrugated arch storm drains, catc~ basins, inlet and outlet str~ctures, all excavation and backfill work and the repaying of streets, and the installing of any and all necessary appurtenances, and. the performance of all incidental work necessary for such storm dra~.nage system, which is to be located along Grand Avenue, Oak Aven~ue, along an easement between Oak Avenue and Chestnut Avenue, along Old Mission Road, Evergreen Drive and Crestwood Drive, and along an easement northerly from Crest~ood Drive to a location near its northwesterly terminus, all of ~hich streets and easements are situate within the confines of the City of South San F~nc~co, and the performing of all work a,~xiliary to the foregoing which may be necessary t~ carry out the same. Ail of the hereinbefore proposed work or improvement shsll include any and all street ~ntersections, terminations and opposite terminations occurring within the limits o~' the work hereinbei'ore mentioned. Ail the work provided for shall be done in~cordance with the special plans, pro~'iles, and specifications for said work, a nd at the locations and to the grades shown upon said plans, which plans, profiles, and speciI'ications were hereto fore adopted by said city~ council on the 6th day of October, 1952, and are no, on file in the office of the city clerk of said city. Section 2. ~henever any public way is herein referred to as ~unn~ng betwaen two public ways, or from or to any public way, the intersections of the ~ublic ways roi'erred to ~ re included te the exten~ that work shall be shown on the plans ~e beedone therein. Ail of the hereinbefore proposed work or improvement shall be of the forms, sizes, dimensions, depth, in the locations and to the grades, as more particularly shown on the plans, profiles, cross-sections and specifications therefor heretofore adopted by the City Council of the City of South San Francisco on the 6th day of October, 1952, and now on file in the office of the city Clerk of said City, and which plans, profiles, cross sections and specifications are hereby expressly made a part of this Resolution; there is excepted, however, from the abovementioned work any and all there- of which has already been done or laid to official lines and grades as heretofore adopted and established in said plans, profiles, cross-sections and specifications; Section 3. Reference is hereby made to said plans and specifications now on file in the office of the City Clerk of the City of South San Francisco and entitled: Northwest Drainage District Storm Drain System" and the same are incorporated herein as if fully set forth herein. Said reference shall be for all purposes of this Resolution of Intention and more particularly for the purpose of describing the area andareas to be improved, the nature and extent and location of such improvements, the extent, boundaries and delin~ations of t he assessment district to be hereafter formed for the purpose of assessing~he same for the cost of the work and improvement herein everywhere referred to. Section &. Reference is hereby made to the written petition of more than 60% of all the property ~wners within the proposed assessment district for saidwork and waiver of proceedings under the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931, and Resolution of said Councilde- claring that said Act shall not apply to this proceeding, all on file in the office of the City Ulerk of ~aid City. Section 5. Said City Council does hereby determine and declare that said proposed work or improvement is of more than local or ordinary p~lic benefit-and will affect and benefit the lands and district herein- after referred to which said district is hereby declared to be the district benefited by said work and im- provement and that, therefore, the .entire costs and expenses of said work and improvement shall be and are hereb~.,made chargeable agairst and shall be assessed upon said lands and district, except as hereinafter expressly provided. Reference is hereby'made to the plat or map on file in the office of the City Clerk of the City of South San Francisco for a complete description of said district, said map or plat being and constituting a portion of the plans and specifications hereinbefore referred to. Said district shall be con- stituted as aforesaid, saving, excepting and excluding therefrom, also, all areas thereon shown to be "except- ed and excluded". Said City Council further dedlares that the tot~l estimated cost of said work and im- provement is the sum of $2&5,000.00 which is the estimated cost of said work and improvement to be assessed against the real property and assessment district proposed to be hereinafter created, as hereinafter mentioned and set forth. Section 6. Reference is hereby made to all resolutions, records and rep~ots on file in the office of the City Clerk of said City, relative to said proposed improvement, all of which may at a~¥ time be exmained at the office of the City Clerk of said City. All of the foregoing are hereby incorporated here- in, as are also each, all and every the maps, plats, plans, cross-sections and specifications herein every- where referred to and reference is hereby made to each andall thereof for all purposes connected with this Resolution of Intention, including a description of the work to be done, the streets, places and public ways wherein said work and improvement is to be done and made and for a complete description of the assess- ment district proposed to be created hereunder and by the terms hereof. Section 7. Notice is hereby given that Serial bonds to represent unpaid assessments and to bear interest at the rate of five per cent(5%)per annum will be issued hereunder in the manner provide~ by the "Improvement Bond Act of 1915 ", and the amendments thereto, the last installment of which bonds shall mature fourteen (1~) years form the 2nd day of July next succeeding ten (10) months from their date. The South San Francisco Enterprise-Journal, weekly newspaper printed and circulated indue City of Smith ~an Francisco is hereby designated as the newspaper in which this Resolution of Intention shall be published,and the City Clerk is hereby directed to cause this Resolution of Intention to be published by two(2)insertions in the mar~er and form required by law. The Superintendent of Streets shall cause to be conspicuously posted along the line of s~id contemplated work or improvement at not more than three hundred (300) feet in distance apart, and along all the open streets and aven~s ~thin said district and in fromt of ~ll oroperty liable to be assessed at not less than three hundred (300) feet in distance apart, but not less than three (3) in all in each street in said district, notices of the passage of this Resolution of Intention, in the manner, and form required by the "Improvement Act of 1911", and the amendments thereto. Notice is hereb~ given that on Wednesday, the 22nd day of October', 1952, at the hour of eight o'clock P.M. of said day, in the chamber room of said City Council of the City or,South San Fran.~isco at the City Hall on Grand Avenue in said City of South San Francisco, any and all persons having any objections to the proposed work and improvement herein described, or change and modification of existing established grades, or having any objections to the proposed Erades at which said work and improvement are to be done and made or having any objections to the proposed district to be assessed therefor or the boundaries or extenb thereof, may appear before said City Council and show c~use why ssid proposed work or improvement or change and modification of existing established grades should not be carried out, in a,,ordance with this Resolution of Intention. Except as hereinbefore provided, all of the ~erein proposed work and improvement shall be done in pur- suance of an Act of the Legislature of the State of California, designated as the "Improvement Act of 1911", approved April 7, 1911, and the amendment~ thereto. The City Olerk is hereby directed to ~il notices of the adoption of the within Resolution of Intention , postage prepaid, to all persons ~pecified and in the time, form and manner provided for, in the "I}~HOVE~ENT ACT OF 1911", herein everywhere referred to.
