HomeMy WebLinkAboutReso 1880-1953RESOLUTION NO. 1880 A RtBOLUTION OF THE CITY OF SOUTH SAN FR~.!CISCO DECLARING THaT I~FSTIGATION PROCEEDINGS ARE NOT REQUIRED IN CONNECTION WITH THE IMPROVEMENT OF SECOND L~E FROM CHw~STNUT AV~ETO EUCALYPTUS AVENUE. R~OLVED by the City Council of the City of South San Francisco, California, that: WHEREAS it is the intention of said City Council to make the following improvements in and, for said city, to-wit: The improvement of Second Lane from Chestnut Avenue to Eacalyptus Avenue, as shown on that certain map entitled: "STREET IMPROV~TS z SECOND LANE", by excavating and grading and constructing storm drai~m, gutters, catchbasins, manholes, and pavenent along Second Lane from said Chestnut Avenue to said Eucalyptus Avenue, and the performing of all work auxiliary to the foregoing which may be necessary to carry, out the same, and '~EREAS the owners of more than 60% of all the property withln the proposed assessment district have signed and filed with this City Council a written petition for the doing of said work and waiver of proceedings under the "Special Assessment, Investigation, Limitation and Majority Protest Act of 1931", NOg, THFREFORE, IT IS ORD~ED, FOUND, AND DETERMINED AS FOLLOw{S: 1. That non~ of the owners of property within the area of the proposed assessment district de- manded the making of the investigation proceedings provided in the Special Assessment Investigation, Limitation ~nd Majority Protest Act of 1931 for the work and improvement herein provided to be done. 2. That said City Council proceed under the provisions of the Improvement Act of 1911 and the Improvement Bond Act of 1915 to carry through the contemplated proceedings without any further restrictions whatsoever by reason of the terms and provisions of said "Special Assessment Investigation, Limitation and MaJority Protest Act of 1931". 3. The boundaries of the lands and of the districts of lands proposed to be specially assessed to pay the cost and expenses of such work and proposed improvement are generally described as follows, to- wit: All that ~ertain real property situate in the City of South San Francisco, County of San Mateo, State of California, ~nd more particularly described as follows: Beginning at the northeasterly corner of Lot ~O, Block 79, as shown upon that certain map entitled "South San Francisco Plat No. I" recorded in Volume 2 of Maps at Page 52, San ~teo County California records; thence South 7~°~27, East 30 feet to the center line of Eucalyptus Avenue; thence along sa~d ~center line Oouth 15o 33, West 335 feet to the center line of COmmercial .Ave~Ue~ ~hence .North .?~? .~.7~ ~t :~30 f~et; ~t.h~ .ema~ ;N~15~,~.33~ E~t ~t357~eet; ~hence North ?~°'27'::'~st ~20. feet[ th,once Sou~hr $~9~3~W'~st I3~-~e~;~: $~ea~eoNo~h ?&~7,iWest ?6~t~eet; thence feet; thence North 7~° 27' West ~0 feet to the intersection of the center lines of Commercial Avenue and Chestnut Avenue; thence along the cent er line of ~estnut Avenue North 15° 33' East 235 feet; thence South 7~° 2?' East 160 feet; thence North 15° 33' East 100 feet to the southerly line of Baden Avenue; thence along said southerly line South 72° 27' East 880 feet to the point of beginning. Excepting all public streets~ avenues, thoroughfares, courts, lanes, and alleys i~cluded and contained in said district. All of said boundaries and ltmtts are shown and set forth in that certain map or plat now on file in the office of the city clerk of said City of South San Francisco entitled: "STREET IMPROVPMEqTS - SECOND LANE". 2. That no portion of such proposed improvement is to be paid from any source other than special assessments upon said benefited property. 5. The statute under which it is proposed to conduct proceedings for the proposed improvement is the "Improvement Act of 1911"(Statute 1911, page 730, as amended) and it is proposed to pay for said improvements by special assessment upon adjacent property upon an area basis with bonds to be issued as authorized under the Improvement Bond Act of 1915 (Statutes 1915, page 1441). I hereby certify that the foregoing resolution was duly and regularly adopted by the City Council of the City of South San Francisco at a regular meeting thereof held on the 2th day of M my, 1953, by the following vote: AYES, Councilmen John Noonan, Adolph Sani, ~nilio Cortesi, Joseph Bracco, Telford Smith NOES, Councilmen None ABSENT, Councilmen None ATTEST: Arthur A.
