HomeMy WebLinkAboutReso 2491-1957RESOLUTION NO. 2491 OF INTENTION TO MODIFY THE ACQUISITIONS OR I~PROVEMENTS TO BE ~ADE WITH RESPECT TO PARKING DISTRICT NO. 1 OF THE CITY OF SOUTH SAN FRANCISCO WHEREAS, the City Council of the City of South San Francisco did on the 4th day of March, 1957 duly pass and adopt its Resolution No. 2464 of Intention to Form Parking District No. 1 of the City of South San Francisco and to issue bonds to pay the costs and expenses thereof; and, WHEREAS, it appears from the affidavit of Jeanette Yancy on file in this pro- ceeding that the said Resolution of Intention was duly published twice in the South San Francisco Enterprise-Journal, a newspaper of general circulation, printed and published in the City of South San Francisco, California, the first publication of which took place on March 7, 1957, which was at least thirty (30) days prior to the date fixed therein for hearing protests, and the second publication took place on March 14, 1957; and, WHEREAS, it appears from the affidavit of Arthur A. Rodondi, City Clerk of the City of South San Francisco, on file in this proceeding, that on the 13th day of March, 1957, which day was not less than twenty-five (25) days prior to the date in said Resolution of Intention fixed for hearing, he as such City Clerk did mail a copy of said Resolution of Intention, postage thereon prepaid, to each person to whom real property in the proposed district is assessed as shown on the last equalized assessment roll, at his address as shown upon the roll, and to each person, whether owner in fee or having a lien upon or legal or equitable interest in any real property within the district, whose name and address and a designation of the real property in which he is interested is on file in the office of the City Clerk; and, WHEREAS, by said Resolution of Intention this City Council did fix and des- ignate Tuesday, the 7th day of May, 1957, at the hour of 8 o'clock P.M. of said day, at the meeting place of the City Council of the City of South San Francisco, located in the City Hall, South San Francisco, California, as the time and place for hearing on the proposed formation of the district; and, WHEREAS, on Tuesday, the 7th day of May, 1957, at the hour'of 8 o'clock P.M., the said proceeding came on regularly for hearing before the City Council of the City of South San Francisco, at its said meeting place; and, WHEREAS, the said hearing was thereupon, on motion duly made, seconded and unanimously carried, duly continued and adjourned by the City Council to Tuesday, June 4, 1957, at the hour of 8 o'clock P.M., at the same place; and, WHEREAS, on Tuesday, june 4, 1957, at the hour of 8 o'clock P.M., at the said place, the said matter was again called for hearing by the City Council of the City of South San Francisco, and thereupon, on motion duly made, seconded and unanimously car- ried, the said hearing was by the said City.Council duly continued and adjourned to Monday, June 17, 1957, at the hour of 8 o'clock P.M. at the same place; and, WB]~REAS, on Monday, June 17, 1957, at the hour of 8 o'clock P.M. at said place, the said proceeding was again duly called for hearing by the City Council; and, WHEREAS, the City Council of South San Francisco, California, has duly heard all written protests filed by the City Clerk, as well as all oral protests urged before the City Council by all interested persons, and after such due consideration has deter- mined not to make any changes in the boundaries of the proposed district but has deter- mined to increase, decrease, change or otherwise modify the acquisitions or improvements proposed to be made in the manner herein provided; Now, therefore, BE IT RESOLVED by the City Council of South San Francisco, as follows: 1. That the public interest, convenience and necessity requires that the ac- quisitions or improvements proposed to be made under Resolution No. 2464 of Intention to Form Parking District No. 1 of the City of South San Francisco, aRd to issue bonds to pay the costs and expenses thereof, be increased, decreased, changed and modified in the following particulars, viz: That in pzace on ]l~rcn -~, ~.o~, wnxcn- was a~ ~eas~ ~nxr~y ~a.] aays prxor Eo Ene aa~e xxxea therein for hearing protests, and the second publication took place on March 14, 1957; and, WHEREAS, it appears from the affidavit of Arthur A. Rodondi, City Clerk of the City of South San Francisco, on file in this proceeding, that on the 13th day of March, 1957, which day was not less than twenty-five (25) days prior to the date in said Resolution of Intention fixed for hearing, he as such City Clerk did mail a copy of said Resolution of Intention, postage thereon prepaid, to each person to whom real property in the proposed district is assessed as shown on the last equalized assessment roll, at his address as shown upon the roll, and