HomeMy WebLinkAboutReso 2734-1959RESOLUTION NO. 2734 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AUTHORIZING SALE OF LOTS 3 AND 4, LOFtA LINDA TERRACE ~HEREAS, the public interest and'convenience requires that the City of South San Francisco sell and dispose of Lots 3 and 4 of Loma Linda Terrace, South San Francisco, California, fOr the common benefit, WHEREAS, the City Council of the City of South San Francisco desires to call for bids on sale of said lots. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of South san Francisco does intend to sell all of its right, title and interest to Lots 3 and 4 of Loma Linda Terrace as is to the highest bidder for cash on the 16th day of February 1959 with the provision and condition that bids for less than FOUR THOUSAND DOLLARS ($4,000.00) for each lot shall not be considered and further that the City Council reserves the right to reject any and all bids. BE IT FURTHER RESOLVED that this call for bids and sale of said lots shall be subject to the following terms and conditions: 1. Bidders may submit bids for one or both lots and bidders may state whether bid is limited as offer for both lots only. Should bidders so fail to state, City may accept the highest for any one lot and combine it with highest bid for the other lot. 2. Bidder shall post ten percent (10%) of his bid in cash or certified check at the time said bid is filed with the City Clerk. Upon failure of bidder to post the ten percent (10%) of his bid in cash or certified check, City may refuse to consider said bid. 3. Marketable title shall be evidenced by policy of title insurance issued by the Western Title Insurance Company or San Marco County Title Company at expense of City. 4. Bidder assumes any encumbrances and assessments. 5. The ten percent (10%) deposit heretofore required shall apply to the purchase price and the balance of the purchase price shall be deposited with Western Title Insurance Company or San Mateo County Title Company within fifteen (15) days after execution of agreement of said sale executed by City and bidder. Should bidder fail to complete purchase of the property, City may retain the ten percent (10%) deposit as liquidated damages and shall be released from any and all obligations in law or equity to convey said property 'to bidder. 6. The terms and conditions set forth in the notice calling for bids is incorporated herein and made a part hereof. BE IT FURTHER RESOLVED that the time fixed for considering said bids and hearing protests to the proposed sale shall be at 8:00 p.m. on the 16th day of February, 1959, in the Council Chambers, City Hall, South San Francisco, California, and that publication of the notice of said hearing.shall be made in the Enterprise Press more than ten (10) days prior to said date and further that final action with respect to sale of said lots shall be taken by the City Council at said time. I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held this 19th day of JanUary, 1959, by the following vote: AYES, NOES, None ABSENT, None Councilmen G.
