HomeMy WebLinkAboutReso 2156-1955RESOLUTION NO. 2156 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DETERMINING THAT CERTAIN MUNICIPALLY-OWNED PROPERTY INCLUDED WITHIN THE AIRPORT BOULEVARD SANITARY SEWER DISTRICT IS NON-OPERATIVE PROPERTY WHEREAS THE City of South San Francisco is the fee owner of the following described real property: All that certain real property situate in the City of South San Francisco, County of San Mateo, State of California, and particularly described as follows: The westerly portion of Parcel 76, Zone "I" as shown on the Official Map of the City of Sohth San Francisco dated March, 1953, more particularly described as follows: BEGINNING at the northwesterly corner of said Parcel 76; thence along the northerly boundary of said Parcel 76 North 55 East 530 feet, North 84° East 130 feet, South 57° East 620 feet and South 23° 20' West 139.86 feet; thence southwesterly along the bank of a slough 450 feet, more or less, to the southerly boundary of said Parcel 76; thence along the southerly and westerly boundary of said Parcel 76, South 80° 57'; West 520 feet, more or less, and North 25° 27' West 600 feet, more or less, to the point of beginning, and WHERE~S the above-described real property constitues a part of a special assessment district known as the"Airport Boulevard Sanitary Sewer District" and, as such, has been assessed for a portion of the costs of installing a sanitary sewer in, and for the benefit of, the entire area comprising said special assessment district, under the provisions of the Public Improvement Act of 1911 and the Improvement Bond Act~ of 1915; and WHEREAS neither the amount assessed against said real property nor any part thereof has been paid and bonds are about to be issued in the total amount of all unpaid assessments, which situation gives rise to the question of whether said real property is "non-operative" municipally-owned real property; and WHEREAS said real property is not presently being used for any municipal or other public purpose whatsoever, and whereas, in addition, it now appears that there will at no time in the future be a need or requirement for using said real property for municipal or other public purposes, NOW, THEREFORE, BE IT RESOLVED that said City Council does hereby find and determine that the above particularly described real property is not now being used for municipal or other public purposes and, in addition, will not be needed or required, for any such purposes within the near or foreseeable future. Consequently, said City Council*is non-operative municipally- owned property, and that therefore there is no valid reason why bonds should not issue as a result of the non-payment of the hereinabove-mentioned assessment lien against said real property. I hereby certify that the foregoing resolution was regularly introduced and adopted at a regular meeting of the City Council of the City of South San Francisco held on the 6th day of June, 1955, by the following vote: AYES: COUNCILMEN Andrew Rocca, Francis Lucchio, Telford Smith, Emilio Cortesi, Richard Gamlen NOES: " None ABSENT: " None ATTEST: Arthur A.
