HomeMy WebLinkAboutReso 1935-1953RESOLUTION NO. 1935 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE CITY OF SOUTH SAN FRANCISCO ORDERING THE SALE OR TRANSFER OF A PORTION OF HOLLY AVE- NUE, TO THE STONESON DEVELOP~ENT CORPORATION AND PACIFIC COAST CONSTRUCTION COMPANY IN EXCHA~'~GE FOR CERTAIN ~EAL PROPERTY OWNED BY THE STONESON DEVELOPMENT DORPORATION AND FOR OTHER GOOD AND, VAL- UABLE CONSIDERATION. WHEREAS on the~5th day of October, 1953, a public hearing was held pursuant to the provisions of Title 4, Division 3, Part 2, Chapter 5, Artible 3 of the Government Code of the S~ate of California, at which all persons having any ob- jections to the sale or t~ansfer of the publicly owned real property of the City of South San, Francisco comprising ar nortion Holly Avenue, public street in said city, which portion is hereinafter more par~ion is hereinafter more particularly described, were offered an opportunity to be heard; and WHEREAS no one did appear to object to said nroposed sale or transfer, NOW, THEREFORE, BE IT RESOLVED that said City Council does hereby order that said publicly owned Dronerty of the City of South San Francisco be sold or transfe~re'd to The S~oneson Development Corporation and the Pacific Coast Construction Company. Said real property to be sold or transferred is particularly described as follows: All that certain real property situate in t~he City of South San Francisco, County of San. Mateo, State of California, and particularly described as follows: Being a portion of-that certain 50 foot read conveyed by F. R. Carton to the County of San Mateo dated and recorded May 19, 1887 in Book 42 of Deeds at page 195 of San Mateo County, more particularly described as follows: Beginning at a point on the northwesterly line of said 50 foot road said point being distant South ~6°'52' 20" East a distance of 13.80 feet and North ~0° 10' East a distance of 259.24 feet from the most easterly corner of Lot 8 Block 3 as shown on a map entitled "WESTVIEW TERRACE SOUTH S. AN FRA~CISCQ SA.N M,J, TEO COUNTY_ CALIFORNIA,~, recorded at Map Book 36 at pa~e 36 San Mateo ~oun~y ~ecoras. 'rnenCe~rom sala point of beginning along a said north~sterly line North 40o 10' East a dis- tance Ofo633.62 feet to the northeasterly termination of said road; thence South49 44' ll" '~est a distance of 50 feet to the southeasterly line of said road; thence South 40° 10' West a distance of 921.10 feet to a ~oint; thence north- e~terly on the arc of a curve to the left, said curve having a radiu~ of 1040. O0 feet, a central angle of 5° 01' 42" and a center which bears North 55° 27' 14" West from the last mentioned point, a distance of 91.27 feet; thence North 29° 31' 04~ East a distance of 200.?0 feet to the point of beginning, containing 0.882 acres. BE IT FURTHER RESOLVED that said Ci6y Council does hereby determine that public interest, convenience, and necessity requir~ the sale or transfer of said oublictyy owned real property. The consideration to be given by said Pacific Coast Constructio~ Company and The Stoneson Development Corporation for said real property consists of the transfer of certain real property to the City of South San Francisco for the re- location of Holly Avenue, which transfer was completed bygrant deed dated August 28, 1953 and executed in favor of said City of South San Francisco by The Stoneson DeveIopment Corporation. Said deed was accepted by the City of South San Francisco by resolution dated September 8, 1953. Reference is here made to said deed for a p~rticular description of said real property. BE IT ALSO RESOLVED that said city execute its deed ~ransferring to said Pacific Coast Construction Company and The Stoneson Development Corporation all the real property hereinbefore described. In this connection, the mayor and the city clerk of said city are hereby authorized to execute on behalf of said city a deed conveying to daid corporations said real property, and the city clerk is also hereby directed to affix to said deed the corporate seal of said city. Further, the city clerk is instructed to cause said deed, together with a certified copy of this resolution, to be recorded in the office of the Recorder of San ~teo County. I hereby certify that the foregoing resolution was regularly intoduced and and adooted by the City Council of the City of SOuth S~n Francisco this 5th day of October, 1953, by the following vote: Ayes, Councilmen John Noonan, Adolph Sani, Emilio Cortesi, Joseph Bracco, Telford Smith.
