A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN
FRANCISCO AUTlJORIZXNG 'THE FILING OF SUIT FOR COMPLETING THE
INSTALLATION OF PUBLIC IlfPROVEIfENTS IN BURl BUR1 #3 AND
BUR1 BUR1 #3A FOR DAMAGES AND OTHER RELIEF
WHEREAS,.Bauer-Lesser, a copartnership, have not completed construction of
publicimprovements in Buri Burl #3 and Buri Buri #3A in accordance with City's spec-
ifications; and aa a result parts of said improvements are in defective condition
and because of said condition have caused, or threatened to cause, damage to public
and private property, and
WHEREAS, Bauer-Lesser have been notified of said defects and have failed
to complete construction, installation and'repair' and have not resPonded.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South
San Francisco that the City Attorney be instructed to assemble required data and
prepare for filing a suit to compel the completion of said improvements in accordance
with City's specifications and for damages and any other relief determined necessary
and that the Hayer be authorised to sign the complaint and any other documents re-
quired to file said suit.
BE IT FURTHER RESOLVED that the City Attorney confer with the owners of
private property and their attorneys or agents to Join efforts wherever the private
and public claims may be properly and Jointly asserted.
I hereby certify that the foregoinf resolution vas regularly
introduced and adopted by the City Council of the City of South San
Francisco at a regular meeting held the 7th day of April, 1958, by
the following vote:
AYES, Councilmen G. J. Rozzi, Andrew Rocca, Emilio Cortesi and Leo J. Ryan.
NOES, None
ABSENT, Councilman Francis Lucchio
