INDUSTRIAL PARK UNIT NO. 2-C GRADING MAINTENANCE DISTRICT -,INDUSTRIAL PARK UNIT, NO. 2-C, 'ZONE 1 RESOLVED, by the City Council of the City of South San Francisco, Calif- ornia, that WHEREAS, on the 6th day of April, 1959, said Council adopted its Resolu- tion of Intention No. 2764 to acquire and construct the improvements hereinafter described; WHEREAS, it was provided in said resolution that said Council intended to order a grading maintenance district formed in the area therein set forth for the purpose of maintaining and operating the grading, including sloping for the proper drainage of the area of the assessment district and for the protection of the streets to be constructed from overfIow, by water, and any improvements which may thereafter be constructed therein; WHEREAS, notice of said proposed improvements and of the formation of said district was given in the time, form and manner provided by law, all as appears from affidavits on file in the office of the City Clerk; WHEREAS, at the time and place specified in said notice, no protests or objections were made or presented to the forming o.f said grading maintenance dis- trict, and said Board has adopted a resolution ordering the work and acquisitions and confirming the assessment; WHEREAS, said acquisitions and improvements are described as follows: (a) The grading of the area within the assessment district, including sloping for the proper drainage of the area of the district and for the protect- ion of the streets to be constructed therein from overflow by water. Easements are hereby granted to the City of South San Francisco for said purposes for the period of construction,.at the expiration, of which time they shall terminate without further action by either party. (b) The improving of Utah Avenue from 350 feet west of Rozzi Way to 470 feet east of Rozzi Way, Llttlefield Avenue from 400 feet west of Rozzi Way to 150 feet east of Rozzi Way, and Rozzi Way for its full length, as shown on the Map of South San Francisco Industrial Park Unit No. 2-C, by the construction therein of 8 inches of untreated base pavement and 3 inches of plant mix surfacing, and Portland cement concrete curbs, gutters and sidewalks. (c) The construction in said streets and in the easement between Lots 15 and 16 as shown on said Map, of reinforced Portland cement concrete culvert pipe and corrugated metal pipe storm drains with standard catch basins and outlet structure. RESOLUTION NO. 2778 (CONTINUED) (d) The installation in said streets of asbestos concrete sewer mains with s-~andard manholes, cleanouts and appurtenant structures. (e) The construction in sa~d streets of a fire alarm system complete inClud- ing conduit, boxes and connection to City system, and also street signs and street bar- ricades. (f) The acquisition of all lands, easements, facilities and work relating or auxiliary to any of the above and necessary to complete the same. NOW, THEREFORE, IT IS ORDERED, as follows: 1. That all written protests and other written comunications were publicly read at said hearing and all persons desiring to be heard were fully heard, and that all protests be, and each of them are hereby, overruled. 2. That a grading maintenance district is hereby formed to be entitled "Industrial park Unit No. 2-C Grading Maintenance District", and that the expenses of maintaining and operating all grading, including sloping for the proper drainage of the area of the assessment district and for the protection of the streets to be constructed from overflow by water, or any such improvements which may hereafter be constructed, including the cost of necessary repairs, replacements, fuel, power, electrical current, care, supervision, and any and all other items necessary for the proper maintenance and operation thereof, to be assessed wholly upon the lands lying within the district bene- fited by and to pay the costs and expenses of said improvements, which is the district hereby determined will be benefited by said improvements pursuant to Chapter 26 of Part 3 of Division 7 of the Streets and.Highways Code. 3. The City Council shall hereafter maintain and operate said improvements in the manner provided in said maintenance district law, and shall in each year prior to the time of fixing the City tax rate, estimate the cost of maintaining and operating said improvements during the ensuing year, and decide whether or not the cost of the same shall be borne wholly or partially by the maintenance district, and shall in ad- dition to all other taxes, fix a special tax rate for the real property (land and im- provements) within said maintenance district sufficient to raise an amount of money to cover the expense of maintaining and operating'~aid improvements during the ensuing year or such portion of said amount as the City Council shall determine shall be borne by said District. 4. The City Council shall annually levy a special assessment upon the real property in such district sufficient to pay such expenses or portion thereof which must be paid by the district, which special assessment tax shall be levied and collected at the sa~e time and in the same manner as the general tax levy for city purposes, and when collected shall be paid into the City Treasury to the credit of the fund of the maintenance district and to be used for the payment of the expenses of said district, and said Council shall control and order the expenditure thereof for such purposes. 5. The City Council may temporarily transfer moneys to the maintenance dis- trict fund from other funds in which are moneys as are not immediately needed, and such moneys so transferred shall be used for the purposes provided in said maintenance dis- trict law and be retransferred from the maintenance district fund out of the first available receipts. 6. The City Council shall include in the first budget of said district and in the first tax levy a sum sufficient to repay the city the amount so transferred to the district during the period of time in which no levy of taxes was made for that pur- pose, and the amounts so transferred shall be retransferred to the city~treasury from the maintenance district out of the first available receipts of such tax levy. 7. The exterior boundaries of said maintenance district are the composite and consolidated area consisting of Lots 13 through 16, Block 3, Lots 9 through 15, Block 4, Lots 19 through 24, Block l0~ and Lots 1-through 8, Block 14, as shown on the map of South San Francisco Industrial Park Unit No. 2-C. 8. The City Clerk shall cause certified copies of this resolution together with metes and bounds descriptions and maps showing the~boundaries of the grading maintenance district to be filed with the City Assessor of the City of South San Fran- cisco and with the State Board of Equalization prior to the first day of February, 1960. I hereby certify that ~he foregoing resolution was regularly intro- duced and adopted by the City Council of the City of South San Francisco at a regular meeting held this 20th day of April, 1959, by the following vote: AYES, Councilmen Andrew Rocca, G" J""R°zz'i~ Emilio Cortesi, Leo J.
