HomeMy WebLinkAboutReso 1897-1953CONDemNaTION R~0LUTION A RESOLUTION OF THE CITY COUNCIL OF T}~E CITY OF SOUTH SAN FRANCISCO DECLARING THE NECESSITY TO CONDEMN CER- TAIN L~NDS FOR THE PURPOSES OF CONSTRUCTING AND MAIN- ~AtNIN~ A BUB~t6 ~%~%~ AND ~HSHOUGHFARE IN SAID CITY AND DIRECTING THE CITY ATTORNEY TO COF~{~NCE AND PRO- SECUTE COND~ATION PROCEEDINGS. City Council finds and determines and hereby declares that; Public interest and necessity require the construction and maintenance of a public street and thoroughfare across,and upon the land next hereinafter described. RESOLVED FURTHE~ that said City of South San Francisco acquire the real property next hereinafter described by condemnation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain and prepare and prosecute in the name of the People of the State of C~lifornia such proceeding or ~roceedings in the Superior Court of the State of California, in and for the ~ounty of San Mateo, as are necessary for such acquisition. The land last hereinbefore referred to is all that certain tract or p~rcel of land situate in the City of South San Francisco, County of San Mateo, State of California, am~ part- icularlydescribed in "EXHIBIT A" attmched hereto and made a p~rt hereof by this reference Just as though fully set forth at t his point. The City attorney is hereby authorized and directed to prepare and file a complaint in eminent domain for the purpose of acquiring the land herein- before described, ar~ to do all such things as may be necessary to carry into effect the purposes of this resolution. Resolution No. 1633, adopted by this City Council on the 5th day of February, 1951, is hereby vacated ~nd set aside. I hereby certify that the foregoing resolution was regularly introduced a~ adopted by the City Council of the City of South San Francisco, at a regular meeting of said Citv Council, this 1st day of June, 1953, by the following vote: AYES: C~tu~cilmen John Noonan, Adolph Sani, ~,~lio Cortesi, Joseph Bracco, Telford Smith NO~o: Councilmen None ABSENT: Councilm~ None ATT~T: Arthur A. Rodondi City Clerk EXHIBIT "A" All that real property situate in the City of South San Francisco, County of San Mateo, State of California, described as follows: BEGINNING at the westerly corner of that certain tract of land conveyed to Tanforan Company, Ltd., a Corporation, by Deed recorded in Book 1279 of Official Records of San Mateo County at Page 4/4 (96R2G); thence along the easterly line of E1 Camino Real North 30°41, 08" hTest 140.99 feet; thence southeasterly along a curve to the left ~ith a raduis of 25 feet tangent to the preceding course, an arc distance of 39.12 feet, thence North 59° 05' 37" East 4.39 feet; thence northeasterly along a curve to the left with a radius of 610 feet tangent to the preceding co,~rse, an arc distance of 292.87 feet; thence North 3l° 35' 07" East 272.49 feet; thence northeasterly along a curve to the right with a radius of 2040 feet tnagent to the preceding course, an arc distance of 197.66 feet; thence North 37° 08' 12'~ Fast 107.84 feet to a point in the westerly line of said tract of land conveyed to Tanforan Company, Ltd. (said point also being the southeasterly corner of Lot 16, Block 5, as shown upon that certain map entitled "Francisco Terrace", recorded in Boom 29~of ~ps at Page 18, San Mateo County Records); thence along said westerly line South 31° 35' 07" ~est 938.99 feet to the point of begin- ning, containing 0.61 acres more or less.
