HomeMy WebLinkAboutReso 2212-1955RESOLUTION NO. 2212 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO OVERRULING PROTESTS FOR THE PUBLIC IMPROVEMENT WORK IN SAID CITY PURSUANT TO RESOLUTION OF INTENTION NO. 2184. WHEREAS the City Council of the City of South San Francisco, pursuant to the requirements of the Improvement Act of 1911, did appoint Tuesday, the 6th day of September, 1955, at the hour of 8:00 o'clock P. M. of said day, in the Council Chambers of the City Hall, South San Francisco, California, as the time and place for hearing protests in relation to the proposed public improvements in said city as enumerated in Resolution of Intention No. 2184, and did direct the City Clerk of said city to give notice of such hearing as required by said Act; and WHEREAS it appears that notices of said hearing were duly and regularly posted, mailed, and published in the time, form, and manner required by said Act, as evidenced by the affi- davits on file with said City Clerk, whereupon said hearing was duly and regularly held at the time and place stated in sai.d notice; and WHEREAS, three (3) interested persons, objecting to said improvements, or to the extent of the assessment district, or to the grades at which the work will be done, or to the engineer's estimate of the cost and expense thereof, ~ade oral protests to said City Council at the time set for hearing, and all'other persons interested and desiring to be heard were given an opportunity to be heard, and all matters and things pertaining to said public improvements were fully heard and considered by said City Council, NOW, THEREFORE, BE IT RESOLVED by said City Council that said City Council does hereby find and determine that the owners of less than one-half (1/2) of the area to be assessed for the cost of said public improvements, at or prior to the time fixed for said hearing, filed written or oral protests against said proposed public improvements as a whole, or against said district or the extent thereof to be assessed for the cost and expense of said improvements as a whole, or against the City Engineer's estimate of said costs and expenses. BE IT FURTHER RESOLVED that any and all written or oral peotests in relation to'said proposed public improvements be, and they hereby are, overruled. I hereby certify that the foregoing resolution was regularly adopted by the City Council of the City of South San Francisco at a regular meeting thereof held on the 6th day of September, 1955, by the following vote: AYES, Councilmen Andrew Rocca, Emilio Cortesi, Telford Smith ABSTAINED" Francis Lucchio NOES, " None ABSENT, '* Richard Gamlen ATTEST: ~tty.~Ierk
