HomeMy WebLinkAboutReso 2464-1957 RESOLUTION NO. 2464 RESOLUTION OF INTENTION TO FORM PARKING DISTRICT NO. 1 OF THE CITY OF SOUTH SAN FRANCISCO AND TO ISSUE BONDS TO PAY THE COSTS AND EXPENSES THEREOF RESOLVED by the City Council of the City of South San Francisco, California, that WHEREAS, a verified petition for the formation of Parking District No. 1955-1 of the City of South San Francisco, signed by the owners of real property in the .proposed district,~as shown by the last equalizied assessment roll used by the city for the pur- poses of city taxation, owning real property of an assessed value of more than 35% of the total assessed value of all taxable real property in the proposed district as shown by the assessment roll, was filed in the office of the City Clerk of the City of South San Francisco on the 7th day of April, 1955; WHEREAS, the City Clerk has examined said petition and on April 25, 1955 certified to this Council that said petition is signed by the requisite number of qual- ified signers and is sufficient; WHEREAS, on the 25th day of April, 1955, this Council adopted its Resolution No. 2140 approving terms of Petition for Formation of Parking District No. 1955-1 in the City of South San Francisco, wherein said Council approved said petition, found that said petition had been signed by the requisite number of qualified signers and is sufficient, agreed to allocate and pledge the net revenues of the on-street parking meters proposed to be allocated and pledged in said petition, and determined that the public interest, convenience and necessity require that parking meters continue to be maintained as proposed in said petition, and directed the preparation of a report, as required by Section 35257 of the Streets and Highways Code, part of the Parking District Law of 1951; WHEREAS, thereafter this City Council did by its Resolution No. 2165 duly appoint and designate J. E. Peck, a duly licensed and qualified engineer, as special assistant to the City Engineer and Director of Public Works, in connection with all matters appertaining to the said Parking District No. 1955-1, and did direct said J. E. Peck, under the supervision and direction of the City Engineer and Director of Public Works, to make and file said report as required by Section 35257 of the Streets and Highways Code of California; WHEREAS, said report has been prepared and filed in the office of the City Clerk and has been read and considered by this City Council, and preliminarily approved; NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED and ORDERED, as follows: 1. That the public interest, convenience and necessity require the acquisi- tions and improvements herein described, and that it intends to order the formation of Parking District No. 1955-1 of the City of South San Francisco, and to issue bonds in the amount and'for the purposes hereinafter stated. 2. That the name of the proposed district is hereby changed to and shall henceforward be Parking District No. 1 of the City of South San Francisco. 3. The boundaries of said district are also shown on that certain map or plat on file in the office of the City Clerk of the City of South San Francisco and which is entitled "Map Showing Proposed Boundaries of Parking District No. 1955-1, South San Francisco, San Mateo County, California", which said map is hereby referred to and by this reference made a part hereof, and which said map shall govern for all of its details with relation to the boundaries of the proposed Parking District No. 1 of the City of South San Francisco. follows: That the parking places proposed to be acquired are generally described as Parcel 1: Being the easterly 25 feet of Lot 12; all of Lots 13 and 14 in Block 139 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal., Plat No. 1", which map was filed in the office of the County Recorder of San Mateo County on March 1, 1892 in Book "B~ of Original Maps at page 6 and copied into Book 2 of Maps at page 52. Parcel 2: All of Lots 21 and 22 in Block 125 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal., Plat No. 1", which map was filed in the office of the County Recorder of San Mateo County on March 1, 1892 in Book "~' of Original Maps at page 6,~and copied into Book 2 of Maps at page 52. Parcel 3: All of Lots 18 and 19 in Block 125 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal., Plat No. 1", which map was filed in the office of the County Recorder of San Mateo County on March 1, 1892 in Book "~' of Original Maps at page 6 and copied into Book 2 at page 52. Parcel 6: All of Lots 5 and 6 in Block 124 as delineated and set out on that certain map entitled "South San Francisco, San Marco Co., Ca1., Plat No. 1", which map was filed in the office of the County Recorder of!San Mateo County on March 1, 1892 in Book "B: of Original Maps at page 6 and copied into Book 2 of Maps at page 52. 5. That the public ways proposed to be acquired for ingress to or egress from said parking places above described are generally described as follows: Public Way No. 1: The westerly 30 feet of Lot 10 in Block 125 as delineated and set out on that certain map entitled ,South San Francisco, San Marco Co., CaL, Plat No. 1", which map was filed in the Office of the County Recorder of San Mateo County on March 1, 1892 in Book "~' of Original Maps at page 6 and copied into Book 2 of Maps at page 52. Public Way No. 2: The easterly 25 feet of Lot 3 in Block 139 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Ca1,, Plat No. 1", which map was filed in the Office of the County Recorder of San Mateo County on March 1, 1892 in Book "B: of Original Maps at page 6 and copied into Book 2 of Maps at page 52. Public Way No. 3: The easterly 25 feet of Lot 23 in Block 124 