HomeMy WebLinkAboutReso 2607-1958RESOLUTION NO. 2607 A RESOLUTION DETERNI,NI'NO TO UNDERTAKE PIlDCEEDINGS PURSUANT TO SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS FOR THE CONSTRUCTION OF IMPNOVEMENTS WITHOUT PROCEEDINGS UNDER DIVISION 4 OF THE STREET8 AND HIGHWAYS CODE - MADIlON~ AVENUE RESOLVED, by the City Council of the City of South San Francisco, Calif- ornia, that WHEREAS, all of the owners of'more than 60~ in area of the property subject to assessment therefor 'have signed and filed with the City Clerk of this City a written petition for undertakin~proceedings pursuant to special assessment and assessment bond acts, and to assess the costs thereof upon the properties bene- fited by said improvements, and waiving proceedings under Division 4 of the Streets and Highways Code, for the'followinK-improvements: (a) The improvement of Ifadrone Avenue between the cent'or lines of Chapman Avenue and Randolph Avenue by grading, including the removsl of concrete curbs, ~utters, driveways and sidewalks, and the conStrUe- Sion therein of orusher run base pavement with plant mix surfacing, and'Portland cement concrete curbs, ~uttars, sidewalks and driveways, (b) The performing of all work auxiliary to. any of the above necessary to complete the same. WHEREAS, the costs and expenses of said contemplated improvements are to be chargeable upon an assessment district, the exterior boundaries of which are the coterminous exterior boundaries of the composite and consolidated area ~onslstinf of lands abutting on said Improvements as shown on a map thereof on flle in-the office of the City Clerk to which reference is hereby made for further particulars; WHEREAS, the public interest and convenience will be served by the taking of said proceedings; NOW, THEREFORE, IT I8 HEP.~BY FOUND., DETERMINED and ORDERED that all of the owners of more than 60~of,the proper~y subject to the assessment for said proposed ~mprovements have filed with the City Clerk of' this City a written petition for the construction of improvements pursuant to appropriate special assessment and assess- ment bond acts, without further compliance with the provisions of Division 4 of the Streets and Highways Code'. IT IS FUkxdnA FOUND, DETERIFINKD and oRDERED that' said-proceedings for the construction of said improVements shall'bo had pursuant to the Municipal Improvement Act of 1913 and the bonds upon the unpaid assessments thereof shall be issued pursuant to the Improvement~Bond Act of*1915-. IT IS FURTHER FOUND, DETERMINED and. ORDERED that 4 of the Streets and Highways Code be, snd they are hereby the provisions dispensed with. of Division I hereby certify that the foregotngresolution.wa8 regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held this 7th day of April, 1958, by the following vote~: AYES, Councilmen G.
