HomeMy WebLinkAboutReso 2207-1955RESOLUTION OF INTENTION NO. 2207 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DECLARING ITS INTENTION TO IMPROVE SOUTH CANAL STREET FROM LINDEN TO SPRUCE AVENUES AND MAYFAIR AVENUE FROM ITS EASTERLY TERMINATION TO SPRUCE AVENUE IN THE CITY OF SOUTH SAN FRANCISCO. RESOLVED by the City Council of the City of South San Francisco, California, that in its opinion the public interest and convenience require, and that it is the intention of said City Council to order, the following improvements to be made, to-wit: 1. Grading and paving of Mayfair Avenue from Mayfair Village Subdivision No. 3 East to South Spruce Avenue, grading and paving of South Spruce Avenue from the intersection thereof with Mayfair Avenue North to the Colma Creek Canal drainage right-of-way, and the grading and paving of South Canal Street from the intersection thereof with South Spruce Avenue Easterly to Linden Avenue; the installation of curbs and gutters along said streets to be-so graded and paved; the installation of sidewalks on both sides of the Mayfair Avenue protion, along the easterly side only of the South Spruce Avenue portion, and along the south side alon~ of the South Canal Street protion; the insta11- ation of all necessary s~orm drainage facilities including the installation of necessary culverts under the Mayfair Avenue Extension; the installation of a sanitary sewer, to- gether with necessary appurtenances, from the interseCtion of North Canal Street and Spruce Avenue southerly along Spruce Avenue to Mayfair Avenue and thence along Mayfair Avenue to a point approximately one hundred (100) feet E~st of said Mayfair Village Subdivision No. 3; the installation of a sanitary sewer, together with necessary appur- tenances, from the intersection of South Canal Street with South Spruce Avenue Easterly along South Canal Street to a point approximately three hundred (300) feet distant from South Spruce Avenue; the stabilization of the South bank of the Colma Creek Canal from South Spruce Avenue easterly to Linden Avenue, as required. 2. The performing of all work auxiliary to any of the above which may be necessary to complete the same. 3. All said work and improvements are to be constructed at the places and in the particular locations, of the forms, sizes, and dimensions and materials, and at the lines,. grades and elevations, as shown and delineated upon the plans, profiles, and specifications to be made therefor, as hereinafter provided. 4. There is to be excepted from the work above described any of such work already done to line and grade, and marked excepted~ or s~own not to be done on said plans, profiles, and specifications. 5. Said City Council does hereby adopt and establish as the official grades for said work the grades and elevations to be shown upon said plans, profiles, and specifications. All such grades and elevations are to be in feet and decimals thereof with reference to the datUm plane of the City of South San Francisco. 6. Notice is hereby given of the fact that in many cases said work and improvement will bring the finished grade to a grade different from that formerly existing, and that to said extent said grades are hereby changed and that said work will be done to said changed grades. 7. Said.contemplated work, acquisitions, and improvements, in the opinion of said City Council, are of more than local or ordinary public benefit, and said City Council does hereby make the expenses of acquisitions and improvements chargeable upon a district benefited thereby, which district lies wholly within the City of South San Francisco, County of San Mateo, State of California, and is particularly described as follows: Beginning at the most easterly corner of Lot 10, Block 10, as said lot and block are shown on that subdivison entitled "MAYFAIR VILLAGE MAP NO. 3 SOUTH SAN FRANCISCO, CALIFORNIA", filed in the office of the R~corder of San Mateo County, California, in Book 26 of Maps at page 45; thence along the easterly boundary of said subdivision S 15° 33' W aldi~ta~oeee~t440yf~et;¥$h~nc~ S 74° 27' E a distance of 1176.08 feet to a line parallel to and 390 feet westerly of and measured at right angles to the westerly line of South ~aple Avenue; thence along said last mentioned parallel line N 15° 33' E a distance of 261.31 feet; thence S 74° 27' E a distance of 390 feet to the westerly line of Soui~ Maple Avenue; thence along the westerly line of SaSh Maple Avenue a dis- tance of 44.23 feet; thence leaving said last mentioned westerly line S 74° 27' E a distance of 410 feet to the westerly line of the Southern Pacific Rsilroad Company right-of-way; thence along said last mentioned westerlF rizht-of-wav ltn~ ~ ~ 2~' l'ncluding the installation of necessary cUlverts under the Mayfair Avenue Extension; the installation of a sanitary sewer, to- gether with necessary appurtenances, from the intersection of North Canal Street and Spruce Avenue southerly along Spruce Avenue to Mayfair Avenue and thence along Mayfair Avenue to a point approximately one hundred (100) feet East of said ~ayfair Village Subdivision No. 3; the installation of a sanitary sewer, together with necessary appur- tenances, from the intersection of South Canal Street with South Spruce Avenue Easterly along South Canal Street to a point approximately three hundred (300) feet distant from South Spruce Avenue; the stabilization of the South bank of the Colma Creek Canal from South Spruce Avenue easterly to Linden Avenue, as required. 2. Notice is hereby given that serial bonds to represent unpaid assessments and to bear interest at the rate of five percent (5%) per annum will be issued hereunder in the manner provided by Division 10 of the Streets and Highways Code in the Improvement Bond Act of 1915, and the last installment of such bonds shall mature fourteen (14) years from the 2d day of July next succeeding ten (10) months from their date. 9. Except as herein ot~erwise provided for the issuance of bonds, all the work above mentioned shall be done pursuant to the provisions of the Manicipal Improvement Act of 1913, as amended. 10. Reference is here made to that certain resolution of said City Council which is numbered 2206 and which was adopted on the 29th day of August, 1955, wherein said City Council made findings and determined that proceedings pursuant to Division 4 of the Streets and High- ways Code of the State of California are, insofar as this improvement project is concerned, unnecessary. 11. Said proposed improvements are h&reby referred to WlLSEY & HAM, duly liCensed civil engineers employed by the City of South San Francisco as the engineers for the instant improvement project, and who have been designated by the said City Council as the persons having charge and control of the construction of public improvements in and for said City of the kind described herein, they being competent persons employed by said City for that purpose; and said WILSEY & HAM are hereby directed to make and file with the City Clerk of said City a report in writing, presenting the following: (a) Plans and specifications of the proposed improvements to be made pursuant to this Resolution of Intention; (b) EngineeFs' statement of the itemized and total estimated costs and ~xpenses of said improvements and ~f the incidental expenses in connection therewith; (c) Diagram. showing, the assessment district above referred to, and also the boundaries and dimensions of the respective subdivisions of land within said district as the same existed at the time of the passage of this Resolution of Itention, each of which subdivisions shall be given a separate number upon said diagram; (d) A proposed assessment of the total, amount of the costs and expenses of the proposed improvements upon. the several subdivis~ns of land in said district in proportion to the estimated benefits to be received by such subdivisions, respectively, from said improvements, and of the expenses incidental thereto. 12. If any excess shall be realized from the assessment, it shall be spent for the main- tenance of said improvements, unless said City Council shall hereafter determine that said amount or any part thereof shall be applied as a credit to each assessment herein. I hereby certify that the foregoing r~solution was regularly introduced and adopted by the City Council of the City of South San Francisco at an adjourned regular meeting held this 29th day of August, 1955, by the following vote: AYES, COUNCILMEN: Andrew Rocca, Francis Lucchio, Emilio Cortesi, Richard Gamlen, Telford Smith.
