HomeMy WebLinkAboutReso 2004-1954RESOLUTION NO. 2004 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AUTHORIZING THE EXECUTION OF AN INDENTURE AND DEED OF RELEASE BETWEEN THE UNITED STATES OF AMERICA, AS GRANTOR, AND SAID CITY OF SOUTH SAN FRANCISCO, AS GRANTEE, AND DIRECTING THE PAYMENT OF CONSIDERATION THEREFOR. WHEREAS, under a quitclaim deed dated November 23, 1949, the City of South San Francisco acquired from United States of America, subject to certain conditions and limitations, title, to certain property situate in said City of South San Francisco, comprising a portion of the land known as "Belair Shipyard Property"', and being the site of the municipal sewage treatment plant of said City of South San Francisco; and WHEREAS the grantor in said quitclaim deeR, namely, United States of America, is now prepared to release to said City of South San Francisco said property free and clear of said conditions and limitations and, in effect, to give to said City of South San Francisco a f~e simple title to said real property; and WHEREAS the City Council of said City of South San Francisco is desirous of obtaining, on behalf of said city, fee simple title to said prooerty for the reason that said City Council does verily believe acquisition of such title to be in the best interests of said city and of the property owners and people residing therein; and WHEREAS United States of America, as grantor, .is requestinE that the sum of FIFTY-TWO THOUSAND TWO HUNDRED THIRTY-SEVEN and 50/100 DOLLARS [$52,237.50) be paid to it as consideration for the conveyance hereinbefore mentioned, and whereas said sum is believed to be fair and reasonable, NOW, THEREFORE, BE IT RESOLVED by said City Council that, for and in consideration of the premises-, said City Council does hereby find and determine that it is in the best interests of the City of South San Francisco and of the nroperty owners and people re- siding therein for said city to acquire a fee simple title to the property hereinbefore mention, ed and to pay therefor the sum of FIFTY-TWO THOUSAND TWO HUNDRED THIRTY-SEVEN and 50/100 DOLLARB ($52,237,50). BE IT FURTHER RESOLVED by said City Council that the mayor and city clerk of said city be, and they hereby are, authorized to execute said indenture and deed of release on behalf of said city, and said city clerk is hereby instructed to affix thereto the corporate seal of said city. Further, said mayor and city clerk are here- by authorized and instructed to draw a warrant upon the City Treasurer of the City of South San Francisco in said sum of FIFTY-TWO THOUSAND TWO HUNDRED THIRTY-SEVEN and 50/100 DOLLARS ($52,237,50), said warrant to be made payaSle to the order of, and to be delivered to, United States of America. I hereby certify that the foregoing resolution was regularly int~educed and and adopted b~T the City Council of the City of South San Francisco this 21st day of April, 195&, by the following vote: Ayes, Councilmen John Noonan, Francis Lucchio, Telford Smith, Emilio Cortesi, George Bosworth.