to each person, whether owner in fee or having a lien upon or legal or equitable interest in any real property within the district, whose name and address and a designation of the real property in which he is interested is on file in the office of the City Clerk; and, WHEREAS, by said Resolution of Intention this City Council did fix and des- ignate Tuesday, the 7th day of May, 1957, at the hour of 8 o'clock P.M. of said day, at the meeting place of the City Council of the City of South San Francisco, located in the City Hall, South San Francisco, California, as the time and place for hearing on the proposed formation of the district; and, WHEREAS, on Tuesday, the 7th day of May, 1957, at the hour of 8 o'clock P.M., the said proceeding came on regularly for hearing before the City Council of the City of South San Francisco, at its said meeting place; and, WHEREAS, the said hearing was thereupon, on motion duly made, seconded and unanimously carried, duly continued and adjourned by the City Council to Tuesday, June 4, 1957, at the hour of 8 o'clock P.M., at the same place; and, WHEREAS, on Tuesday, June 4, 1957, at the hour of 8 o'clock P.M., at the said place, the said matter was again called for hearing by the City Council of the City of South San Francisco, and thereupon, on motion duly made, seconded and unanimously car- ried, the said hearing was by the said'City/Council duly continued and adjourned to Monday, June 17, 1957, at the hour of 8 o'clock P.M. at the same place; and, WHEREAS, on Monday, June 17, 1957, at the hour of 8 o'clock P.M. at said place, the said proceeding was again duly called for hearing by the City Council; and, WHEREAS, the City Council of South San Francisco, California, has duly heard all written protests filed by the City Clerk, as well as all oral protests urged before the City Council by all interested persons, and after such due consideration has deter- mined not to make any changes in the boundaries of the proposed district but has deter- mined to increase, decrease, change or otherwise modify the acquisitions or improvements proposed to be made in the manner herein provided; Now, therefore, BE IT RESOLVED by the City Council of South San Francisco, as follows: 1. That the public interest, convenience and necessity requires that the ac- quisitions or improvements proposed to be made under Resolution No. 2464 of Intention to Form Parking District NO. 1 of the City of South San Francisco, and to issue bonds to pay the costs and expenses thereof, be increased, decreased, changed and modified in the following particulars, viz: (a) That in lieu of the off-street parking places proposed to be acquired by said Resolution No. 2464, there shall be acquired as such off-street parking places the following pieces and parcels of land, lying and being in the City of South San Francisco, County of San Mateo, California, viz: Parcel 1: All of Lot 2 and the east 1/2 of Lot 3 in Block 139 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal. Plat No. 1", which map was filed in the office of the County Recorder of San Mateo County on March 1, 1892 in Book "B" of Original Maps at page 6 and copied into Book 2 of Maps at page 52. Parcel 2: Ail of Lots 9 and 10 in Block 140 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal., Plat No. 1", which map was filed in the office of the County Recorder of San Mateo County on March 1, 1892 in Book "B" of Original Maps at page 6 and copied into Book 2 of Maps at page 52. Parcel 3: All of Lots 18 and 19 in Block 125 as delineated and set out on that cer- tain.map entitled "South San Francisco, San Mateo Co., Cal., Plat No. 1", which map was filed in the office of the County Recorder of San Mateo County on March 1, 1892 in Book "B' of Original Maps at page 6 and copied into Book 2 of Maps at page 52. Parcel 4: All of Lots 19 and 20 in Block 140 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., C~1., Plat No. 1", which map was filed in the office of the County Recorder of San Mateo County on March 1, 1892 in Book 'B" of Original Maps at page 6 and copied into Book 2 of Maps at page 52. 12 Parcel 5: All of Lots 5 and 6 in Block 124 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal., Plat No. 1", which map was filed in the office of the County Recorder of San Mateo County on March 1, 1892 in Book "B" of Original Maps at page 6 and copied into Book 2 of Maps at page 52. Parcel 6: Ail of Lots 5 and 6 in Block 126 as .delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal,, Plat No. 1", which map was filed in the office of the County Recorder of San Mateo County on March 1, 1892 in Book "B~ of Original Maps at page 6 and copied into Book 2 of Maps at page 52. Parcel 7: All of Lots 12 and 13 in Block 126 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal., Plat No. 1", which map was filed in the office of the County Recorder