I RESOLUTION OF INTEPJTIOI~ N0. 2401 t^1HEREAS, in accordance with the provisions of Section 280/ of the California Streets and HiPh- ~rays Code, the owner of all the property to be subject to assessment, for the proposed acquisitions and ' improvements hereinafter described has signed and filed with the City Clerk of the City of South San Francisco a written petition for said acquisitions and improvements in proceedings to be taken by the City Council pursuant to the Municipal Improvement Act of 1913 and for the issue of bonds in said proceedings under th e Improvement Act of 1911, and by said petition taaived all proceedings required by the provisions of Division 4 of said Streets and Highways Code (being the special Assessment investigation Limitation and Majority Protest Act of 1931, Streets and Highways Code Sections ?_800-3012); and W!-IEREAS, $'he City Council of the City of South San Francisco by its resolution entitled rrResolution Appointing Engineers" adopted Augtt~t 27, 1956 appointed Wilsey & Ham, Burlingame, California, as Engineers of ~1ork to do and perform all engineering work necessary in and for said proceedir~s, including all preliminary surveying, preparation of plans, profiles, specifications, estimate of costs, diagram, assessment, setting grade stakes and supervision of work; and ?~!-iEREAS, the public interest and convenience required the said proposed acquisitions and improvements; NO~J, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORPdIA, AS FOLLO~yS: 1. The City Council hereby finds that said petition has been si<<;ned by the owner of all the property to be subject to assessment for the proposed acquisitions and improvements hereinafter described, and hereby grants said petition and hereby determines that the situation described in clause (3) of Section 2804 of the Streets and Hi~ways Code exists and that Division 4 of the Streets and Highways Code shall not apply to the proceedings hereinafter provided for. 2. The public interest and convenience required the proposed acquisitions and improve~r-ents hereinafter described. 3. It is the intention of the City Council wing work to be done and acquisitions and improvements to assessmc~t district (hereinafter provided for) designated ~ exterior boundaries of which are hereinafter specified and and said acquisitions and improvements to be made as shown paragraph 4 hereof, to wit: A. Acquisitions: of the City of South San Francisco to order the follo- be made in the City of South San Francisco in an "Industrial Park Improvement District No. 1", the described in paragraph 4 hereof, said work to be done and designated on that certain map referred to in 1. Reinforced concrete pile supported highway bridge over Colma Creek on Utah Avenue ` located about 1000 feet easterly of Airport boulevard South. 2. Excavation and fill of the relocated Colma Creek channel from the desi ned invert to s g existing ground elevation. 3. Roads and streets within the assessment district boundaries to wit: Utah Avenue, Littlefield Avenue, Haas 'day, Haynie play and Harbor way as follows: Utah Avenue between Airport boulevard South and the easterly boundary of the assessment district an approximate distance of 1940 feet; Harbor Way from the existing City of SoutYi San Francisco sanitary sewage pumping station to about 450 feet north of Havigable Sleuth; Haas Way from Utah Avenue to a point about 400 feet north; Haynie Way from Utah Avenue to a point about 540 feet south; Littlefield Avenue from Harbor '~1ay to the easterly boundary of the assessment district a distance of about 340 feet. B . Improvements Construction of paving and grading for streets with $ inch or 6 inch Untreated base and 3 inch plant mixed surfacing, curbs and gutters, sidewalks, sanitary sewer facilities, two sanitary sewage pneumatic ejector stations, storm drain lines, manholes and catchbasins, monu- ments, fire alarm system, street signs, and the appurtenances for the above works.; all on Utah Avenue between Airport Boulevard South and the easterly boundary of the assessment district an approximate distance of 1940 feet; Harbor 'Yday from the existing City of South San Francisco sanitary sewage pumping station to about 450 feet north of Navigable Slough; Haas Way from Utah Avenue to a point about 400 feet north; Haynie 6~ay from Utah Avenue to a point about 540 feet south; Littlefield Avenue from Harbor Way to the easterly boundary of the assessment district a distance of about 340 feet. r.,xcept as in this resolution otherwise specifically provided, all of said work and acquisitions and improvements shall be made and done pursuant to the Municipal Improv~nent Act of 1913. 