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal., Plat entitled ~Map Showing Propose~ ~undaries of Parking~lStric~ No.'1955-1, South san Francisco, San Mateo County, California", which said map is hereby referred to and by this reference made a part hereof, and which said map shall govern for all of its details with relation to the boundaries of the proposed Parking District No. 1 of the City of South San Francisco. m That the parking places proposed to be acquired are generally described as follows: Parcel 1: Being the easterly 25 feet of Lot 12; all of Lots 13 and 14 in Block 139 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal., Plat No. 1", which map was filed in the office of the County Recorder of San Mateo County on March 1, 1892 in Book "B* of Original Maps at page 6 and copied into Book 2 of Maps at page 52. Parcel 3: All of Lots 18 and 19 in Block 125 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal., Plat No. 1", which map was filed in the office of the County Recorder of San Mateo County on March 1, 1892 in Book "F' of Original Maps at page 6 and copied into Book 2 at page 52. Parcel 4: All of Lots 19 and 20 in Block 140 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal., Plat No. 1", which map was filed in the off~e of the County Recorder of San Mateo County on March 1, 1892 in Book "B" of Original Maps at page 6 and copied into Book 2 of Maps at page 52. Parcel 5: All of Lots 9 and 10 in Block 124 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal., Plat No. 1", which map was filed in the office of the County Recorder of San Mateo County on March 1, 1892 in Book "B" of Original Maps at page 6 and copied into Book 2 of Maps at page 52. Parcel 6: Ail of Lots 5 and 6 in Block 124 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal., Plat No. 1", which map was filed in the office of the County Recorder ef!San Mateo County on March 1, 1892 in Book "B: of Original Maps at page 6 and copied into Book 2 of Maps at page 52. 5. That the public ways proposed to be acquired for ingress to or egress from said parking places above described are generally described as follows: Public Way No. 1: The westerly 30 feet of Lot 10 in Block 125 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal., Plat No. 1", which map was filed in the Office of the County Recorder of San Mateo County on March 1, 1892 in Book "~' of Original Maps at page 6 and copied into Book 2 of Maps at page 52. Public Way No. 2: The easterly 25 feet of Lot 3 in Block 139 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal,, Plat No. 1", which map was filed in the Office of the County Recorder of San Mateo County on March 1, 1892 in Book "B: of Original Maps at page 6 and copied into Book 2 of Maps at page 52. Public Way No. 3: The easterly 25 feet of Lot 23 in Block 124 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal., Plat No. 1", which map was filed in the Office of the County Recorder of San Mateo County on March 1, 1892 in Book ',F! of Original Maps at page 6 and copied into Book 2 of Maps at page 52. 6. The improvements which are proposed to be made or constructed pm~suant to this Resolution of Intention are generally described as follows: Demolition of any existing structures on said parking lots and public ways; grading and leveling said parking lots and public ways; construction thereon of a suitable rock base and topping for the parking of motor vehicles on the park- ing lots and for the use by motor vehicles and pedestrians of the public ways; the installation on the parking lots of appropriate markings and parking meters and other facilities deemed reasonably necessary for draining, lighting and otherwise making said parking lots available for use for off-street parking of motor vehicles; the installation and construction on the public ways of suitable markings and other facilities deemed reasonably necessary for the use of said public ways by motor vehicles and pedestrians as ways of ingress to and egress from said parking lots; the installation and maintenance of such additional parking meters as may be deemed reasonably necessary on those public streets and avenues lying within the boundaries of the district not yet serviced by such meters as proposed in the petition for the formation of said district on file in the office of the City Clerk; the making of all acquisitions and the construction of all improvements and the performance of all work auxiliary thereto and deemed necessary to complete the same as off-street parking facilities, in the manner proposed and petitioned in the petition for the formation of said parking district now on file in the office of the City Clerk of the City of South San Francisco, and as agreed to be done by this City Council by virtue of its Resolution No. 2140 approving said petition. 7. The estimate of the cost of said acquisitions and improvements is the sum of $512,262.00. It is estimated that the amount of gross revenue which will be derived from the operation of said parking places will average the sum of $14,091.20 per year over a period of 25 years. It is estimated that the expenses of operating said parking places and servicing the parking meters will average the sum of $18,958.00 per year over a period of 25 years. It is estimated that the annual net revenues which can be expected to be derived from the parking meters now installed or to be installed on the public streets and avenues within the district, from which moneys will be available to make payments towards the principal and interest of the bonds, and any other purposes authorized by the law, provided to be made pursuant to the pledge, will average the sum of $25,600.00 per year over a period of 25 years. The assessed valuation*of the taxable real property within the