HomeMy WebLinkAboutReso 1876-1953RESOLUTION NO. 1876 COND~2~NATION RESOLUTION A RESOLUTION DECLARING THE NECESSITY OF ACQUIRING CERTAIN PROP~TY IN THE COUNTY OF SAN MATEO FOR THE PURPOSE OF LAYING, INSTALLING, AND MAINTAINING A SANITARY SNgER TO SERVE THE P~.RK HAVEN SUBDIVISION IN THE CITY OF So~rH SAN RRANCISCO. RESOLVED by the City Council of the City of South San Francisco that said City Council finds and determines and hereby declares that: Public interest and necessity require the construction of a sanitary sewer in and through the land next herei described, and the construction of said sanitary se~er is necessary to protect the public health, safety, and general welfare of people about to reside within the City of South San Francisco, to-wit, within the Park Haven Subdivision of said city. RESOLVED FURTHER that said City of South San Francisco acquire an easement in the real property next hereinafter described for the purpose of constructing and maintaining a sanitary sewer therein, by con- detonation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the S~ate of California relating to eminent domain and prepare and prosecute, in the name of the people of the State of California, such proceeding or proceedings in the Superior Court of the State of California, in and for the County of San Mateo, as are necessary for such acquisition; the land last hereinbefore re- ferred to consists of all those certain tracts or parcels of land situate in the County of San Mateo, State of California, and more particularly described as follows: BEGINNING at a point in the southeasterly terminus of Fairway Drive as shown upon the map entitled "Parkhaven", recorded in Book 36 of mapS' at pages l0 and ll San Marco County records, which point bears North 55° 42' lC" East 1.97 feet from the center line of said Fairway Drive ; thence South 52° 40' 30" East 268.53 feet to a point in the southeasterly line of the property described in the deed from Calif- ornia Pacific Title Insurance Company to Ferdinando and Colic Martorella recorded in Book 1334 of Offi- cial Records of San Narco Cc~nty at page 186(56824G), which point bears South 28° 19' 40" West (given as South 27° ~5' West in said deed) 5.07 feet from an angle point in said southeasterly line, The City Attorney is hereby authorized and directed to make application to the Board of Supervisors of the County of San Mateo for permission to institute condem~ation proceedings in the name of the City of South San Francisco for the purpose of acquiring said sanitary sewer easement. Further, the City Attorney is hereby authorized and directed to prepare and file a complaint in eminent dommin for the pur- pose of acquiring the land hereinbefore described, and to do all such things as may be necessary to carry into effect the purposes of this resolution. I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Prancisco, this 6th day of April, 1953, by the following vote: AYES, Councilmen John Noonan, Adolph Sani, Emilio Cortesi, Joseph Bracco, Telford Smith NOES, Councilmen None ABSENT, Councilmen None ATTEST: Arthur A.
