AUTHORIZING THE EXECUTION OF A DEED OF INDENTURE BETWEEN THERESA ~;
UCCELLI AND SAID CITY, WITH RESPECT TO THE GRANTING OF A CERTAIN
STORM DRAIN EASEMENT TO SAID CITY.
WHEREAS the City of South San Francisco is desirous of obtaining from Theresa Uccelli a
certain storm drain easement, which will be beneficial to said City; and
WHEREAS said Theresa Uccelli is willing to grant said Deed of Easement, provided that said
City agrees to be responsible for all costs and expenses incurred in connection withi~the repair,
maintenance, or replacement of the storm drain located upon said easement, and provided that
said Theresa Uccelli shall have the right to build and construct any structure whatsoever on
or upon the land directly above said easement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco
that said City accept from said Theresa Uccelli said offer ~o grant to said City a storm drain
easement upon the conditions specified in the premises hereto. In this connection, said City
shall enter into a Deed of Indenture with said Theresa Uccelli, the Mayor of said City being
hereby authorized to execute the same on behalf of said City and the City Clerk being directed
to attest to the same and to affix thereto the corporate seal of said City. The Deed of
Indenture to be entered into between said Theresa Uccelli and said City shall convey to the
City of South San Francisco the following easement:
An easement interest (together with reasonable rights of access thereto) for the purpose
of constructing, operating, and maintaining a storm drain in, across, over, upon, and through
that certain parcel of real property situate in the City of South San Francisco, County of
San Mateo, State of California, and particularly described as follows:
A parcel 4.25 feet in width lying parallel and adjacent to each side of the
following described center line: Beginning for reference at the northeasterly
corner of Lot 7, Block 2, as said lot is shown upon a map entitled 'REGLI
TRACT", SOUTH SAN FRANCISCO, which map was recorded in Volume 11 of Maps at
Page 63, San Mateo County Records; thence North 75° 28' West~ 27.20 feet to
the True Point of Beginning~ said point being distant 46.00 feet from the
northeasterly corner of Lot 6, Block 2, of the aforesaid Regli Tract; thence
South 17° 59' 31" West 47.73 feet; thence South 10° 21' 36" West 158.86 feet
to the northerly line of Grand Avenue Park.
BE IT FURTHER RESOLVED that upon receipt of said Deed of Indenture, properly executed
and acknowledged, the City Clerk shall forward the same to the Recorder of the County of San
Mateo for recordation, together with a certified copy of this resolution.
I hereby certify that the foregoing resolution was regularly introduced and adopted at
a regular meeting of the City Council of the City of South San Francisco held on the 3rd day
of October~ ~55, by the following vote:
AYES, Councilmen: Andrew Rocca, Francis Lucchi°, Emilio Cortesi, Richard Gamlen, Telford Smith.
