R,[NDLETT i.~ITH RESPECT TO ENGINEERING SERVICES TO BE RENDERED FOR THE INDUSTRIAL SFifERS AND PUMP- ING S'?~TIONS ,'\SSESSHENT DISTRICT, hFITH THE ~lgRCH 6, 1950 CONTRACT TO BE CANCELLED. N{EREAS the City of South San Fr::~ncisco did', by its Resolution No. 1521, passed and adopted on the 6th day'of },{~rch, 1950, enter into a contract employ- ing Charles E. R~.ndlett for the purpose of p~'rforming all engineering services necessary for the construction and installation of a sewage collection system in the industrial area E~st of Bayshore Freeway in said City, including 'the providing of all inspection services; and ~]{ERE~%S it is provided in said Resolution, among other things, (the terms of which w~=re agreed to ~ said Charles E. Randlett) that said Charles E. Randlett shall rei~ihurse said City for certain, moneys paid to one John E. Estes, a duly li- censed ?~nd registered civil engineer :~nd the predecessor of said Charles E. Randlett as City Engineer of s~id C~ty, for t].e prep ~'~t ion of drip. wings, plans, and preliminary studins for said industrial collection, systen; and 7HERE..~S said Charles E. Randlett h~'~s admitted t?:-~t he has made use of said dr~.~i?Ss, ?l.~-!}'~.s, ~nd prclinim,,ry studies; and' ?IHEREAS a dispute has arisen as to just how much money said Charles E. Randlett shouid reimburse City for staid dr'!~.'.ri~s~,~ plans~ and preliminary studies~ and in consequence t}~ereof said Ch,%rles E. Randlett h~s offered to enter~into a new agree- ment with said City~ the saute providing fop a very substanti'll saving in ensineering costs nd fees; and ?~HEREAS ~he City Co,moil of said City deems it to be in the best i~ePest and welfare of not only said City but also of the o~ers of property lying within the aforementioned assessment district~ they having heretofore agreed ~o the employment of said Charles E. Randlett as engineer for said distrio~ on the same basis as spec- ified in the aforementioned reso~io~ No. 1521~ a~d whereas said City Ooenoil has so found and determined; and WHEREAS, in addition to the making of a very substantial saving in engineering fees and costs should the aforementioned revised contract be entered into, said City proposes to make further savings to the owners of property in. said district by per- forming at cost all the inspection services required, and to give said assessment district the benefit of the report prepared in the year 19~8 by the engineering firm of Brown & Caldwell at the behest of said John E. Estes and paid for by said City; and WHEREAS in view of the foregoing said City deems, and it hereby determines, that it is entitled to reimbursement from District in the full amount of Twelve Thousand Seven Hundred Fifty-five and 30/lOOths Dollars (~12',755.30), being the sum of money paid to said John E. Estes for engineering services as above mentioned~ NOW, THEREFORE, BE IT RESOLVED by the City Council of said City that said City e.nter into a new contract with said Charles E. Randlett, the same to be in the form of that attached hereto, marked "EXHIBIT A" and made a part hereof by this reference just as though fully set forth at this point, it being understood that upon the execution of said contract, t!e ~%arch 6, 1950 contract entered into with said Oharles E. Randlett shall be and become null and void. Further, the Mayor of said City is hereby authorized to execute said contract on behalf of said City and the City Clerk is hereby directed to attest to the same and to af- fix thereto the corporate seal of said City. BE IT FURTNER RESOLVED that $~i~ City Council does hereby declare, on the basis of the recitals hereto, that the Industrial Sewers and Pumping Stations Assessment District shall be obligated to said City in the amount of Twelve Thousand Seven Hundred Fifty-Five and 30/1OOths Dollars (~12,755.30), and in tnm~ connection, the Director of Public Works as Ex-officio Superintendent of Streets is hereby directed to withhold from the assessment moneys received by him in connection with the proceedings for said as~ess~ent district the sum of Twelve Thousand Seven Hundred Fifty-five and 30/lOOths Dollars (~12,755.30) and to deliver the same to the City Treasurer for the benefit of said City. I.hereby certify that the foregoing Resolution was regul~rly introduced and adopted by the City Council of the City of South San Francisco at a regular ad- journed meeting held on the 3rd day of August, 1954.
