HomeMy WebLinkAboutReso 2170-1955RESOLUTION NO. 2170 A RESOLUTION OF THE CITY OF SOUTH SAN FRANCISCO ORDERING THE VACATION OF A DRAINAGE AND SANITARY EASEMENT UNDER THE PROVISIONS OF THE PUBLIC SERVICE EASEMENTS VACATION LAW WHEREAS the City Council of the City of South San Francisco has determined that the easement hereinbelow described for sewers, drainage, and sanitary purposes has not been used for a period in excess of five (5) consecutive years next preceding the date hereof; and WHEREAS said City Council desires that said easement be vacated under the provisions of Sectio~ 50433 (a) of the Government Code of the State of California; and WHEREAS the owners of said real property have conveyed to said City an easement in exchange for the hereinafter described easement, NOW, THEREFORE, the City Council of the City of South San Francisco hereby orders that the hereinafter described easement for sewers, drainage, and sanitary purposes be, and the same hereby is vacated and abandoned. The easement hereinab~ve referred to is particularly described as follows: Ail that property situated in the City of South San Frm~isco, County of San Mateo, State of California, described as: So much of that certain right of way 15 feet in width for sewers for drainage and sanitary purposes as granted by South San Francisco Land and Improvement Company, a corporation, to City of South San Francisco, a municipal corporation, by Deed dated July 20, 1929 and recorded December 21, 1932 in Book 581 of Official Records of San Mateo County at page 299, that lies within the lands described as follows: BEGINNING at a point in the southwesterly line of Linden Avenue which is the most northerly corner of that certain 1.197 acre parcel of land described in Deed from South San Francisco Land and Improvement Company, a corporation, to Leonard D. McLeod and Cerrine E. McLeod, his wife, by deed dated February 20, 1946 and recorded February 26, 1946 in Book 1248 of Official Records of San Mateo County at page 150 (89631-F); thence from said point of beginning, South 33° 25' 08" West along the northwesterly line of said 1.197 acre tract 212.36 feet to the most westerly corner of said tract; thence North 56° 34' 52" West 50 feet and North 33° 25' 08" East 206.40 feet to the southwesterly line of Linden Avenue above mentioned; thence South 63° 22' 30" East along said line of Linden Avenue 50.35 feet to the po.iht of beginning. BE IT FURTHER RESOLVED that said City execute its deed transferring to FELICE PEDEMONTE and MARY PEDEMONTE, his wife, all the real property hereinbefore described. In this connection, the Mayor and the City Clerk of said City are hereby authorized to execute on behalf of said city a Deed conveying to said FELICE PEDENONTE and MARY PEDEMONTE, his wife, said real property, and the City Clerk is also hereby directed to affix to said Deed the corporate seal of said city. BE IT FURTHER RESOLVED that the City Clerk of said City shall cause a certified copy of this resolution to be recorded in the office of the Recorder of the County of San Mateo. I hereby certify that the foregoing resolution was regularly introduced and adopted at a regular meeting of the City Council of the City of South San Francisco held on the 18th day of July, 1955, by the following vote: AYES, COUNCILMEN NOES, " ABSENT, " Andrew Rocca, Francis Lucchio, Emilio Cortesi, Ricbm~dGamlen None Telford Smith ATTEST': Arthur A.