of San Mateo County on March 1, 1892 in Book "Bu of Original Maps at page 6 and copied into Book 2 of Maps at page 52. (b) That in lieu of the public wa~s for ingress to and egress from said off- street parking places proposed to be acquired by said Resolution No. 2464, there shall be acquired as a public way of ingress and egress only the following piece and parcel of land, lying and being in the City of South San Francisco, County of San Mateo, Cal., viz: The easterly 25 feet'O'f Lot 23 in Block 124 as delineated and set out on that certain map entitled "South San Francisco, San Mateo Co., Cal., Plat No. 1", which map was filed in the office of the County Recorder of San Mateo County on M~rch 1, 1892 in Book "B" of Original Maps at page 6 and copied into Book 2 of Maps at Page 52. (c) Each and all of the parcels of real property particularly described in said Resolution No. 2464 of Intention proposed therein to be acquired as off-street parking lots or public ways, and improved as therein provided, other than such of said parcels of real property which are hereinabove particularly described, are hereby eliminated from this proceeding, and each and every one of said parcels so eliminated shall not, in this proceeding, be so acquired or improved, anything in said Resolution No. 2464 of Intention to the contrary notwithstanding. 2. It is hereby declared that the parcels of land described above as Parcel 6 and Parcel 7, respectively, are presently owned in fee by the City of South San Francisco and that it is the intention of the City of South San Francisco, in addition to the amounts proposed by it to be contributed towards the proposed acquisitions and improvements as in said Resolution No. 2464 of Intention expressed, to contribute to said Parking District No. 1, at no consideration, each of the said parcels of land, to be by said Parking District No. 1 improved for use as off-street parking lots, and to contribute all of the net revenues from all of the parking meters or other revenues received from the establishment and oper- ation thereon of off-street parking facilities throughout the life of the bonds to be issued in these proceedings. 3. In conformance with the requirements of Section 35629 of the Streets and Highways Code of California, J. E. Peck, as the herein duly appointed special assistant to the City Engineer and Director of Public Works of the City of South San Franc~co, is hereby directed to prepare and file with the City Clerk of the City of South San Francisco, prior to the time fixed herein for hearing protests, a supplemental report showing the effect hereof upon the estimates and other data given in his original report filed with the City Clerk on November 7, 1955, as amended by his report filed with said City Clerk on February 20, 1956. 4. Monday, the 5th day of August, 1957, at the hour of 8 o'clock P.M. of said day, at the meeting place of the City Council of the City of South San Francisco, located in the City Hall, South San Francisco, California, is hereby fixed as the time and place for hearing objections to the changes herein proposed. Written objections to any proposed change may be filed with the City Clerk of the City of South San Francisco by any interested person at any time prior to.the hour set for said hearing. 5. The City Clerk of the City of South San Francisco is hereby directed to give notice of this Resolution of Intention by two inser~ OhS hereof in the South San Francisco Enterprise-Journal, a newspaper of general circulation printed an~ published in the City of South San Francisco, the first publication of which shall be not l~ss than twenty (20) days prior to the date herein fixed for hearing. (c) Each and all of the parcels of real property particularly described in said Resolution No. 2464 of Intention proposed therein to be acquired as off-street parking lots or public ways, and improved as therein provided, other than such of said parcels of real property which are hereinabove particularly described, are hereby eliminated from this proceeding, and each and every one of said parcels so eliminated shall not, in this proceeding, be so acquired or improved, anything in said Resolution No. 2464 of Intention to the contrary notwithstanding. 2. The further hearing on protests to Resolution No. 2464 of Intention to Form Parking District No. 1 of the City of South San Francisco and to issue bonds to pay the costs and expenses thereof is hereby continued and adjounred to the same time and place as the hearing herein fixed for hearing on this Resolution of Intention. I hereby certify that the foregoing Resolution was regularly and duly adopted by the City Council of the City of South San Francisco, San Nateo County, California, at a regular meeting thereof, held on the 17th day of June, 1957, by the follow- ing vote, to wit: AYES: NOES: ABSENT: Councilmen G.
