HomeMy WebLinkAboutReso 2701-1958RESOLUTION NO. 2701 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO ABANDONING A PORTION OF A PUBLIC EASEMENT DEDICATED FOR PURPOSES OF A GARBAGE DUMP WHEREAS, pursuant to Resolution No. 2655 passed and adopted on the 16th day of June 1958, the City CounCil declared its intention to abandon a portion of a garbage dump easement dedicated for the dumping of garbage and refuse, reserving easements for roads, streets, sewers and other public services, and WHEREAS, Notice of Hearing was duly given and posted and said hearings held on the 21st day of July 1958 at 8:00 p.m. and continued through successive hearings until the 6th day of October 1958, and WHEREAS, from the evidence received at said hearings, the City Council find that the portion of an easement described in Resolution No. 2655 is unnecessary for present and prospective public use. NOW, THEREFORE, BE IT RESOLVED that upon execution and delivery to City of the Grant of Easements for roadways and other public purposes as set forth on that certain map entitled, "Boundary Plan of Lower Butler Area - Easements, Parcels and Rights of Way - City of South San Francisco by Louis H. Goss, Director of Public Works"; the same being Drawing No. 7-25-58, the easement for garbage and dump purposes shall be abandoned excepting and reserving therefrom the easements for roadways and other public services heretofore acquired and existing. The parcel of real property from which said easement is abandoned and vacated is described as follows: All that certain real property situate in the City of South San Francisco, County of San Mateo, State of California, described as follows: BEGINNING at a point which bears South 17° 48' 10" East 26.04 feet from the southeasterly corner of that certain 0.146 acre parcel of land acquired by Wilberg Bros., a description of which was recorded March 9, 1923, in Book 66 of Official Records of San Mateo County at page 381; thence southeasterly around a curve to the right, having a radius of 100 feet, a distance of 42.29 feet; thence continuing in a southeasterly direction, around a curve to the right, having a radius of 275 feet, a distance of 180.47 feet; thence continuing around a curve to the right, having a radius of 200 feet, a distance of 148.59 feet; thence South 12° 51' West, a distance of 118.12 feet; thence South 75° 54' 08" West 25 feet to the easterly line of the Southern Pacific Railway Right of Way; thence in a northwesterly direction, on the easterly line of said right of way, on the arc of a curve to the left, having a radius of 530.26 feet, a distance.of 500 feet; thence North 1° 32' 46" West, to a point which is South 25 feet from the southerl~ line of said Wilberg Bros. property; thence North 88v 27' 14" East, parallel with said southerly line, at a distance of 25 feet, measured at right angles therefrom, 172.49 feet to the point of beginning. which was dedicated to the City of South San Francisco by deed from the South San Francisco Land and Improvement Company, a corporation, dated October 23, 1928, and recorded November 10, 1928, in Book 381 of Official Records of San Mateo County at page 288 (22077B). Reference is made to documents and deeds on file in the City Clerk's Office designating said easement. I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 6th day of October, 1958, by the following vote: AYES, Councilmen G.
