A RESOLUTION APPOINTING SPECIAL ASSISTANT TO THE CITY ENGINEER IN
RE PARKING DISTRICT NO. 1955-1 OF THE CITY OF SOUTH SAN FRANCISCO
AND AUTHORIZING AGREEMENT
WHEREAS, the City Council of the City of South San Francisco on the 25th day of April 1955
did duly pass and adopt its Resolution No. 2140 approving the terms of petiZion for formation of
Parking District No. 1955-1 of the City of South San Francisco, and did direct the City Engineer of
the City of South San Francisco to make and file with the City Council a report in conformance with
the requirements of Section 35257 of the Streets and Highways Code of the State of California; and,
WHEREAS, it is deemed by the City Council of the City of South San Francisco that a specia
assistant to the City Engineer and the Director of Public Works of the City of South San Francisco b~
appointed in this proceeding; and,
WHEREAS, J. E. Peck, a duly licensed and qualified engineer, deemed by the City Council
competent to perform such duties, did on the 26th day of May, 1955 file with the Director of Public
Works of the City of South San Francisco a written proposal, a photostatic copy of which 16tter
proposal is attached to this resolution; and,
WHEREAS, the City Council deems it to be in the public interest, convenience and necessity
that J. E. Peck be appointed special assistant to the City Engineer and Director of Public Works in
connection with the formation of said Parking District No. 1955-1 under the terms and conditions
set forth in his said proposal,
NOW, THEREFORE, BE IT RESOLVED That J. E. Peck, a duly licensed and qualified engineer,, be
and he is hereby appointed special assistant to the City Engineer and Director of Public Works of th~
City of South San Francisco to, under the supervision and direction of the City Engineer and Directo]
of Public Works, perform all work requisite to the making of the report, conforming to the provision~
of Section 35257 of the Streets and Highways Code of the State of California, by this City Council
ordered made and filed by the City Engineer under its Resolution No. 2140; and to, under the supervis
and direction of the City Engineer and Director of Public Works of the City of South San Francisco,
perform all other engineering duties required in connection with the formation and completion of sai(
parking district and the construction of the improvements that may be hereafter authorized by the
City Council of the City of South San Francisco, County of San Mateo, State of California, in
connection therewith,
FURTHER RESOLVED that as compensation for all professional services to be rendered by said
J. E. Peck pursuant hereto, he shall receive and be paid by the City of South San Francisco a sum
equal to 2½% of the amount of bonds finally issued and sold in connection with these proceedings,
excepting therefrom such amount as shall represent the fees and costs of said J. E. PECK, payable
by the City upon the sale of said bonds; provided, however, that in the event these proceedings be
by the City Council at any time abandoned prior to the issuance and sale of any bonds, the liabiltiy
of the City of South San Francisco to said J. E. PECK for all of said services and out-of-pocket
expenses shall be the sum of $500.00, and no more.
FURTHER RESOLVED that all compensation or other remuneration or expenses which may become d
and payable to J. E. PECK under and pursuant to this resolution be deemed to be chargeable to the
district as an incidental expense in connection with this proceeding.
I hereby certify that the foregoing Resolution was regularly introduced and adopted by the
City Council of the City of South San Francisco at a regular meeting held on the 20th day df June, 19
