HomeMy WebLinkAboutReso 2113-1955RESOLUTION NO. 2113 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SU3TN SAN FRANCISCO DETERMINING D-NPAID ASSESSMENTS AND PROVIDING FOR THE ISSUANCE OF BONDS. WEEKEAS the City Council of the City of South San ~rancisco did, on the 15th day of March, 1954, pass and adopt its Resolution of Intention No. 1987 and thereafter did, on the 7th day of June, 195~ and ou the 6th day of July, 1954, pass and adopt its R~solution No. 2017 and'Resolution No. 2026, respectively, ordering changes and modifications in the proceedings under said Resolution of Intention, all relating to the construction of public improvements iu said city under and pursuant to the provisions of the Municipal Improvement Act of 1913, as amended~ and did therein provide that serial bonds would be issued thereunder pursuant to the provisions of the Refunding Assessment Bond Act of 1935, am modified in the Municipal Improw~-~e~nt Act of 1913, reference to said Resolution of Intention, as so modified, being hereby expressly made for further details and particulars; and WHEREAS notice of the recordation of the assessments, and of the time within which the assessments, and of the time within which the assessments may be paid in cash has been duly published and mailed in the manner provided bylaw, and whereas the time so provided for receiving the payment of assessments in cash has expired; and whereas, on January 5, 1955, the City Engineer of said city did file with the City Treasurer of said city a list of all assessments which now remain unpaid; and WEEREAS said City Council has duly considered said list and has determined that the same is an accurate statement thereof, NOW, TEEKKFORE, BE IT RESOLVED by said City Council, as follows: 1. That the assessments in said unpaid list which~ now remain unpaid, ~nd the aggregate thereof, are as shown on E~bit "A", attached hereto and by this reference made a part hereof. 2. That reference is hereby made to the assessment an~ to the diagram recorded in the office of the Superintendent of Streets of said city, as the same have been confirmed by said City Council, for a particular description of the lots bearing the respective assessment numbers upon which assessments remain unpaid, severally and respectively. B- That the amount of the unpaid assessments is Two Hundred and Eighty-three Thousand and Eighty Dollars ($283,080.00) and that bonds in the amount of Two Hundred and Eighty-three Thousand and Eighty Dollars ($283,080.00) shall be issued upon the security of said unpaid assessments in accordance with the provisions of the aforementioned Refunding Assessment Bond Act of 1935, as modified in the Municipal Improvement Act of 19lB, and under and pursuant to the provisions of said Resolution of Intention, as modified, and the proceedings thereunder duly had and taken; that said bonds shall be two hundred and eighty-five (285) in number, shall be dated August 9, 1954, and bear interest at the rate of not to exceed five percent (5~) per annum from August 9, 1954, and the denomination of said bonds with their respective numbers and dates of maturity are as follows: SERIES BOND NO. That said bonds shall be issued in series, and the unpaid assessments as shown on said list as filed with the City Treasurer of said city and determined by said city council, together with the interest thereon, S ~halt~ remain' and_~cOnstitue a trust fund for the redemption and payment of said bonds and of the interest which may become due thereon, which unpaid assessments shall be payable in annual series corresponding in number to the number of series of bonds issued, and an even annual proportion of each assessment shall be payable in each year preceding the date of the maturity for each of the several series of bonds issued, and such proportion of each assessment c~,~ng due in any year, together with the annual interest thereon, shall in turn be payable in install- ments in the same manner as are the general real property taxes levied by said city, and shall become delinquent at the same time and in the same proportionate amounts and bear the same Droportionate penalties for delinquency. 5. The interest coupons affixed thereto shall be signed by said City Treasurer or, in lieu thereof, bear his engraved, printed, or lithographed signature; and such signing and sealing of said bonds by said officers and such signing of said coupons by said City Treasurer shall constitute, and be, a sufficient and binding execution of each and every one of said.of ~id bonds '~nd 'all~he ~Coupon~ thereof, · reSi~Cti~elY.'~ Said bonds shall be substantially in the~form as set fort~ in the Refunding Assessment Bond Act of 19~5, as modified in the Municipal Improvement Act of 1913. Said Mayor, City Treasurer, and City Clerk are hereby respectively authorized and directed so to sign and attest said bonds and interest coupons. 6.
