HomeMy WebLinkAboutReso 1951-1953970 RESOLUTION NO. 1951 A RESOLUTION OF THE CITY COUNCIL OF TiiE CITY OF SOUTH S.,tl'i FR.~LCISCO AUTHORIZING THE EXECUTION OF AN AGREEI,iENT BETWEEN SAID CITv, ON THE O~E ~AND, AND '~' v ~Hn SO~THEid~ PACIFIC RAiLt~OAD CO~.'iPANY AND THE SOUTHEH~',~ PACIFIC COI~H~ANY, ON 'J]JE OTHER HAND, PROVIDING FOR THE GRANTING TO SAID CITY OF ~oE~l~l~ ACROSS THE ~t~OP~RT~ SAID COiiPANIES SUBJECT TO CERTAIN COI'.~DITtONS. W't{EtiEAS the So~tthern Pacific Railroad Company and the Southern Pacific Company (hereinufter collectively referred to as "Railroad") have, in restoonse to a request made by the Cit:r of South San ~"rancisco (designated hereinafter as "City"), agreed to convey to said citF .aneasement across Railroad's right of way at the intersection thereof with Spruce Avenue ir~nediate~y west of Railroad Avenue in said 6ity of South San Francisco for the p~.rpose of constructing, maintaining, and locatihg thereon of a oublic street, generally referred to as the extension of Spruce Avenue, which convey- ance is to be n~ade subject to certain conditions, as set forth in that certain form of a~eeme~t submitted by Hailroad to city, which is entitled "Street or Highway In- denture" ant1 is dated the 16th day of ~ovember, 1955; and M~EREAS said agreement is in the usual~or standard form and is in all respects fair and equitable to the City of South San Francisco. NOb', THEREFOkE, BE I'f RESOLVED by the Cits~ Council of the City of South San Fran- cisco that said agreement be, and the same hereby is approved and acceoted.