4. Said pity Council hereby declares that the territory within the boundaries hereinafter specified and described ~;g the district to be benefited by said work and acquisitions and improvements and to be assessed to pay the cost and expenses thereof; that the expense of said work and acquisitions and improvements is hereby made chargeable upon said district; and that the exterior boundaries of said assessment district are hereby specified and described as follows: BEGINNING at the most southerly corner of that certain 4.679 acre parcel of land described as Parcel No. 2 of Deed from South San Francisco Land and Improvement Company to Pacific Gas & Electric Company,trecorded,F~banary 26, 1926, in Volume 210 of Official Ytecords of San Mateo County at page 105 (File No. 54968-A); thence from said Point of Beginning, N ©°01'02" Gd $20.03 feet; thence N$9°55+2$~' E 726.00 feet; thence PJ 0001'02" w 360.00 feet; th encel~i0°04'32" W 150.00 feet; thence southeasterly curving to the ri ~ht from a tangent which bears N $9055'2$" E, with a radius of 310.00 feet and a central angle of 54°5g'0$" an ar.c distance of 297.41 feet; thence S 89°53'30" E 693.12 feet; thence N 0°06'30" E 8.2b feet; thence S 89°53'30" E 20.00 feet; thence southeasterly, curving to the left, from a tangent which bears S 0°06'30'" W, with a radius of 349.265 feet and a central angle of 17°13'54" an arc distance of 105.04 feet; thence S 17°07'2411 E 940.91 feet thence s 9°29'43" E 150.67 feet; thence s 17°07'24" E 940.00 feet; thence S 54°34'04" 'vJ 1$.20 feet; thence S 62029'04" ?~T 366.30 feet; thence N 81025' Ga 146.$0 feet; thence N 63°28' W 753.17 feet; thence S 80000' W 240.00 feet; thence S 54°00' Tnl 510.00 feet; thence N 25027'29" !~T 1114.53 feet to the Point of Beginnine~. 5. A11 public streets, alle;rs, easements and ways and all publicly owned property in said assessment district in use in the performance of a public funC~.ion shall be omitted from said assessment hereafter to be made to pay t;;e cost and epenses of said work and acquisitions and improvements. 6. The City Council hereby declares and notice is hereby given that serial bonds to represent unpaid assessments of ~25.C'0 or more and to bear interest at the rate of 6% a year payable semiannually will be issued hereunder in the manner provided by Division 7 of the Streets and Highways Code, the Improvement Act of 1911, and said bonds shall extend .over a period not exceeding 14 years from tie 2nd day of January next succeeding the next October 15th folloT~ving their date. Each of said bonds shall be redeemable at any ti me before maturity and before commenchrnent of proceedings for sale upon payment by the holder thereof of the amount then unpaid on the principal stun thereof, with int Brest thereon calculated up to the due date of the next maturing interest coupon and all penalties accrued and unpaid, together with a premium of 5~ of said unpaid principal. ?. The City Council hereby finds and determines that if the assessment therein proposed results in a surplus in the improvement fund to be provided in the proceedings hereafter to be taken pursuant to this resolution, after the improvement is completed, said surplus shall be refunded or credited pro rata to tke parties assessed, all in accordance with the provisions of Section 10427 of the Streets and !-iighways Code. 8. The City Council hereby ref ers said propos ed work and acquisitions and i;.tprovementa to said Engineers of ?-fork for Industrial Park Improvement District No. 1 and hereby directs said Engineers of Work to make and file with the City Clerk of the City of South San Francisco a report in writing containing the matters ape~~ified in Section 10204 of the Streets and Highways Code.
