HomeMy WebLinkAboutReso 2710-1958RESOLUTION NO. 2710 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO GRANTING THE RIGHT AND PRIVILEGE TO PACIFIC GAS AND ELECTRIC COMPANY AND PACIFIC TELEPHONE AND TELEGRAPH COMPANY TO SUSPEND WIRES AND TRANSMISSION ,LINES ACROSS CITY PROPERTY WHEREAS, it is necessary to locate wires and transmission lines across a certain six (6) foot strip of land to service industries in the area of Roebling Road and the City desires to grant to Pacific Gas and Electric Company and PaciTfCl~l~one'&Telegra~ Company the right and privilege of suspending and maintaining said lines. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that Pacific Gas and Electric Company and Pacific Telephone and Telegraph Com- pany Company are hereby granted the right and privilege of suspending, inspecting, re- placing, maintaining and using such wires and crossarms as shall from time to time be necessary for transmitting and distributing by Pacific Gas and Electric Company of elec- trical energy and for rendering by Pacific Telephone and Telegraph Company of telephone and telegraph service respectively, together with a right-of-way therefor over and across certain premises situate in the City of South San Francisco, County of San Marco, State of California, which are described as follows: That certain parcel of land conveyed by South San Francisco Land and Improvement Company to the City of South San Francisoo by deed dated August 28, 192~, and recorded in the office of the Recorder of said County of San Marco in Book 447 of Official Records at page 453, The route of said wires across said premises shall be as follows: Within a strip of land of the.unlfor~ width of 3 feet, lying equally on each side of a centerline beginning at a point on the south- easterly boundary line of Roebling Road, as said Roebling Road is delineated and so designated upon the map entitled, "Milland Tract, City of South San Francisco, San Mateo County, California," which map was filed in the office of the Recorder of said San Mateo County in Book 48 of Maps at page 50; distant thereon North 33° 22' 42" East 36.74 feet from the point of intersection of said south- easterly boundary line of Roebling.Road and the northerly boundary line of East Grand Avenue, as said East Grand Avenue is shown upon said map; thence extending from.said point of beginning South 1° 33' 30" West 11.40 feet, more or less, to the southeasterly boundary line of the above mentioned parcel of land. BE IT FURTHER RESOLVED that said grant of right, privilege and right-of-way is subject to the rights that may exist in any other parties whether recorded or unrecorded. Should any other parties establish rights to said six (6) foot str~p of property and require City to remove this right-of-way and the right and privilege herein granted, City shall have the right.to terminate the right, privilege and right-of-way granted by giving thirty (30) days written notice to Pacific Gas and · Electric Company and Pacific Telephone and Telegraph Company. Such right, privilege and right-of-way may be terminated without City incurring:any liability or cost to Pacific Gas and Electric Company and Pacific~Telephone and-Telegraph Company and/or any of their users. BE IT FURTHER RE~OLVED that the Mayor is herebyauthorized to execute a document granting to Pacific Gas and Electric Company and Pacific Telephone and Tele- graph Company said right, privilege and right-of-way. I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City.of South San Francisco at a regular meeting held on the 17th day of November, 1958, by the following vote: AYES, Councilmen G, J.
