HomeMy WebLinkAboutReso 2139-1955RESOLUTION NO. 2139 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO URGING THE DEFEAT OF ASSEMBLY BILLS NO. 859, No. 860, ~ND NO. 862, WHICH, IF ENACTED iNTO LAW, WOULD REQUIRE ~J~tCIPAL GOVERNMENTS TO ENTER INTO COLLECTIVE BARGAINING. AGREEMENTS UPON THE REQUEST OF ~UNICIPAL E~fl~LOYEES' ORGANIZATIONS. WHEREAS certain Assembly Bills -- namely, Assembly Bill No. 859, Assembly Bill N°. 860, and Assembly Bill No. 862 -- now pending before the Legislature of the State of California which, if enacted into law, would greatly affect the func~ioning of municipal governments throughout the State by requiring such governments to enter into collective bargaining contracts upon the request of municipal employees' orgainzations; and WHEREAS collective bargaining can, by its very nature, apply only to private employer- employee relationships because wages, hours, and working conditons of public employees are fixed by statute, charter, and ordinance and therefore cannot be controlled by contract; and WHEREAS, insofar as concerns the employment of persons by mUnicipal governments as well as by other public bodies, public officials cannot delegate, by contract, their functions and duties to the representatives of employees; and ~'AEREAS many of the services rendered by muniCipal governments are often of an emergency nature, such as, fire protection, police protection, sewage and waste elimination, street and sidewalk maintenance, and health and sanitation protection in general, and therefore must be provided continuously in the interests of public safety, health, and welfare, without any interruption whatsoever, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that said City Council does hereby tind and determine that it would be inimical to the best interests and welfare of the people of the City of South San Francisco, and, in general, of the people of the cities throughout the entire State for collective bargaining rights to be given to municipal employees' organizations. Consequently, said City Council do~s hereby de,tare that it is unqualifiedly opposed to the passage of Assembly Bills Nos. 859, 860, and 862. In that connection, said City Council does hereby urge each and every member of the of the California Legislature, both Senate and Assembly, to vote against the enactment of all three said Bills. BE IT FURTHER RESOLVED THAT THE CITY CLERK be, and he hereby is, directed to cause certified copies of the resolution to be forwarded to Honorable Goodwin F. Knight, Governor of the State of California; Honorable Harry L. Parkman, Senator from the Twenty-First Senatorial Distrrict; Honorable Richard J. Dolwig, Assemblyman from the Twenty-Sixth Assembly District; Honorable Wallace D. Henderson, Assemblyman from the Thirty-Second Assembly District and Chairma~ of the Industrial Relations Committee; the Board of Supervisors of th~ County of San Mateo; the City Councils of each of the cities situated in the County of San Mateo; the Leag~eof California Cities; and the Peninsula Division of the Leag~eof California Cities. I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 18th day of April, 1955, by the following~vote: AYES: COUNCILMEN: Andrew Rocca, Francis Lucchio, Emilio Cortesi, Richard Gamlen, Telford Smith.