proposed district, as shown on the last equalized assessment roll used by the City of South San Francisco for purposes of city taxation, is the sum of $1,320,770.00. All of the figures hereinabove given of estimates of cost, revenues, ex- penses and assessed valuation are taken from the report of J. E. Peck, Civil Engineer, heretofore appointed by Resolution No. 2165 of the City Council of South San Francisco as special assistant to the City Engineer, as to all matters appertaining to the forma- tion and creation of Parking District No. 1955-1 of the City of South San Francisco (now designated as Parking District No. 1 of the City of South San Francisco), filed in the office of the City Clerk on the 7th day of November, 1955, as amended by his report filed with the City Clerk on.the 20th day of February, 1956, which said reports are hereby re- ferred to for all particulars and details with reference to said items of estimate. 8. The amount which is to be contributed by the City of South San Francisco, as petitioned for in the Petition for the creation of said parking district, as hereto- fore agreed to by the City Council of the City of South San Francisco by Resolution No. 2140 a~d as set forth in Resolution No. 2463 passed by the City Council of the City of South San Francisco on the 4th day of March, 1957, and as provided in this Resolution of Intention, shall consist of the following: (1) The net revenue from all of the parking meters or Other revenue which shall be received from the establishment of the parking lots hereinabove described and proposed to be acquired. (2) The net revenues of the parking meters which are installed and maintained on any or all of the public streets or ways within the district, or which may hereafter be installed and maintained thereon. Said amounts shall be contributed by the City of South San Francisco throughout the life of the bonds to be issued in these proceedings. 9. It is hereby estimated that the amount of the bonds proposed to be issued is the sum of $512,262.00; that the maximum number of years the bonds are to run shall not exceed thirty-one ~31) years from the date of the bonds; that the rate of interest upon the bonds shall not be in excess of six per cent (6%) per annum. 10. The limit as to the rate of taxation upon ad valoreum assessments which which may be levied upon all taxable real property within the district to be created is hereby set at 50~ on each $100.00 of assessed valuation of all taxable real property in the district in any one year for all purposes permitted by the provisions of the Parking District Law of 1951. 1!. The public ways within the district on which the City of South San Fran- cisco has proposed by the petition to install and maintain and continue to maintain park- ing meters, the net revenues from which will be allocated and pledged to the payment of principal and interest upon the bonds, consist of all of those public streets and ways inside the district boundary line shown upon the map of said district hereinabove referred to and shown in the petition for the creation of said district on file herein. It is further proposed that the period of time, measured from the date'of the bonds, for which the City of South San Francisco agrees to maintain the meters on said streets is through- out the entire life of the bonds to be issued. 12. Tuesday, the 7th day of May, 1957, at'the hour of 8 p.m. of said day, at the meeting place of the City Council of the City of South San Francisco, located in the City. Ha11,.South San Francisco, California, is hereby fixed as the time and place where and when any person interested in objecting to the formation of the proposed parking dis- trict, the extent thereof, the inclusion of his property therein, the proposed acquisi- tions and improvements, the issuance of bonds, or any other proposal in this Resolution of Intention, may file a written protest with the City Clerk of the City of South San Francisco at any time prior to the time herein fixed for hearing thereon. The City Clerk of the City of South San Francisco is hereby directed to publish this Resolution of Intention twice in the SOUTH SAN FRANCISCO ENTERPRISE-JOURNAL, a newspaper of general circulation printed and published in the City of South San Francisco, the first publica- tion of which shall be at least thirty (30) days prior to the date herein fixed for hear- ing. The City Clerk shall also, not less than twenty-five (25) days prior to the date herein fixed for hearing, mail a copy of this Resolution of Intention, postage thereon prepaid, to each person to whom real property in the proposed district is assessed, as shown on the last equalized assessment ro11, at his address as shown upon the ro11, and to each person, whether owner in fee or having a lien upon or legal or equitable interest in any real property within the district, whose name and address and a designation of the real property in which he is interested is on file in the office of the City Clerk. REFERENCE IS HEREBY MADE to the report of J. E. Peck, Special Assistant to the City Engineer of the City of South San Francisco made pursuant to Resolution No. 2140 of the City Council of the City of South San Francisco, and which said report was filed with the office of the City Clerk of the City of South San Francisco on the 7th day of November, 1955, as amended the 20th day of February, 1956, for any and all particulars with reference to the matters contained in said report. I HEREBY CERTIFY that the foregoing Resolution was regularly and duly adopted by the City Council of the City of South San Francisco, San Mateo County, California, at a regular meeting thereof, held on the 4th day of March, 1957, by the following vote, to wit: AYES, Councilmen G.
