HomeMy WebLinkAboutReso 2205-1955454 RESOLUTION NO. 2205 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DECLARING THE NECESSITY OF ACQUIRING CERTAIN PROPERTY IN THE CITY OF SOUTH SAN FRANCISCO FOR THE PURPOSE OF CONSTRUCTING STORM DRAINS ON FOREST VIEW DRIVE AND EVERGREEN AVENUE IN SAID CITY. BE IT RESOLVED by the City Council of the City of South San Francisco that said City Council finds and determines and hereby declares that: Public interest and necessity require the conStruction of storm drains in and through the land hereinafter described. BE IT FURTHER RESOLVED that said City of South San Francisco acquire an easement in the real property next hereinafter described for the purpose of constructing, operating, and maintaining a storm drain by condemnation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California relating to eminent domain, and prepare, and prosecute, in the name of the People of the State of California, such proceeding of proceedings in the.~Superior Court of the State of California, in and for the County of San Mateo, as are necessary for such acquisition; the land hereinbefore referred to consists of all those certain tracts or parcels of land situate in the City of South San Francisco, County of San Mateo, State of California, and described as follows: PARCEL I A five-foot strip of land lying southeasterly of, and parallel and adjacent to the northwesterly property line of the Devincenzi property, extending from the southwesterly property line of Mission Road to the northeasterly property line of the Southern Pacific Company.right-of-way as said property line is described in a deed recorded in Book 195 of Deeds at page 244, San Mateo County Records. PARCEL II A ten-foot strip of land within that certain 3.512 acre parcel described under Deed No. 81314K, San Mateo County Records, extending from the north- easterly right-of-way line of the Southern Pacific Railroad to the southwesterly right-of-way line of Mission Road and lying parallel and adjacent to the southeasterly property line of the aforesaid parcel. PARCEL III Beginning, for reference, at the northeasterly corner of Lot 7, Block 2, as said lot is described and deline- ated upon a map entitled "REGLI TRACT, SOUTH SAN FRANCISCO", which map was filed for record on May 8, 1924 in Liber 11 of Maps at page 63, San Mateo County Records; thence alRng the northerly line of the aforesaid lot, North 74- 28' West, 32.78 feet,to the True Point of Beginning; thence South 10° 21' 36' West, 206.50 feet; thenceo South 74° 07' 22'' East, 10.05feet; thence North 10 21' 36" East, 206.56 feet; thence North 74° 28' West, 10.04 feet to the said true point of beginning. The City Attorney is hereby authorized and directed to prepare and file a complaint in eminent domain for the purpose of acquiring the land hereinbefore described, and to do all such things as may be necessary to carry into effect the purpose of this resolution. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at an adjourned regular meeting held this 29th day of August, 1955, by the following vote: AYES, Councilmen Andrew Rocca, Francis Lucchio, Emilio Cortesi, Richard Gamlen, Telford Smith NOES, " None ABSENT, " None ATTEST: Arthur A.
